All they had to do is tape a notice on the front door if the person was never at home. Would like to know where all the annual bills and regular HOA notifications were mailed to. Probably previous owner. NC requires disclosure of HOA. Even Zillo indicates this home has HOA dues. The real estate agent that sold this home failed. This HOA does have a main entrance with two large masonry walls with the name of the community on it; but no mention of "association" or "managed by" info. I hope she can get her home back and some money.

I work at a property management company (not in NC) and we just took over managing an HOA that was being cared for the the board. We only take pictures, do inspections when needed and help find vendors, take payments for HOA dues and send violation tickets and fines. Several of the houses in it have over $15k owed in dues because the people managing the HOA before did not to get organized and collect dues. So we inherit that mess and we have not out a lien in a single home because we understand that even though it’s owed they have not been informed, contacted or told so with what nerve do you spring one day and tell someone pay the $24k now (our highest balance int that HOA) or your out? They did that on purpose in my opinion.

HOAs are certainly predatory entities and should be dissolved or become heavily regulated. But, how does a person buy a home and not know it's part of an HOA? When a person is signing the contract and related documents for a home purchase, wouldn't certain documents include language indicating HOA fees, homeowner responsibilities to the HOA, HOA responsibilities to the homeowner, etc.? And why does a person never review at least some of their so-called junk mail especially if it's "official looking" just to be sure it's really junk and can be discarded? Any unusual/new mail I receive I will read to determine whether it's junk or something that needs to be dealt with. Some mail pieces will be obvious junk, but it's important to make sure before tossing it out.

Even if the real estate agent didn't mention the HOA, if there were no papers she signed stating she was joining an HOA, the HOA can't do this. This poor lady has worked hard to buy this home.. then because of some hidden rule in her HOA it can be taken from her..... it is just not fair ( and without proper notice or someone coming to her house and discussing it with her??) The rules are not hidden. At the very least she should have known she had to pay dues and apparently at some point she was. They sent her notices. She threw them away. They should have sent certified return receipt requested but she probably would have ignored that too. The county can also take your house if you don’t pay your taxes. Way back before foreclosures were commonplace my friend, who had been diagnosed with a non malignant brain tumor, lost his house for missing two payments. Life is brutal and you HAVE to look out for yourself as best you can. This is scary though

Added info is that she is ALSO DELINQUENT ON 2021 house taxes due….meaning a yr and a half ago not paid up. She only got notice of eviction from HOA this summer. Add also, SHE IS PRESIDENT OF A COMMUNITY SERVICE ORGANIZATION and has been involved in sheriff activities too. In other words, she IS FULLY AWARE of her HOA, HER FINES, ETC. DO NOT be fooled here.

She was aware, just did not want to pay. She threw out notices without reading. She did not answer door to process servers. There should be laws against this. If you do not talk to the owner of the home in person with receipt of their signature they should not be allowed to acquire hundreds of thousands of dollars over a couple thousand dollar debt and evict someone from their home. I do NOT believe this homeowner had no idea that she was purchasing a home in a common-interest, covenant-controlled community. Absolutely NO WAY she could not have known it. For one thing, she would have been notified (after purchasing) by the HOA's management company of her HOA assessment amount and where to send payments. For another she would have received periodic communications and notices concerning HOA annual meetings and other business. I, for one, am not fooled by her tears and sniffles.

I call BS. She paid it off. Which means there was a mortgage. Which means there was a title search. Which means they would have seen that the house was part of the HOA on the deed and that the HOA was registered with the county recorder of deeds. These are big houses in a subdivision with monuments out front and maintained landscaping. Someone manages that. Who could that possibly be? Well golly gee, there is an HOA. Has she never in all those years heard a neighbor mention the HOA? And shes never received anything like a newsletter and the annual meeting info from them? What about her neighbors? Shes the only person in the entire Hood who had no clue the HOA existed? Of course not. Ill bet her signature is on the closing docs that state there is an HOA and the annual fee is $X. If all this was somehow missed, she needs to contact her title insurance. Get the other side before coming to conclusions. These news pieces are always completely lacking context and half of the facts. Ill guarantee there is a slew of information not being shared. She knew she was in an HOA. I’m on my HOA’s Board…the homeowners are always contacted by lawyers. They either ignore the notices or they don’t think anything can be done to them. Get involved in your community, get to know your neighbors, read the covenants & bylaws…you MUST GET ENGAGED IN ALL ASPECTS OF YOUR LIFE!

@@badfanedits lolol you’re so right. I just love increasing our property values by maintaining our streets and other infrastructures. I also enjoy ensuring the safety and sanity of our neighbors. Not to mention, I love making sure our city’s officials keep their promises to our tax paying neighbors. But you wouldn’t know anything about that because you probably don’t care about anyone but you! Oh yeah and if there are no engaged homeowners on the HOA board we leave it to the state and that my friend would be a travesty. But you enjoy your miserable day!

@@rpm10k. oh yeah I’m the worst but our community’s property values have increased, allowing homeowners the option to sell at a higher price. We have also made strong connections with our city officials and they are Johnny on the spot when we need something m done. We are a safer and more secure community. And our neighbors actually like each other. So maybe you’re the WORST kind of person because you haven’t taken the time to understand how HOA’s operate and how they can increase you quality of living. But I digress.
