Excellent point! A horse will always be a prey animal and no matter how well trained and mild mannered one is, they can all still be spooked into flight-fight response. One kick or a good bite is all it takes. Animals should be respected, but try and tell that to these people.

Passenger. In general, a passenger is one who gives compensation for a ride. Shapiro v. Bookspan, 155 Cal.App.2d 353, 3 1 8 P.2d 123, 126. The word passenger has however various meanings, depending upon the circumstances under which and the context in which the word is used; sometimes it is construed in a restricted legal sense as referring to one who is being carried by another for hire; on other occasions, the word is interpreted as meaning any occupant of a vehicle other than the person operating it. American Mercury Ins. Co. v. Bifulco, 74 N.J. Super. 191, 181 A.2d 20, 22. The essential elements of "passenger" as opposed to "guest" under guest statute are that driver must receive some benefit sufficiently real, tangible, and substantial to serve as the inducing cause of the transportation so as to completely overshadow mere hospitality or friendship; it may be easier to find compensation where the trip has commercial or business flavor. Friedhoff v. Engberg, 82 S.D. 522, 149 N.W.2d 759, 76 1 , 762, 763. Waited until the sun was setting, traffic was light. But no streetlights or lights carried by the horse and rider. Along came a modified car, with an exhaust that pops when throttle is released. Driver sees a horse just up ahead of him, let's off the gas. POP POP POP Spooked horse spins right in front of the car. Everyone is injured, horse got put down due to it's injuries. @@daveroberts289 The real reason they do not train Police to a higher standard is two fold. The primary reason, is because they have qualified immunity. They know that when a cop eventually fucks up and violates someone's rights, the Department and the individual cop will be protected by it. Secondly: "IF" the cop looses his qualified immunity, the tax payers pick up the tab in the lawsuit against the Department. They then hang the cop out to dry, and he stands to loose big personally in that same lawsuit. They are simply doing the math that they "probably" will get qualified immunity. And if not, oh well, its just the tax payers money anyway.

Yes, my friend (1 Tennessee Walker and 2 Quarter Horse) and I (1 Morgan and 1 Arabian) used to ride our horses all over around here and only got stopped once (our own fault) in over 8 years. We both unfortunately received a well deserved "drunk and disorderly" citation and a friendly escort to the end of the cops jurisdiction. No mention at all of the horses not being allowed on the roadway (because that would have been BS).

Stupid + gun + badge + tender ego is a recipe for disaster. These clowns have no clue about law or the natural laws of horses. Back in the day a cop would just slow down and give a horse a little room on the road. 4 cop cars and stopping a guy on a horse, blocking traffic, harassment go beyond anything reasonable.

So this big farmer dude in overalls told all the party goes he would drive them home so he left and came back with some giant plow horse and a wagon behind it and he took every person home by horse and wagon while to cops followed them the whole time but didnt know what to do. I am 66 years old so it was a few years ago, but I rode my pony then a horse all over town when I was a kid. No one ever said anything to me. True, one town's population was only about 16000 people and the other was around 3000. Why don't cops get there correct information before making an ass of themselves. Then when they find out they are wrong cry they did it for public safety. No, They think they know everything and allow their big, fat egos to get in the way. All public employees need to be accountable for their actions, but unfortunately they are not. In the private sector if a person makes a mistake they can get reprimanded and even possibly lose their job. Rarely does anything happened to government employees when they make a mistake.
