Exactly, and I just watched another video where a man was being threatened by his gf’s ex with a gun and he even had a protection order against him yet the officer told the victim there was nothing that could be done unless he was physically assaulted. But they’ll go to an old man’s house and arrest him of the word of a Walmart manager over a tv…. I guess the giant corporations have priority with law enforcement over us common folk…..

Technically, he was out of order, but definitely not guilty of a crime. The manager is definitely not qualified to do her job or else this would have been settled, and it would have happened in 10-15 minutes, not over 30.

Most Sales have a 30 day return or exchange to the store.. Warranties are taken up by the manufacturer to either repair or replace the item... His Tv was almost 1 year old... He should have called the manufacturer Not return it to Walmart... Walmart management to should have known this.

Just in the last year they updated the terms and conditions to prevent people from suing them, and a patent came out from them showing a way to display ads even when you aren’t using Roku such as playing a video game or things like that. Even if nothing becomes of the patent, that shows their true intentions.

For those who couldn't follow, this is what happened: First of all, Utah law requires the seller to honor the implied warranty. Walmart Customer Service line also told him that. WALMART CUSTOMER SERVICE TOLD HIM TO TAKE HIS TV FOR REPLACEMENT. This is important. When he did as Walmart told him, the store kept telling him that they couldn't scan his original receipt, and gave him the run-around about that. After he got a REPLACEMENT RECEIPT because they kept saying they couldn't scan the original, THE MANAGER TOLD HIM TO GRAB A REPLACEMENT TV, so Walmart could honor the implied warranty. So he grabbed a replacement TV. Then A DIFFERENT MANAGER stopped him & told him they'd arrest him for stealing if he left the store with it. Since he was 1) doing what Walmart told him [the return], 2) doing what Walmart told him [showing the original receipt], 3) doing what Walmart helped him to do [showing the replacement receipt], 4) doing what Walmart told him [grabbed the new TV], & 5) doing what the law in Utah says Walmart is supposed to do for him [upholding the implied warranty], he left with the new TV. Then they still had him arrested, just for 💩💩 & giggles. Charges had to be dropped because that Walmart employee was in the wrong. He did NOT take the law into his own hands. It was hard to follow because Walmart gave him the run-around, which is designed to frustrate people into just giving up.

Not surprised. I bought a brand new Asus laptop from Best Buy with cash. As I was walking out the door, a manager stopped me and demanded I pay an additional $150 on top of the $750 I had just paid them. She claimed the price was wrong, but I know what the sticker on the shelf stated and the receipt showed the same price. She then threatened to have me arrested should I leave, I told her to go ahead and call the cops and I warned her security not to bother putting their hands on me. The GM ended up making it right by apologizing and giving me a $1,200 Asus model in place of the one I bought. It still shouldn't have happened to begin with. No one deserves to be threatened with arrest for something they clearly bought and paid for, its disgraceful.

I used to work at Best Buy. 10,000% that manger messed up. I bet they were on a performance plan for under performing managers and she thought losing money on that sale because of a messed up price tag could cost her, her job. Best Buy does lose money on basically every single laptop they sell. They make up for it by selling the accessories, warranties and services.

Police, lawyers and the courts still see those expunged and sealed records. They just aren't supposed to use them against you when sentencing.

This is one of the worst local news affiliate stories I’ve ever seen. It’s absolutely astounding how horrible of a job they did conveying the story. We had no idea which TV he was leaving with. The one he already purchased? A new one off the shelf? We had no idea why it was a problem to do so. This was a 4 1/2 minute segment - which is an eternity on the local news affiliate considering the program is usually about a half hour of actual news reporting. So it’s astonishing this actually made it to air whilst never actually being specific about the details of the story.

But as he was walking out the door with his replacement, he said that’s when another manager threatened to arrest him for theft should he leave. I got really angry. I said ‘Listen, I did exactly what you folks told me to do,'” DeSantis told ABC4. “I had the reference number. I have the receipt. I’m entitled to the TV. Onn TV's are what are known as House Brand TV's, like Kirkland for Costco, and Ryobi for Home Depot. Onn TV's are ONLY sold by Walmart, and are basically a Walmart brand TV's. 3. The Onn TV uses the ROKU Operating System, hence is known a a ROKU TV, just like buying a Google Pixel Phone is known as an Android phone, because it uses the Android operating system. 4. He worked as a consumer lawyer UNTIL he retired. Just wow.... I'm stunned you even completed 1st grade....

it did for many months, then it stated showing issues about a year in. Sounds like the Power board had short, or the TCON board had an issue. A simple 30 min fix if he contacted ONN RMA dept. They likely would have sent out a guy who would swap it. Or bring a replacement to his house and take the broken one.

If that's the case, wasn't filing a police report accusing him of theft was a flat-out lie? As a result of that lie, this man was arrested. Thankfully, It seems the man was retired and didn't have to worry about losing a job. Facts are when the average person is arrested, it's common for that person to lose their job. To make matters worse, most folks can't afford a lawyer, and making bail is a financial hardship. You see where I'm going here? Being arrested can devastate a person's life. For that reason, I believe what walmart did here is criminal. The odds of anyone at walmart being arrested over this issue

Not to mention, a lot of folks are just not confrontational enough to stand up for themselves. Remember the whole "United Healthcare CEO assassination" thing? While digging a little on that story, I learned that UH will deny up to 75% of all claims--which saves them a whopping amount of money. And of those denied claims, nearly 90% of people fail to appeal the insurance company's decision. I learned about this a couple of years ago when my local hospital claimed I owed them nearly $300 that I knew were visits that the insurance should cover. It took nearly 9 months of haggling between the hospital billing people and the insurance, and it turned out that the hospital had simply failed to submit some annual letter or another before the insurance company would consider them "in-network". When they got that corrected, the claims were promptly paid and the darned hospital finally left me alone. But, the problem is you have to stand up for yourself, document everything and insist everybody live up to their obligations.

We are talking about a retail price of $400-$500, then take the time to research the company policy and make any needed changes. Then, have your team leaders take 10 minutes during their next meeting to go over the policy.

Even if there is a contractual agreement a court would have to enforce it in the event of a dispute. A party to the contract cannot, on their own, doesn't have the legal authority to deprive another of property. This guy knew that he would win in the end. Don't think he really thought that he would get arrested in the process though. As a pointer, anyone pushing this boundary, should not answer the door when the cops come calling. Let the detectives try to deal with it. In most departments, the case will get pushed to the back burner.

I bet you do & that is why you tossed in the disclaimer element. 🙂 Regardless, I think that violating that US code essentially requires intent. A copper trying to do their job right can't violate that law. Now, with that being said, the coppers ARE absolutely required to investigate to determine if probable cause exists. If this guy walked out with a TV that was off of the shelf, I would say probable cause exists. But if he walked out with the unit that he bought 1 year earlier than clearly probable cause doesn't exist. I was not really clear on that point. It sure looks like he took another off of the shelf without the vendor's consent.

Millions buy TVs and other electronics from them with no problems. For a return well after 30-90 days, it's at store discretion. Treat workers with respect and one of them will likely make it right. Stores allow returns for a limited time as a courtesy. It's not warranty service, which is provided by the manufacturer. Many conflate the two. He should have known better.

Let’s talk about my experience with Walmart. I was in the store and saw vitamins on sale on a rack adjacent to the pharmacy. When I scanned the price at self checkout, the scanned price did not reflect the price that was advertised on the rack. The person at checkout told me that the pharmacy in Walmart is separate from Walmart, and that I should go speak with someone at the pharmacy counter. The pharmacist told me that they are only responsible for the price of the products directly in their area, and since the vitamins were on a rack just outside their area, there was nothing they could do about it. The law in Quebec is that if it scans higher as advertised then it’s free to the customer if the item is under $10. However, Walmart said it’s an issue with the pharmacy and the pharmacy said nothing they can do about it. I made a complaint to consumer protection. Consumer protection investigated and informed me that products sold by the pharmacy are exempted from this law. So, Walmart said not our problem, and the pharmacy said it’s a mistake but we have an exemption from the law. Go figure.

Walmart is very strict about bad stops when it comes to shoplifting to avoid things like this happening. One bad stop is grounds for termination. And everyone involved who did not follow policy here is most certainly getting fired, especially since this made the news. You can't fix stupid though. Source - I'm a former WM employee.

he got his replacement receipt and that should have been enough. however one of two things had to have happen; either he took a better model than his old TV that was out of the price range of his old TV or the store simply denied him to replace any TV on the grounds that they thought he had to go through the manufacture and not their store so a miscommunication and misconception on their end. if the later its on walmarts end but then they should have been more responsible in working with the customer which most retailers never seem to want to.

I get now that it was a much more complicated transaction and there are different consumer protection laws in utah. I personally would not buy the cheapest-no-name tv and expect to return it a year later broken for a better model. I might attempt to send it back to the manufacturer for some compensation but not expect much. That guy has waaaay too much free time to hassle walmart and waste all of our time commenting on this. Poor reporting too.

The man has a TV that is currently under warranty and has failed by law he is entitled to, a refund or a replacement. He organised a replacement with one manager Another manager decided, if he takes the TV, he'll be charged with theft, which is what happened, mainly because the cops are totally unable to 'investigate anything'. They were basically instructed by an 'employee of Walmart' to arrest a man for stealing He was charged In court, he won because, according to consumer law, and Walmart policies and knowing the law, The man won it's all there if you listen closely

I'm confused. If you buy something, you have a number of days to return it. 14 days for most electronics. Now if it stopped working a few months later. I can't return it to the store with the receipt. I will have to take it up with the manufacture. Most new items come with the Manufacture limited 1 year warranty. which means if you have a problem within the one year. you take it up with the manufacture. not the store.

No, Walmart knew the attorney read their warranty policy, which is a legal contract, which the store refused to follow, violating not only their own store policy, but the law.... "You can RETURN your ONN TV to Walmart, or get warranty service from Walmart or their designated warranty service." A warranty is a legal contract. Their own warranty says you can return it to the store for replacement, and the store had incompetent clowns that didn't know their own policy nor the law. When they couldn't figure out the paperwork, and asked them to call Onn, they told them Onn IS Walmart, and they needed to sort out the paperwork themselves. No different than if you bought an Insignia TV and Best Buy told you to call Insignia... they are the same entity...

Once they refused to honor the warranty and do the paperwork, which is a legally binding contract, this became a contractual dispute and a civil matter, not a criminal matter. As someone who’s really into TVs and used to sell them, I can tell you there were a few mistakes here. First, buying a 70-inch TV. Second, going with Onn. And third, getting it from Walmart. Honestly, I’m not surprised it started acting up so fast. TVs like that aren’t made to last; they’re just designed to get through the one-year warranty. Walmart TVs are another story. A lot of the models they sell are slightly different from the ones you’d find at other stores. Manufacturers often make cheaper versions specifically for Walmart, which usually means lower quality compared to the equivalent model at a place like Best Buy. If you’re shopping for a TV, it’s better to stick with sizes ending in 5 or 9 if you’re going bigger than 43 inches. And always do some research. If the price seems too good to be true or it’s being sold as a great value, it’s probably not going to last long. TVs aren’t something you want to cheap out on unless you’re okay with replacing them every year or two. Even then, I’d still recommend getting an extended warranty unless it’s one of the higher-end models that already includes one. Spending a little more upfront on a good TV will save you a lot of hassle and money in the long run.

Terrible reporting, the framing of this story is misleading. Rather than "trouble with the law" for returning a TV, it's actually trouble with the law for leaving a broken TV at Walmart and walking out with a new one. Not defending Walmart's actions here either, getting the faulty TV replaced should have been quick and easy.

They also killed off the TV repair shops by having low cost TVs and other consumer electronics. These days it costs more to repair one than it is to replace. Gone are the days of component level repairs and instead manufactures have gone back to the 1970s mantra of replacing boards. Often times the boards, if they can be had and if the end user is intelligent enough to pick the correct board causing the actual problem can cost more than a brand new TV with more features.

If you disagree with their behavior, you must sue in civil court. 2. If you're an attorney, you should know that you never open your door to strangers, including the police. Exactly. If the police had arrived at the store during the dispute, the police would have told the attorney exactly that, i.e., you cannot walk out with a new TV and you need to settle it in court. I think he knew that, but he didn't think they'd have the balls to call the police. He's lucky he's retired, so he can afford to play games like that. If he were younger and working, he'd have an arrest record to deal with now, regardless of whether he was prosecuted or not.

I'll point your attention to the fact that the DA originally sent to police to arrest him, but then dropped the charges later, presumably after the found out the details of the case and realized that the "stolen" tv actually belonged to him, per his contract with Walmart. Police often urge people to use the civil court system because they don't want officers to have to litigate on the side of the road, but legally there is no obligation to do that in circumstances like this.

Since when can you return an item to the store after the return window (often 30 days) but within the manufacturer’s warranty? Never heard of that. Only if you purchase the store’s protection plan does that work.

Onn is a Walmart house brand, and its warranty specifically says you can return it to a Walmart store for a warranty exchange. That's extremely common for house brands. Worked for Best Buy for a good while and any of their brands you could just take it to the store and they'd give you store credit.

Presumably a new TV without paying for it. The man is wrong. Stores provide a return policy not warranty service. Many consumers conflate the two. For most products, after 30-90 days or whatever the store return policy is and applicable state law, one needs to deal directly with the manufacturer.

I have no clue about Utah, but here in Florida Walmart generally as a 15 day only return policy on electronics. After the 15 days the manufacturer is expected to fix the issue. It states it on every receipt when you purchase an electronic product and it is posted everywhere around the store. I don't take returns for a year on items I sell that is insane to expect Walmart to do the same and I am not a fan of Walmart.

Never buy an electronic from Walmart without first, making the store open the item, make sure the numbers on the the box and on the item match, and they plug it in and make sure it works. Then check your receipt to make sure the serial number matches the box and item. Otherwise, you'll be treated like a criminal if anything is wrong when you get it home and need to return it.

I bought a tv from Kmart many years ago and I had problems with it so I got a hold of someone at Kmart about the issue. They said I had no warranty but they agreed for some reason or other to pay for half the repair cost on my new TV. It came to about $125 or so. 3 months later the TV went bad again so I carried the thing into the store, up to the service counter where the person asked, "can I help you?' I replied, "nope. I want to talk to the captain of this ship." I knew he'd be bothered by this request and expediate my issue immediately. I didn't have even a receipt for the purchase of the TV but I did have the receipt from the repairs with Kmart's signature on it. The man took one look at it and said, "refund this man's money" You gotta go straight to the top to get something done.

100% correct. I work for Philips TV and usually Walmart is very easy for accepting the returns and past it on to the vendor. If the consumer have a defective TV after a year the consumer should have called customer service. They usually replace the defective TV for a refurbished TV. I know this is true because i usually authorized the acceptance of the defective replacement. Defective TVs happens all the time regardless of the brand name.

Walmart is GLAD THE MATTER WAS RESOLVED! A retired lawyer was arrested at his home, taken to the police station and charged with theft. Only later did the DA drop the charges and Walmart finally do what they should have done in the first place. How many people who are not retired lawyers did this happen to and not stand up for their rights. Great story educating the public. Hopefully the MANAGER was forced to apologise face-to-face but unlikely this happened.

How was he able to actually "take" the replacement TV ? Did they point to it and said here is one just like it, but dont take it. Was it out in the back room in a box, so he went where he wasnt allowed and dragged it out. The stores staff did nothing to hold on to a TV that supposedly was not being allowed to leave. This part is weird.

Should have read the return policy: The manufacturer was obligated to repair or replace the TV, not Wal-Mart. If you buy a car and it fails in the warranty period, you don't get a new car.

That scanning and reading the barcode. That’s the part they dwelled on. I’ve had cashiers spend time trying to figure out the numbers. Tip: place your receipts high up in your kitchen cabinets that way they stay preserved and you always know where they are.

This is so much simpler in Australia. In Australia, retailers are legally obliged to have a good understanding of retail law. Each state also has a government Department of Consumer Protection. I've been on both sides of the counter many times. As a customer, I've made about four or five reports to my state's Consumer Protection. Working in retail, I knew the retail laws extremely well, so I "won" each of my cases against other retailers. One thing a lot of shops try to get away with is palming off warranties to the manufacturer. That can be allowed for an extended warranty period that was supplied by the product manufacturer. The statutory warranty, now known as a "statutory guarantee", is the legal minimum duration that a product must function. For that period, the retailer is responsible for any issues that are covered by the statutory guarantee. However, customers often have the choice to go directly the product manufacturer. That can be preferable for people if it's something like a solar system that's attached to their house, because the customer can't just remove it and take it back to the retailer.
