Hi guys. There is much that you have to say that is correct, but there is one point on which you are factually incorrect, regarding the Clinton email issue. The criminal offense for which she could be charged does NOT require intent for a conviction. It is one of the few federal criminal offenses that does not. The standard for a conviction is that she acted "recklessly" in placing classified material in a non-secure place. In addition, there is a separate offense that simply requires a showing that she removed classified material and put it in an non-secured spot. This has already been established that she had her IT guy do that. I just thought you should know that intent is not an element of these offenses. I'm not saying that I think this is a lock, but I do think there are reasonable grounds for an indictment potentially.

Serious problem with your explanation. Under the Espionage Act, intent is not a requirement for conviction. Negligence (wittingly or otherwise) is all they have to prove, which is much easier to prove than intent is.

She is one of only 10 people trusted with determining the status of "classification". She had to sign her understanding of this responsibility. 3. If she cannot determine a document's status by virtue of it's content she is not qualified to handle such content, she will have this privilege revoked thereby ending her run for presidency. 4. She was given a 2 hour FBI instruction debriefing on how to manage her passwords, etc. 5. She held restricted government information on a non secure server giving anyone with malware access and in so doing jeopardized the security of the largest super power on earth. 6. When access to her server was granted to the FBI she admitted to having "wiped" it thereby destroying government property. The documents originating while conducting government business belong to the government (the people). She is SOOOO screwed!!!!

Just a piece of information, just so you have everything: Some Soldiers end up handling classify information. Every Soldier has a government e-mail account. Every Soldier has to read and sign a document that explains the handling of information and the consequences on violating that accord. Now, in order to avoid any situation Soldiers handle information received through the government e-mail by only reply with the same account and if resending, only resending to other Soldiers to their government account. Soldiers only use "Yahoo, Hotmail, Gmail", etc to e-mail family members, friends, conduct daily purchases, etc. Now, if a Soldier would've sent any classified information through any server other than the government account, that Soldier would've been court-martialed. There's no need to prove intent but the act. Not knowing that something is illegal is not an excuse nor proves innocence. If she sent ONE classified e-mail, she's guilty as charge, no matter the intent or the knowledge behind it.

Ehh, everyone is innocent until proven guilty. At least that's what we've being told. Starting with that view, she should be charged only when evidence of mishandling of information is obtained. Now, if she will be charged once there's definitive proof, that's the $64M question. History has shown that people with $$$ and/or power get away with many things. We currently have a murder case of a 8 y/o boy that remains unsolved for 6+ years. What's peculiar is that the mother was in the house with a couple of friends, there were kids of those friends yet he was killed between 12 mn and 4 am. All of the sudden a person was mistakenly released from prison, his personal belongings were found in the crime scene, and so it happens that the mother's friend know this man from youth. Oh, did I mentioned the man is a schizophrenic? Anyway, the defense proved that this man had nothing to do with the murder of the boy, and that he was just a pawn to be framed. Do I think she'll be charged? No, I think not!

If she had transacted state emails on Gmail it would have been one level of misbehaviour. Information is classified, not the document in which its conveyed. Her staff stripped off the classification headers and copied/pasted the classified information into email messages. That is illegal on its face. There are hundreds of instances of classified information, dozens of instances of secret information, a few instances of top secret information and at least ONE "above top secret". Whoever told her staff to strip off the classification headers? Whoever did that should rot in a prison cell for a couple of decades.

The reason her aide's are being interviewed is because most of them have some level of security clearance and they are obligated to report the mishandling of classified information to not do so is a federal crime.
