Yes, perfect memorization of the test... How that test was actually administered we will never know. Unfortunately police are under pressure to say all the correct things on the witness stand or risk admonishment from the prosecutor and their superiors. We really have a more corrupt system than people acknowledge. I'm leaving out the fact that a cop can't perform a neuro-ophthalmological exam on the side of the road or anywhere for that matter.

Also unfortunately he incorrectly identifies the jerk eye movements he sees when testing for smooth pursuits as nystagmus when actually it is a saccadic eye movement.

This is true. That's why you have a court date. But prior to all this you have a bac test.

@@keryobryan1450 what about: Chriari type 1 malformations, foramen magnum mass lesions, platybasia, spinocerebellar lesions, congenital, hypomagnesemia, B12 deficiency, west nile encephalomyelitis; phenytoin, carbamazepine, lithium toxicity; MS, infarction, cerebellar degeneration, tumors, and smoking. Do you ask about all of those? Do you think people would know if they had anyone of those things? The fact is this test is a joke and performed wrong every day because cops are taught the test, but not the reasons why it is important to administer the test correctly. Did you know it is possible to induce physiologic nystagmus in people in lateral gaze of 30 degrees? The cop in the video does not even realize that the lack of smooth pursuits does not mean nystagmus, it means the eye stopped momentarily and had a saccadic movement. But hey it's called the horizontal gaze nystagmus test, and I am looking for lack of smooth pursuits so let's call it nystagmus. Do you know how many normal people lack smooth pursuits? Many. Especially if you move your stimulus with higher angular velocity. Stimulus too close? That gives higher angular velocity and saccadic eye movements. He also said that his pen tip had a high contrast stimulus. High contrast in compared to what? The background of moving cars? His shirt? The trees in the background? Oh, it must be the uniform background that he is standing in front of. Give me a break. But it sounds nice on the witness stand. This guy memorized the procedure for the test out of a book and puked it up on the witness stand, to hell with how he really administered the test. Cops use terms like medical assessment and pupil assessment as a part of testifying 1) to sound more official and make it sound like it is less of a sham and 2) because they were probably taught that they are doing one by improperly checking pupils. Did you know when assessing for anisocoria it matters whether you are checking in bright or dim illumination? This is because someone could have anisocoria and it wouldn't be noticeable in bright illumination, but present in dim. Note: he checked in broad daylight. Also to properly check pupils a pupil gauge should be used. Eye doctors use them to measure pupil size, but I guess cops are just THAT good. Plus anisocoria does not require immediate medical attention, it is very common. 20% of people have physiologic anisocoria. There is no medical reason why anisocoria it would preclude someone from performing the test, it's not like if you have anisocoria you have nystagmus. Sure the pathway for pupillary response goes to the midbrain, but it also dips to the apex of the lung and back up. But it sure sounds good on the stand to say that they are checking for "medical reasons" which would preclude you from taking the test, even if they are inept and would never find any. I'm not trying to blame cops, but it is absurd to make them think they have the knowledge and skill to perform a medical test which few doctors are competent to perform and they have studied the neuro pathways. If you are not seeing eyeballs all day everyday you have no business performing this test. I saw a video where a cop arrested a guy because he saw hippus (normal fluctuation in pupil size). It's surprisingly complex and is even more scary now that they have "drug recognition experts" roaming around who can make your life miserable spending a couple of years in court even if you pass a breath test.

@@keryobryan1450 I didn't say drugs had no effect, nor did I say it wouldn't affect one's ability to drive, nor that it couldn't be inferred by doing a battery of tests. I just don't think you can train a cop in a weekend (or ever) to go out and decide if someone under the influence of anything by administering them. "Drug recognition experts" are not experts and are not equipped or qualified to administer the tests. They consistently get it wrong and innocent people are left dealing with the legal consequences of horrible decisions at the hands of unqualified people (it happens too often). I get that driving under the influence of drugs is a problem, but pseudoscience is not the answer. My point was all these tests are used for is to make an arrest look legitimate in court and the only somewhat reliable method is a PBT and even if you pass a PBT you are not safe if a "DRE" thinks you're on something. If you think it's justified tell that to the professor in Georgia who was placed under arrest driving with his kids and had CPS get involved, lost his license. The cops said he failed the tests because he had TRACE amounts of cold medicine in his system from 2 days prior.

@@keryobryan1450 not a defense attorney or involved in law in any way, nor have I ever been arrested for driving under the influence, just a concerned citizen. But I have been pulled over and told that "there was the smell alcohol" and on a separate occasion my pregnant sister driving alone was told the same thing. I also had a friend who I was riding with do a FST and was told he had to do a PBT because he "failed the eye test" then blew zeros and was released. Like I said I'm not blaming police, you all have been sold a bill of goods, but it's impossible for pretty much anyone with the exception of a neurologist or neuro-ophthalmogist to detect drug use using these tests, and even then I doubt they could specify what drugs someone is on, which what is taught in the courses. I understand your training tells you that you have this ability. I've seen the training documents from the companies doing the training, you've been lied to. Do me a favor when you check for anisocoria, check in bright and dim illumination and use a pupil gauge.

Isn't it fact trooper that it was wasn't sunny that day it was midnight and the pavement wasn't even or smooth and that you had him exit his car walking up hill on a rocky road pitch black, windy, raining and foggy as well isn't that true?

Bruh, she's speaking in public on an important matter full of all of the rules of evidence and the court. Some people begin wavering their voice when in that position.

Cop how would you know the difference between nystagmus due to chronic brain disorder vs acute vs drunk. I wouldn't want to be sent to the hospital or to jail because you don't know the difference. I don't know if I actually have nystagmus but I do have a chronic brain disorder

The test can still be performed on people with resting nystagmus btw. Their eyes will shake as its resting but will immediately stop when they are focusing on something moving. This is fact.

That is why there are more tests to see the balance, the heel to toe walk and one foot stand. Plus the breathalizer. Plus the counting backwards and reciting alphabet, the finger to nose...

HGN test is like playing a trick on a little kid!!! You tell them to follow the point. So you proceed to smoothly move it back and fourth. And usually they have no problems tracking it 2x. That program’s the brain to think that the next time this happens, the point is going to move smoothly back and fourth. So the next time you do the test, but this time for smooth pursuit; you stop at maximum deviation and hold for 4 seconds. Well you just subliminally programmed the persons brain to think it’s going to smoothly move back to the other side, but it doesn’t. So the brain and eyes short circuit waiting for it to move back because it’s anticipating it to move!!! Not really fair in a heighten situation where humans get nervous/anxious, and their hearth rate climbs. Tunnel vision sets in, and the bodies survival instincts take over.

Lol that’s why you hold it for 4 seconds. It takes a millisecond for the brain to calculate that the stimulus is now stationary. So when the eyes bounce many times within 4 seconds, it’s pretty convincing. It’s science… not child’s play.
