There is a private citizen that is a native born State national of the constitutional State he/she was born in which is a Free State under common law. This is also called a citizen of the United States of America. Each of these Constitutional States is a country unto its own and have State Constitutions that created it. These are the sovereign people who establish there proper status and do not participate in the business affairs of a foreign government. There is also the public citizen which is also called a US Citizen which is a statutory citizen and a permanent resident of the municipal jurisdiction of the District of Columbia. Most of these US Citizens are foreigners who have become permanent residents first and then taken an oath and become a US Citizen. Only their sons and daughters that are born in one of the constitutional States that make up the federal union called the United States of America are free if they choose to be in one of these free States. This is who the United States Constitution applies to. They are also US Citizens that are born on territories controlled by the Federal Government such as Army Bases in foreign countries. (The movie character Jack Reacher is a good example of this US Citizen status, but he is not a permanent resident). To help further in this. The constitutional State of Texas is called "Texas" (State). The corporation of Texas registered in the District of Columbia by the government is called the "State of Texas".

Section 2 of Article III says, The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;-to all Cases affecting Ambassadors, other public Ministers and Consuls;-to all Cases of admiralty and maritime Jurisdiction;-to Controversies to which the United States shall be a Party;-to Controversies between two or more States;-between a State and Citizens of another State,-between Citizens of different States,-between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects. (emphasis added) "[T]o Controversies to which the United States shall be a Party" is clearly against sovereign immunity for the United States. "[B]etween a State and Citizens of another State" was amended away with the Eleventh Amendment, mostly because states didn't want to pay their debts for the Revolutionary War. If sovereign immunity were so well established, why was there a need to amend the constitution? And nobody has amended away the bolded part. Sovereign immunity for the *federal* government just seems to be something federal judges decided, and pretty gradually as well. It's generally regarded as starting with _US v. Clarke,_ 33 US 436, 443 (1834) ("[T]he United States are not suable of common right...") But why should common right matter, especially as "[t]here is no general federal common law." _Erie v. Tompkins, 304 US 64, 78 (1938). If there was none a century later, there certainly wasn't any in 1834. The Supreme Court wasn't clear until the late 19th Century: "The United States possess other attributes of sovereignty reasting also upon the basis of universal consent and recognition. They cannot be sued without their consent." _US v. Thompson,_ 98 US 486, 489 (1879), and "Despite its myriad and sometimes questionable underpinnings, federal sovereign immunity remains an entrenched tenet of our law-a point of departure unquestioned." _Cunningham v. Macon & Brunswick RR,_ 109 US 446, 451 (1883). So it's a case where the Founders wanted things one way, and the judges wanted things another way, and so the judges got their way. Which should remind you of everything else judges did to the constitution.

@@0529mpb Yes they did, though I don't know how you're addressing a point I made or addressing sovereign immunity.. In my view, the 49 states based on English common law do an overall better job than the federal government and Louisiana, which aren't. States still have _habeas corpus,_ while the federal kind, already weakened by 2255 and a 1993 SCROTUS case the name of which I can't remember, was gutted by "Little Willie" Clinton's AEDPA. They also have general _mens rea,_ which the feds don't. See _Without Intent_ by the Heritage Foundation and the National Association of Criminal Defense Lawyers. They don't agree on much, but they do agree there should be federal _mens rea_ beyond individual statute. There has also been far too much federal jurisdiction creep. The Harrison act could only tax. Then the Prohibition amendment was considered necessary to do more, but the Marihuana Tax Act was also only taxation. But Nixon's War on Drugs and the CSA, which Ehrlichman admitted was a lie to oppress hippies and black people, was way out there. It was challenged in _Gonzalez v. Reich._ The "conservatives" wanted to get rid of the CSA, and the "liberals" kept it, which makes me question the categories. Of all people, Thomas wrote a great concise dissent, which I find spot on.. I am no fan of his, but he did right here and in _Entertainment Merchants,_ if memory serves. It's way too early in the morning for me to look it up.

Note that often he is talking historically, rather than currant usage. An American state national is someone born in land controlled by the united states, but is not any of the united states, eg American Samoa, If you meet the 14th amendment's first line, you aren't a American national.

@@ChampStyle82 No, it's not a proper noun. A United States national, is a national of the united states, but there are nationals of other countries. It's not a title, it's not uniquely identifying. If you were one you would likely have documentation from your local government that shows it's usage. And while it may be used in some places in old law, it's "United States national" or "national of the United States" there isn't an "American National" unless you are talking about the insurance company in Galveston, Texas. If you hear someone claiming they are an "American National", when they were born inside the borders of one of the 50 states they are just wrong. Refer back to the 14th amendment.

The decision expounded on from 6:20 through 7:20 violates the 1st Amendment of "the right to petition the government for a redress of grievances", and the 14th Amendment's Equal Protection Clause! No Court nor Congress can rewrite our Constitution except by way of 3/4 of the States Legislators! But, as we know! Even today, a U.S PASSPORT is 'the' only GOVT ISSUED I.D you officially need to travel on public roads, tour the country, or work in the country. IF you are a Native American or "American National"meaning you are Sovereign Upon the land, born on the land, and the Natural person, the U.S PASSPORT is the one form of GOVT I.D you would need in order to prove you are legally allowed to Reside, Travel, Work in any such State Republic - as you not yet have claimed allegiance to any such state nor the United States. Now if you were to purchase a 'vehicle' - paying cash outright, you do so in as an AMERICAN NATIONAL, if reside within the Republic of South Dakota - you would have to "register" the vehicle in the State but you could very easily just PAY THE TAX DUE to register, show proof of which the tax is paid, and request all "THREE" parts to that title - MSO Hard Copy, Green Lien Copy, and the White Soft Copy. Hold all three parts to that title you are the "FREE" and Clean Property Holder of the Vehicle, and the State cannot force you to use a state issued plate, cannot force you to place insurance on the vehicle (you may wish to...), but you still need to abide by the Speed Limits, Traffic Lights, etc as they are common codes we choose to live by. As a soverign, buying "LAND" under the Settler Acts either the 1862 Homestead Act or the 1841 Preemption Act which allowed you to go out and settle on the land, claim 80, 160, 320 acres of free land, live on the land for up to 5 years, building a home, developing the land in order to prosper off the land, in return you could then upon application, obtain a Land Grant (patent) to the land, which is surveyed, documented, and you and your heirs are made "rightful owners" of the land free and clear of any property tax or direct control of any such State. You may owe the "Federal Govt" imposition fees such as a tariff on any profits or gains made on the land, which would then be deposited in the Federal Treasury in order to manage the Country, Protect Our Borders, Manage Immigration, and manage our Monetary System ( the four delegations given to the Federal Govt ). You essentually would establish your "Sovereign Territory" within the 50 State Republics. Also Note: Todays "domestic tariff" that imposition fee that early pioneers once paid prior to 1921 - is today the Federal Income Tax, so that probally becomes the imposition fee you would pay as a "Sovereign Individual" as you reside, travel, and work within your "territory". Even as a Soveriegn, you cannot escape "taxes" you simply are not forced to pay any direct taxation to any foreign state, except for where you act in a commercial manner under the 'public laws' that govern commercial trade in that state or federal territory.

In another youtube video a 65 year old Sovereign put liens on the property of the judge, police and others who prosecuted him. - About 3 years ago he was sentenced to 20 years in prison. Federal law has to abide by supreme court rules which in turn are based on the teachings of the maxims of law. Problem is common law is based on the rulings from courts throughout history. People have won suits against states since this first case was quoted. That new ruling becomes the new common law. That is why sovereign citizens are wrong in their thinking. The bond issue is not about the ruling of foreign governments suing. Bonds are not good is a private business has sold you a bond and then goes broke. These banks are privately owned and went broke. As far as Confederate law or states, they ceased to exist as US states during the war. Therefore any debt went null after the war because every state that had seceded had to reapply as a US state because technically it did not exist as a US state or territory. Anyone can argue using old case law which might not even apply today because of new precedent set by courts known as common law. Even the Supreme Court today can overturn past Supreme Court cases.

What the hell is federal common law? There is only the common law of the People. We the People give no sovereignty to our government. We are not citizen of any state or commonwealth; we are perhaps citizens in a state or commonwealth. Which "united states"? Under what/which jurisdiction of law does the judicial system operate? The 14th Amendment is a violation of the People's right, therefore it is null and void. That amendment provides no security to the People. it has to do with persons and citizens. Citizens are subjects and subjects are slaves. Individuals, persons and citizens are corporations... "legally". We, the people are as kings and queens; we have no obligation or allegiance to the State or the government; we are both.

The end "you can sue a state official". I will expand on that. The state is a corporation (today maybe has always been in history maybe dejure before). A state official that acts outside of there office (colorable of law) can be sued privately because maxim of law, God is Law, because God harms no one. Acting outside of God, moves you out side of the Sovereignty of the State. The Sovereign immunity only means IF you do your job according to God (Law) you can not be sued.
