There is nothing anyone can do. Unless you have a true emergency which for most people they dont meet the requirements for expedited cases, you can only wait until the Embassy decides they feel its safe to resume routine processing. If they continue to stay shut down for k1 visas uscis will have to stop accepting new applications with nowhere to move. Its a growing problem that could easily be avoided. Department of state as given the embassy the green light to resume k1 processing more than once. Its up to the embassy to do the right thing at this point. There is no excuse at this point to remain closed. They had nearly a year to figure out how to resume safely.

Its not stuck for no reason. The NVC cannot send cases to the embassy until the embassys backlog clears. As long as the us embassy chooses to not process visa cases the problem will remain.

Are you the petitioner? If yes you will need to pay the fees for your son to go through the next level (medical and interview). I think there are 12 mnths or 18 mnths for you to pay for the fees.

But in our situation today becoz of covid, i dont know if he can speed up the process by paying the fees. And just the fact that your son was turning 21 soon. If your son will turn 21 for 6 to 8 mnths i think he can still make it. Pay the fees asap and send those documents that nvc asked. Just try, theres no harm in trying, right?

The Embassy contacts you for interview not NVC. The length of time depends on whenever the embassy decides to resume processing. Its impossible to know how long because there is no idea on how big the backlog is. If i had to guess today, it looks like it might be 10 to 12 months delay. I hope im wrong.

Did NVC already send your beneficiary an email about his/her approval? If not. Wait for an email from NVC. They will give them his/her case number and some instructions and some detail for the next step (medical and interview). In my case my priority date was april 2019, but i recieve an email from NVC for my approval last september 2020.

We were lucky to get our case to the embassy just before covid-19 hit but now our case has been stuck with a "READY" status at the Manila embassy for 9 months. They will not allow any interviews to be scheduled. The wait for scheduling an interview is now longer than the entire process used to take before covid-19 stopped human progress world wide.

How much does the mandamus lawsuit cost to file. What are your charges. The NVC cannot issue a "final" decision if the consulate is closed due to COVID. The only thing they can do is hold the case until the embassy reopens. Also, when Federal agencies do layoffs, the first employees to go are the newest workers with least seniority. The experienced old hands will never get laid off. The State Dept will not lay off anybody unless Congress cuts their budget.
