I have to say the garden has really married since the last time i saw it. I agree with you. Indeed, location is key! When I was looking for land in Ormoc, I told my ex that I wanted either a beach lot or something up in the mountains with a nice top-down panoramic view. She vetoed both, rightfully so, as a beach lot risks being flooded and a house on a mountain may come down in case of a landslide. The land we bought in Luna was far enough away from the sea not to be flooded and from the remote mountain range not to be affected by landslides. Downside: we did not have a view. As for ownership laws: I know them and I will never buy land or build a house in the Philippines again. Once bitten, twice shy! I appreciate that others have a different take on the matter and that's OK. As long as they aware that they could lose it!

Owning a piece of land for your home is a realistic dream. Owning a large land for your farm or ranch is like winning the lottery. Foreigners can own land in Philippines in ways: by being a former Filipino citizen, by being a child of Filipino citizen, by becoming a Filipino citizen (by giving huge contribution to the welfare of Filipinos), by inheritance from a Filipino spouse (involve good expensive lawyers and living in Philippines for good (due to squatter rights)), by partial ownership with Filipino citizens (mostly for businesses), by not owning but leasing, by not owning but renting or visiting. Influx of foreign ownership will stay in the current pace in the next 50 to 100 years, but depends a lot on foreign business investments.

Great video as always Adam and Jane. Fellow Brit here - I have bought land with my wife in Masbate. We are also looking to buy some additional lots. Currently almost all my assets are in Europe, so lots and potentially small modest rentals or a mini boarding house are in our plans as a way to save drawing from our European assets, and hedge any currency risk. But the main focus would be the own a home there someday soon

From what I understand from what you are saying I would be very insecure,if my wife passed away someone else would inherit it and could tell me to leave. No my friend, if you are married and registered marriage in the Philippines then you would inherit the land and property on it if if your wife was to unfortunately pass before you as long as she made no will about the property and land. There is no way to protect your interests before this as it’s viewed as unconstitutional. Don’t worry my friend. The law is solid but obtain legal advice from a good attorney here if you have concerns. God bless you😊

It’s a good idea always but leases can be difficult unless you have a great owner as it can cost a lot of money to take a landowner to court over a break in the lease agreement.

I understand (as a fact) that a foreigner can register his/her name on the land title besides his/her spouse as a proof of a conjugal ownership. But not many land registrar knows about it

Yes my friend. It can be done and even though the foreigner won’t be the owner they may still inherit some or all of the land. A foreigner can 100% own the house but not the land it is on. Legally the house would belong to the foreigner but obviously couldn’t be sold as the land isn’t owned. The Filipino who owns the land also though can’t sell the house or alter it etc 😊

I got a really smart idea about this. Because usually ylu trust the person that sells you the land, because its a lot if money. So trust has to be there anyways. So if you can put the person in charge that actually owns the land, that he or she doesn't allow anyone to enter the property. You can basically buy it and its yours, just its still on their name, but they'll basically take care of it for you. So basically its yours. Easy pisi.sometimes u just gotta talk with the people and find ways around the law

@@theunconciousmind7314 there are no ways to circumvent the Philippines constitution and nor should there be either. You can give money to someone who owns the land but they will own control of it and anything you put on the land. Even the greatest friendships can be tested by money sometimes. It's not a good idea. Basically it's never going to be yours and when you buy land you trust your attorney and not the seller as such. Of course you can trust them but not above your own due diligence and competent attorney.

In reality, nobody really owns land anywhere in the world. In early days, it's just a matter of land grab, documented and made legal by society. Nobody bought it from the CREATOR, it's absurd. Anyone who has the legal paper really are just custodian of the land. We have to look after it.

No, you generally cannot use agricultural land for non-agricultural purposes without reclassification. Agricultural land is intended for farming, and changing its use requires legal approval and reclassification. Only if you own a vast amount of land could a small structure be built but only for the purpose of the farm. No legal water connections from public services or electrity would be allowed.

My name is on all of the paperwork, I'm required to be present and sign for any changes or sale of those... that's owning it in my opinion lol. Sorry but legally you can't own even if your name is on the paperwork. You'd be listed as spouse of landowner. They couldn't dispose of the property without your signature but as a non-citizen there are ways around this. The only way to own is to become a citizen or inheritance should you not be named on the property or a will. In that case you can inherit 50% and children or spouses relatives the other 50%. It doesn't matter though if you are in a healthy relationship 😊

An attorney can still transfer property without your signature in many circumstances. You can't argue it as again you have no legal rights when it comes to land. However it doesn't matter if you are in a healthy relationship. We have 2 lots of land and it's not a problem. I don't legally own but it's not a concern or factor in anything. Good luck my friend 😊

Someone told me that a foreigner can inherit land known as intestate succession. So, if my mom was a filipino citizen and she died, as long as there is no will, me as a U.S. citizen can inherit her land.

That’s my understanding. If you could become a Filipino citizen as your mother was a Filipino citizen at the time of birth then could legally inherit and own an entire estate of a Filipino citizen parent.

We were completely unaware my friend but it’s more of a service where you select another country while in the Philippines to obtain cheaper flight, different tv shows and security using public Wi-Fi. Foreigners cannot buy land but can own land in the Philippines as per the law. It’s been that way since 1980’s at least if not before then. You should think about how you word your comment as it’s very offensive in tone and borderline racism. Anytime you say someone isn’t welcome somewhere you are excluding due only to race. The difference between the US/UK and the Philippines is that the Philippines was colonized and the land was taken away by the colonizers. It's in the blood of the Filipinos that they are scared that it can happen again. Land prices will be unaffordable for normal Filipinos when the market will be open for everyone. My personal opinion is that the government isn't interested in changing it because the Philippines is owned by a handful of families and conglomerates like San Miguel, SM and others. The same is happening in Indonesia an ex Dutch colony ...

@@klausschumacher7126 I’d agree my friend but it seems moves are being made as it will encourage far more foreign investment which would bring so many benefits to the people here… jobs, industry, infrastructure… if it was limited to what it is for former Filipinos (1,000sqm max total) then it would work. No one could come in and buy up all the land. Absolutely we understand the fear but this happened in most countries and the economies grew and unemployment fell.
