This is because a sole trader company is not considered to be a separate legal entity from the individual owner. This makes it more difficult for UKVI to assess the financial viability of a sole trader company. For your first question: Yes, the business partner who is British National can apply for Sponsor Licence and then he can issue you the sponsor visa - skilled worker visa. But the company needs to justify the Home Office that there is a genuine need for the job role. For your second question: Self Sponsor Idea is for the UK Expansion Worker Visa. When you already got the running company outside the UK and wanted to expand it in the UK. The most important condition for that, the company should not be already registered in the UK and genuinely seeking an expansion. How Old : The company which is currently registered in the UK and submitted the last Tax return & making profit (adequate current assets) in order to afford more employees, proving genuine running business, will be mandatory requirements to apply for the Sponsor Lic.

If you start a new business then at least one HMRC tax returns would be necessary to proof that business is making enough money to afford employees. As each employee you sponsor you need to pay salary. For example: you start business in Oct 2023 and do tax returns in April 2024 and apply lic in May 2024. And business revenue is equal to employee salary you wanted to sponsor then that wont justify the case. Home Office don't stop applying for the lic as you end up paying fees for it, its more about justifying the job which is created is really needed & genuine and business can afford.

Dear Sir, I has been working for a restaurant for last three months as a part time employee with 16-20 hours per week. Last week they promote me as Restaurant Manager with full time employment (37.5 hours). I am not sure how much salary I have to show for 1223 code as Restaurant Manager. Do they have licence to Sponsor you ? According to Gov. UK ONS tool. It says this 1223 Restaurant and catering establishment managers and proprietors Café owner Fish & chip shopkeeper Operations manager (catering) Restaurant manager Shop manager (take-away food shop) £19,600 (£10.05 per hour) So, if its mentioned this on gov.uk website then your knowledge is correct.

You can't just register a company by just opening it. You do need few more documents like Insurance / Tenancy Agreement / Business Bank Account etc. What is your plan ? According to the Home Office Standard time is 8 weeks. But its not just you who is experiencing this delay issue and worst part is Home Office is not even updating about this delay. Someone else I know is waiting since 12 week now for Sponsor Lic Category. Only way we can understand this is by sharing our waiting time with each other. I have created a thread for Sep 2023. @@UKknowledgeGuru From my experience applying for a visitor visa, it was a 6-7 weeks delay. While I was waiting, I wrote an email to the home office. It cost me a few pounds for this email but it was worth it because I got the answer within 24 hours and they followed up my application as well. After that, I got my results about 5 days later You may want to try this approach.

The answer is no, you cannot start a business on a student visa in the UK. Student visa holders are not allowed to be self-employed or do business activity. But if you on Post Study Work Visa then Yes. To Sponsor yourself you need a Business Citizen the Authorising Officer who can be assigned CoS and then he can issue you the Visa. But the company has to be genuine and job which is created for you must be genuine. In-Short, if you doing Genuine Business in UK then there should be no problem.

Yes, they have to be the part of the company. Its like they will be taking responsibility while submit the Sponsor Lic application to Home Office, its basically you hiring someone in your company who is British National to look after the operations.

The way it can be done is by Applying in Global Mobility Scheme known as UK Expansion worker Visa. Basically, you expanding any current business registered in xyz country to UK and then you will hire staff who is British National and he will apply for UK Sponsor Licence to work you in the UK by fulfilling its conditions. No, you can't sponsor yourself. You can open a company and you can hire someone British National to apply for the Sponsor Licence. Then he can apply for CoS and sponsor you (Only possible if the business is genuine and there is genuine need of that job role)

I think someone must have misguided you. First of all, as per page 22 of the 66 pages guidance you cant issue COS directly to your family member. Watch this guidance without forwarding to understand.
