How can the ICC investigate possible war crimes in Afghanistan? | Inside Story

The International Criminal Court has authorised an investigation into accusations of war crimes in Afghanistan.
An appeal by the ICC's chief prosecutor Fatou Bensouda was approved after being rejected last year.
Allegations of atrocities committed by U-S soldiers, the Taliban and Afghan forces will be investigated.
The torture of prisoners, sexual violence and the indiscriminate mass killing of civilians are among the claims the ICC wants to look into.
But the U.S. does not recognise the court's authority and the White House has even imposed a travel ban on its judges.
So can justice be done in this war-torn country?
And are politics at play?

It is 2023 and the Taliban has taken full control of Afghanistan. The US released Taliban prisoners and they overtook Afghanistan… It is so sad to see that the guy who kept mentioning all atrocities that rook place since 1978 was right…. There was no justice for women, men, and children of Afghanistan… I hope they become free of Taliban’s control soon…

Something to keep in mind One World Government will allow the same proceedings to be applied to anyone in the world, and any of us can be tried for crimes in any country even if we had never been there. This is just one example of what could happen. I doubt that anything will come of this as my government will not allow it.

You did not understand the aim of the ICC. It is to prosecute people who committed crimes such as war crimes, genocide and crimes against humanity in a specific country. Yes, by doing such atrocities such person should be brought in front of a court no matter where they are from. And no, you have to have been in a country and committed inhuman crimes for being judged. I think you completely misunderstood the whole concept. It's not about you stealing a coke in the shop around the corner, it's about people like Hitler being responsible for millions of deaths. If your government does not support this judgement, your government should change, not the ICC.

When a man is unable to manage his affairs, that man is made a ward of the state. Afghanistan is unable to manage its affairs; Afghanistan can not control its territory or enforce the rule of law. Afghanistan should be made a ward of the UN, and the U.S. should leave. We don't want to be in Afghanistan for the next hundred years.
