There is no such loophole as the OP never signed any contract with the HOA.

Yeah, even if property was in the HOA at one point, if it had been removed, however that happened, that's it. The HOA has no power over the property whatsoever.

My complaint is that the HOA officers had their insurance pay the settlement, and the premium increases will be passed on to the HOA rank and file. The Officers should have to pay individually and severally personally the settlement costs, and forfeit their official standing.

@@lonnysimmons1889 It's an educated guess. HOA officers NEVER make personally accountable mistakes. The insurance pays off the losses. When premiums rise, the rank and file pay the added fees.

Actually, in my state HOA officers have to buy their own liability insurance because they are personally liable for all decisions they make. It’s one of the reasons I didn’t get on my board.

Kennedy vs the Canal Sreet Condominium Owners, proves that a " view" is NOT an intrinsic right of property ownership. In this case, the condo owners filed suit, seeking to prevent developer Chris Kennedy for constructing a new condo building next to theirs, claiming that said new building would block their view, of the Chicago River, damaging the value of their condos, the judge ruled as above, and the new structure went up. ( at the time I was employed by the Kennedy family, and was the first of the employee's to find out, that the condo owners planned to file suit as a group of them showed up at my desk, one night redfaced, and angry, screaming that they wanted to know if rumours about Chrises plans were true, because employees at my level weren't privy to his plans, I referred them to higher authority)

A very long row of very TALL fully wide pine trees that only grow out and full over the years. That will not only block their precious view but also block any cool breezes that may flow across his property. A fence might have a height restriction, but trees don't.

The thing people don't realize is that H0As have ZER0 authority over those who do not sign onto their charter. If you move onto a property, it is yours lock, stock and barrell. When they come knockig with their regulations, you can tell them to keep walking. They only have authority if you sign on the dotted line and become a member.

In the US, if you try to buy a property that is part of a HOA, then you are given a contract (normally named Terms and Conditions). If you sign that contract, then you are subject to the contract. If you don't sign that contract, then in most jurisdictions you can not buy the property. Period. Don't sign a contract without having your lawyer reviewing it. HOAs are just contracts, the terms and conditions vary widely; however, City, County, State and Federal laws always supersede any HOA rules or bylaws. edit: I am not a lawyer, consult a real one (as I said above).

@@conjumonblue6450 Fun fact, you can ask for time to read it, retype the contract exactly as it appears but with different terms that favor you massively, sign it, submit it, and if they accept it... it's legally binding. In the 90s a guy did this to a bank, getting a credit card with unlimited credit and no fees. It took the bank 9 years to stop him from just paying for everything with that card. He spent 23 million dollars before that contract could be voided because he messed up XD

Most HOAs in the United States operate illegally. They can’t tell you what color to paint your doors or regulate the color of your blinds or curtains. If they don’t have a color chip standard or a color meter reading they can’t tell you what color to paint your house. This was all established by federal court cases. In my state, to be on an HOA board you must take a class and get certified. If every board member isn’t certified, the board can’t issue fines. In fact it can’t legally do business at all. It doesn’t matter unless someone challenges the board in court. I took the class and got certified then noped out of joining my HOA board because they were doing illegal things. I took them to court and got the HOA dissolved. I sold my home at a good profit and bought another HOA home. That HOA was also operating illegally. I got that HOA dissolved. I made enough profit from the property to buy a new house free and clear with no HOA.

I don't get it. I have never heard a GOOD story about an HOA. They seem to do absolutely nothing, but cause trouble. So why does anyone join one, or allow one to grow in their neighborhood? Maybe the good side is never talked about. But that doesn't really make sense.

@@jezeski2011 Most HOA's are benevolent organizations and actually do good things. You almost never hear about the good ones. They organize the neighborhood to keep common areas like, for example, the central clubhouse, neighborhood pool or condo building maintained. When entitled, narcissistic, OCD, greedy, stubborn, criminal, A-hats get to be in charge then there are problems.

In the US, Federal law allows ocean access to the public up to the high water mark. I believe that the same law applies to "navigable" rivers. It does not apply to non-navigable streams, lakes or ponds. As for blocking the view there are no federal laws, most States leave that up to the local zoning authority. Contact a lawyer to see is applicable. What is legal in one place might be illegal just a few miles away.

@@conjumonblue6450In Washington state, every creek river or pond that is wet year round is a public right of way. There are no private beaches. It’s all public. The treaty with the Indians before it even was a state established that. Californians come here and try to wall off the beaches, saying it’s their beach. They usually get a visit from local law enforcement telling them to take down the fences. A Californian bought land on both sides of a river and then tried to say it was his river. The local sheriff arrested him after he wounded several people fishing in their boats. The rivers and creeks flood regularly here and I don’t remember what they use for right of way but I think it is the highest point the water has ever flooded to. Which would make whole valleys right of ways.

@@richardbeckenbaugh1805 State law in supersedes the Federal law in a case like this, which is why I suggested people contact a lawyer to see what applies in their situation. At the very minimum the Federal law would apply. That jerk that bought land on both sides a river and tried claim the river would have his claim is shot down in every state in the US.

Water haul: Water allocation by the USDA/BLM for firefighters is 2 gallons/day. For 18 people that translates to 36-40/day. Even without the well supplementing what he brought, he supplied 6 days of water per trip. I was twelve years old when grandma got running water and an indoor toilet and we had extended family parties. Therefore I have exactly no sympathy for these people. In 1973 my ship went 7-10 days with no washing and drinking water was shut off from 6 P.M. to 6 A.M.

It has to list if its in an HOA and on forms at closing stating NO HOA, If it was removed from HOA by the previous owners File a lawsuit, sue.
