Very informative. I've been denied 3 times (from lawyers) for a previous claim from 2020. I missed a zoom appointment the day after I had surgery (sedated under Oxycodone and other meds) and another zoom scheduled so I thought it was @ 1pm and it turns out it was at 10am. Hello! Question, so if a settlement can’t be reached then it goes to jury trial for the policy amount, say 25k. But the jury can award more than that, right? Or if not, then what’s the incentive for insurance companies to settle and not go to trial?

Yes the jury doesn’t hear anything about insurance so they can allow for much more than the 25k limits.

Usually there is no fault coverage that pays medical providers for their care. There is also a separate bodily injury policy the car that hit you will have. That is for pain and suffering. But definitely consult with a local Michigan lawyer

Hi there, thanks so much for this video! I have a question. I was T-boned by a distracted driver on 11/23/2022 and my car that is worth around $1,000.00 based on KBB values contained over $4,500.00 worth of damages based on picture estimates. Based on the police report, I was not at fault. Although I have done this before in previous accidents but now realized that it may not have been the best decision, I went straight to the other insurance myself and reported the accident rather than going through my insurance. The other insurance has been cooperative but stated that they cannot get in contact with the person that hit me and notified me that they have to send 3 notices to them and wait 5 business days in between the notices before making a final "liability decision". They informed me that a final liability decision will be made on 12/21 and as of 12/16, they still have not been able to get in contact with the driver. As far as next steps goes, should I wait for their stated "liability decision" on 12/21 or should I be prepared not to receive money and fight this another way? Also, is there a good way of knowing how much I may get since my car isn't worth much but damages were significant? Thanks so much for your advice and help!

You should receive a property damage settlement. I think they just want to confirm w their policyholder before issuing payment. I’m not too familiar with property damage only claims as I handle only serious injuries. If they don’t pay you can file a small claims case without a lawyer and you should win.

I have a question. My 17 yo nephew was hit by a drunk driver oct 30 last month. My nephew was in a coma for maybe 7 days before he opened his eyes. Pretty bad traumatic brain injury. Hi, had a drunk driver hit my vehicle head on collision while i was on my way home. Have torn rotator cuff, labrum tear in other shoulder, bulging discs in neck & it pops when i move it now & with pains every night from sleeping & my shoulder down to pinky go numb when im laying at a certain angle in my back, so far therapy 3x a week, prp in the labrum tear of shoulder & am considering the rotator cuff surgery to fix my weakness in that other shoulder. What about accidents where no injury was involved? I was recently involved in an accident where a woman hit me head on in a parking lot and who admitted responsibility on the scene. Her insurance company declared my vehicle a total loss (after I took it to their body shop) and wanted to scrap my car and pay me out $2,300, the blue book value. The car was still running fine other than the bumper and I could hardly replace the car with what they were offering. I ended up keeping the car ant taking only $1,700 which wasn’t even enough to repair the damage which I had done. I ended up taking a loss for an accident which wasn’t my fault but I saw no other options.

Depends on where it happened as every state has different laws. In New York you have no fault PIP pay $50k of medical bills in addition to being able to sue the defendant for an additional $25k if it’s a 25/50 minimum policy. Hi, Do you mean the bodily injury limit of the defendant you are suing is only 100k and you have more than 100k in medical bills ? That would mean they should definitely tender the 100k BI Limits. But in New York, medical bills are paid by No Fault or PIP which is a different insurance policy altogether. By statute they pay up to 50k but some people purchase endorsements for more coverage so they have higher limits for medical bills. Let us know if this answers your question. @@GodAlwaysWins it’s under insurance but it only applies if you have more coverage than the defendant. For example if at fault car has 25k and you have 100k you can take the full 25k from the defendant and then 75k more (the difference) from your own.

Hi i met with accident in Erie, Pennsylvania in February 2023, had a minor spine L2-L3 fracture. Driver has USAS insurance of 15,000 only my medical bills are way more and my pain too. Depends on your state law but if you have to sue for expenses then it’s going to be tough. Now if there is excess , umbrella or if you can find UM then you can pursue that too. Or try for bad faith to open a policy. There are options but it will be state law dependent

@@andrewpena758 usually lawyers stick to the policy. I couldn’t really advise you because I only represent plaintiffs never defendants. I would speak to your defense lawyer or the insurance company. They should handle everything for you. Good luck.

My accident happened in 2017 and I had a deposition last year. It depends on why the case is taking longer than expected. You should know the reason. An open and continuing stream of communication between you and your attorney is absolutely essential. The case can be taking time because of many different factors: court delays, multiple depositions, motions, or it can just be that it is not being prosecuted efficiently.

One for no license and one for at fault for wreck. I took videos and pictures. I would recommend reporting everything to your mother's insurance company. They hire lawyers to review the medical records, depose the plaintiff,and defend themselves very well.

Wow sorry to hear that. With a Rearend crash the other car is 100% at fault and you should receive summary judgment on liability. The only issue is how much your injuries are worth versus how much insurance is available from the at fault vehicle. A separated collar bone is serious. I settled just that for $140,000 recently. Total loss is usually declared when it costs more to repair the car than its blue book value. We help clients with property damage as part of handling their personal injury lawsuits but we do not do PD only claims. You can try to negotiate it. There’s no clear formula so definitely some wiggle room. Hope this helps.

Depending on where it happened. Each state has distinct rules on what damages are recoverable. In New York you are entitled to lost salary and medical bills up to $50k regardless of fault. Uber usually has a significant policy limit. Where did your crash happen ? You may want to get a second opinion from a local lawyer. In New York we have a serious injury requirement so 6 weeks of therapy is not enough. Would need at least 3 months but all jurisdictions have different rules.

I have gotten nothing but emails saying they put in a demand letter and to just wait until they hear back,. Yet i get my back broken and have to learn how to walk again along with pain that does not go away and will likely get little to nothing.. was told also that the woman was uninjured and had insurance with a small county firm.. so is underinsured but i had a policy that was over insured and still had to pay out of pocket for hospital and things.. im almost going to have to declare bankruptcy and i had my life finally going somewhere.. lost everything from that wreck.. cant get anything for the pain because theres so many addicts and deadbeats in this world taking it away from people who need it.. was denied disability because my dr notes said i was able to learn how to and regain ability to walk, yet im maybe 60% of what i used to be but drs didnt write that.. fucked my life up.. between people who dont care about anybody but themselves, people who somehow get one over on others, greedy and selfish lazy souls i get screwed when i need it most.. ive paid taxes my entire life, worked since i was 14. Paid for all my schooling and had no debt but the government would rather give drug addicted wastes of space 600$ every 2 weeks plus food stamps but when i pay taxes and own a home they dont care a bit about me unless i just continue to pay taxes so they have the money to keep paying those people.. tired of this world.. you spend 38 years trying to be apart of the community, help everybody you can, work until you hurt then the one time you need something back, just a little help, you get nothing and viewed as nothing or a waste of others time.. but if youre gay, black or rich you get priority and praised... even the people i gave my all to help them all are ghosts when i ask for even a ride to a dr appt so i dont have to suffer for half a day on busses to get there.. plus walking up those bus stairs with a broken back takes a bit yet nobody gives a damn and curse you out for taking so long to get to a seat, even the drivers called me names.. tired of this crap.. somebody pays for a million in coverage but if they gey hit by somebody who has no coverage, guess who has to pay everything no matter what and who gets off with a driving without insurance fine?? Bullshit is what it is.. tired of this life..

Sorry to hear that. Terrible. Yes with 25k policies it’s tough to get more unless it’s bad faith. Unfortunately those with 25k policies usually don’t have assets either. One avenue could be UM against your own policy if your limits are higher than 25k
