I was working with a realtor in April and she had me sign paperwork that she said was a contract stating that I would only be working with her. I read the paperwork and signed it. I’m a first time home buyer so this was all new to me. The forms said consumer guide I believe but I thought this was the contract. About a month and a half later I decided to terminate the agreement. When I called the agent to tell her she said oh you weren’t under contract. I said well what was that I signed then because that’s not what you told me. Lesson learned. I sent her an email stating that I was ending the relationship with her and the realty agency she was with and cited my reasons. She was acknowledged and agreed to it in a return email. I have a new agent now that doesn’t have me waiting days to see a property and is very patient with me. I’m learning a lot from your channel and I thank you for being so helpful. I’m definitely experiencing growing pains from this exciting and at the same time nerve racking experience.

Omg, similar situation, except I was a signed offer on a home which she (the realtor) went ahead with without verifying the loan with her loaner it was less than a month, I switch realtor agents and she and the realtor asked me if it were something that they did wrong. As God be my witness she said that. She had on on vacation after the 16 of December like the 20 days of December. And it was then that I told her that I was moving on.

Whoa! The shade of the buyer. Fortunately, my agent and I met via church flier. We're a perfect fit-the same dry sense of humor, flexibility, and business ethic. Although kudos Shaheeda, I learned so much from your videos, that I impress and stump my agent.

Well, my realtor is costing me lots of money. I’m buying a home in a different state and he agreed to be my eyes to ensure the home isn’t a money pit before I fly in to view in person. He provided videos of the home, but neglected to share the problem areas in said videos. Needless to say, I am currently under contract on a home that is indeed a money pit. I hired an inspector on my own and they found a host of issues, and many were visible to the eye. I have already paid earnest money, purchased a flight, hotel, rental car, AND paid for a host of inspections. My due diligence ends tomorrow, so I’ll get the earnest money back, but I find the deception too egregious to continue this relationship with my realtor. Pissed is an understatement, as interest rates are continuing to rise and now I’ll be back to square one with a realtor.

I know how you feel in the last part. I too have to restart to square one 1.5 years working with the same real estate program to get poor quality customer service and success in first time home buying. When we began rates were 2.7 -.-

I have been looking for about a month and a half now and I honestly feel like my agent and their company is kinda like ehh, not putting much effort into us. I'm not going to lie I feel pretty much looked down on. We are at the point were we feel like we may need to change agents. I have gone though my emails and not doing that agreement. Its a difficult time for first time buyers depending on price point. Have a conversation with them about the market and how best to achieve your goal of home ownership.

Good video, but if buying a house under FHA, USDA, or VA loan I wouldn’t recommend signing a contractual agreement with a Realtor. Reason being is once you sign the dotted line the Realtor will favor clients with Cash offers and 20% down over a client with a more challenging situation. A Realtor without a contract will fight harder for you.

I've read in a home buying how to book that going behind your agents back in the ways described here can lead to lawsuits and court battles which will massively delay the home purchase.

Based on what I experienced for the past month, I found that most of the agents are passive, they don't want to spend time looking for the homes within your criteria other than click here and there from website that basically available everywhere. They don't have added value to make it worth it using them as agent.

Agreed. It's 2020, buyers can find their own house. Hiring an agent is only for the trust and guidance through paperwork and escrow. Rather have one than not but most are definitely overpaid

@@yume816 This! I have a realtor and we are proving to not be a good match. He just plugs in my price range and sets up emails to be sent to me. Then he wants me to only use this one app he has, saying the others ones are garbage. I’m like, that app ain’t telling me nothing extra special over Trulia or Homes.com 😒 I guess I thought he’d see some more homes for me through MLS that could help me out, so it’s a bit frustrating.

@@Gunngirl Don't hesitate to switch. Most agents nowadays are concern racking up their commissions and forget to provide care and communication throughout the entire process. I find agents less than 4 years are more eager to help.

Loved your channel!! We are in AZ. How do you fire a realtor if we didn't sign a contract with her? However, a person that we know brought her the day that we signed the contract on a built. We were told that if we didn't have an agent, nobody would get the commission. We regret our ignorance at the beginning of the process. If wouldn't know I would hire an agent that will help us and look for our best interest. In our case, she hasn't really done anything but waits for the commission. Love your channel. You don't have a buyer's brokerage agreement with her but she is listed on your sales contract as your Realtor so the builder/seller is obligated to pay her a commission. Since she has not done much for you see if she would be willing to give you a rebate of some of her commission to reduce some of your closing costs. We are in Australia and fell for exactly the same thing. Stuck with a realtor who is doing nothing with our purchase in Conroe, Texas. She is even not going to do a blue tape walk through with us/for us if we can't fly in time. @jrpermk do you sharing how it worked out for you?

Nice video. Only think I don't agree is that you encourage a buyer to look for a realtor with a lot of years of experience. So what about new agents. They can be very responsible and guide them through the process. Remember how you felt when you started in this career and you were new and no experience yet.

What I tell new agents is that you can make up for the lack of experience with education. If the agent is newer you should make sure they are knowledgeable about the market and can answer your questions. Most new agents are working with mentors as well that can make up for the inexperience. So if you are considering going with a newer agent or if you are a new agent. Watch my 7 things to ask your buyers agent now...to see if they can answer those questions. If they are unable to answer your questions and they are new...I would probably keep looking. Hi. I noticed most of your questions are geared towards someone choosing a very experienced agent. What advice would you have for someone who is a new agent and wants to build up their client base? Everyone has to start somewhere and just because someone is a newer agent doesn’t mean they aren’t as qualified as a more experienced agent. What is your opinion on buyers choosing a newer agent to represent them?

Knowledge makes up for experience. So if the new agent is knowledgeable then I wouldn't see a problem with using them. They need transaction knowledge and market knowledge. I'm watching this 9 months too late. My husband and I are 1st time homebuyers. Our agent has been a complete disaster. The reason we chose him was because we had worked with him renting a house last year. This year, the homebuying experience with him has been horrible. We chose his company's title company well now we have to change because they lied about covering title fees and they send me another one of their clients closing 💁‍♀️ That's not all we wanted a pre drywall inspection which I did without telling him. The inspector found mold on several pieces of lumber. Well the Project Manager told him it wasn't mold and he went with it even after me stating that the inspector is mold certified. He then told me I don't want to keep asking questions because the Project Manager will get mad and not want to fix items before closing. I'm like what? Are you working for me or the Homebuilder? The sales rep said he can't be moved but I know he can. Anyone live in Texas have any advice will be wonderful

I hope you can offer me some advice. I have an agent who has listed my current house and helping us look for a new house to purchase. Therefore, she's listing and working with us as a buyer's agent. We already have our current house under contract. But she has not been that helpful with helping us find a house to live in. 😔😔I have other complaints but that's the gist of it. I know we're probably stuck with her for the selling of our house but are we stuck with her in looking for a house? Can we hire someone else for that?

Hi, some people do split this between 2 different agents, but typically they use the same person. You can use someone else for the home purchase by terminating the buyer brokerage. You should have 2 contracts in place 1. Listing Agreement and 2. Buyers Brokerage Agreement. So you can terminate #2. However, review your documents - if she gave you a discount on the listing side since she was going to represent you on the buy side you may need to renegotiate this(lots of agents do this). I would just have an open conversation with her because sometimes agents that mostly list homes for sale may not like working with buyers - its a lot more labor intensive. She may be ok with the switch. I hope this helps!

You likely just need to get approved for a mortgage and contact a Real estate attorney to complete the transaction.

This is great advice. Currently under contract and signed a Buyer agreement however my agreement is good for one year. Not 120 days or less. Is that common? I thought it was so I signed. I found a house so I guess it doesn't matter now. Just curious.

The Realtor can make the contact for whatever you both agree on there is no set time but I think on the buyer side the shorter the better. Then if things are going well you can always extend.

Not yet, I just have one new construction video right now, you can watch that. However, for the most part new construction builder contracts are written in the builders favor and not yours so make sure you fully understand what you are signing. Also, you may be able to get a special stip in there if needed. Have your agent advise you.

Hi Shaheedah... any ideas why a realtor would not offer the Buyer's Brokerage Agreement? Particularly when a contract has been signed (New Construction), deposit has been made, and a closing date has been set? Maybe the agent has a closer relationship with the builder's sales rep perhaps... and working in the builder/sales agent's best interest as opposed to the buyer's?

Some agents just wait until right before closing to have you sign if they are listed as your agent on the sales contract already. I like to do mine after the first complimentary showing, but I have gotten busy and did it after the buyer has gone under contract as well. So it could just be a paperwork thing.

You can try some of the auction sites like auction.com. Also foreclosures are often listed for sale with brokerages so you would see them on on regular real estate listing sites.

You can still stay with the lender. The lender has a esponsibility not to share your information with anyone you have not given them permission to.

You can terminate at any time and then use another agent. If you are already under contract and want to switch it can be more difficult becuase the first agent likely already earned their commission.

Hi! I’m hoping you can clear up a couple things for me. What exactly do you mean by “if I find you a house”? The reason I ask is this. I am currently working with an agent that is not finding me anything. I find the house, and she shows it to me. Does “find” mean “show”? Also, I have a budget of 200k. My agent is telling me I need to look at houses around 160k so that I have room to offer more. To me, that seems extreme. I’ve been looking for about 9 months.

Good question, regardless of who finds the house during the term of the buyers brokerage agreement your agent is likely entitled to a commission, however please review your contract. 9 months in a long time to be under contract. I usually do 90 days and we can see how it is going and if we want to do another 90 days. On the price, I general advise something similar because if you are looking up to your max offers are coming in above that amount its hard to compete. I usually advise 10-20K under but that is market dependent. If you want to be in that price range offer to be a binding back up if your initial offer is not accepted. Best of luck!

I had a question about a personal situation I’m in: Me and my fiancé are first time home buyers and have been working with a real estate agent for about 1 month. My fiancé knew the agent personally and never asked us to sign a contract. Unfortunately, she has not been the most communicative person and takes days to reply or confirm a showing during this crazy market when we find something through the portal that she has given us access to. We want to start looking for a new agent but not sure what the ethical way of doing this would be. Again, we did not sign anything with agent. Only has shown us 3 houses and have not submitted any offers. Again thank you for great video! Hope you could answer my question!

Since you are not under contract with her there is nothing to terminate. However, I would inform her that you would like to find another agent to represent you. You will likely want to have your fiancé have the conversation since they know one another and he may want to be keep the relationship intact. Thank you for watching!

Yes, but... I do recommend that you find an agent first because they can help you find lenders. However, they may not work with you as a client until you are approved. I generally do a buyer consult, send the potential client lenders I recommend for the customer and if they are approved and would like to work with me I have them sign the buyer brokerage agreement. But all agents run their business differently so this will vary. Thank you for watching!

Hi Shaheedah, I hope you don't find my comment offensive, I am in dilemma right now about why I should work with the real estate agent to buy a house. I want to ask you one question? what value does a real estate agent bring to the table? In the bay area houses don't last more than 7 days, listing on Thursday -> open house on Saturday and Sunday offers on Tuesday or Wednesday. (Highest bid with no contingencies offer gets accepted). I can do the comps based on Redfin and Zillow sale data in the neighborhood. For one of the offers I put listing agent asked my agent that they don't like inspection contingency (I added it mostly for the foundation since home inspection didn't cover it) my agent asked me if I can remove the contingency I said no then she was kind of upset about it. With that being said I really liked your video.

No offense taken, but a real estate agents job is not only to find you the house but to guide you through the transaction unitl closing. Using their exprience and knowledge to guide you to reduce the risk of making the wrong decisions with this large investment. Also, even if you don't have an agent, the listing agent only represents the seller, so then you are left with no representation. It is a difficult market, you have to let your agent know what you will not do like waive the inspection, it may take you longet to find something but you will.

Questions saved, when I'm dealing with realtors this past year I saw it doesn't matter if your employed with good credit and have money, many still discriminate against black people. Should I ask the realtor also do you have a diverse client base or do you only work with high income clients?

Question; What knowledge / terms and agreements etc do you have about builders who ask the buyer to stay away from their home during the building process? I understand the safety aspect etc, In the pass I had a home build that had a cracked foundation I decovered before the carpet was installed....I was able to terminate the contract because of the defect... If I stayed away, the builder would have never said anything? Oh, this would be after normal work hours eg 9 to 5.

Schedule your inspections, you can do a private inspection on a slab, pre-drywall and a final inspection . That way you are not in danger of getting injured on the property during the build. thank you for watching.

I say reach out to agents first because they can help navigate to the best lenders but most will not take you to look at properties or may not take you on as a client until you are pre-approved. This is how I do it generally. I do a phone or in person/zoom buyer consult. Recommend lenders that match their financing needs, when they get approved and we decide to work together then I have them sign the buyer's brokerage agreement. But all agents conduct business differently.

I feel I'm between a rock and a hard place with my agent and my lender. We are first time home buyers and signed a contract for a home. We found out it had structural damage and although we met with someone who does the work and the seller agreed to give us 3,000 for new downspouts, we also discovered that the house had several Piers/Peers installed and there is a large crack in the basement and an uneven floor. We asked our agent to get the warranty from the seller and his agent regarding the company that made the repairs and he said he bought it as is from an agent 5 years ago and he didn't have any information on what company did the work. She referred us to her son-in-law who is a mortgage loan officer and now I just don't know what to do! I recently found out that my realtor has dual agency as well. How do I find out from a third party how many days we have to back out? Our closing isn't scheduled until 03/23/22. The person selling the house is not living in it, so the only issue seems to be that other possible buyers have not been looking at it. I'm beginning to think being homeless and living in our van is better than buying a house.

I don't have a video on that specifically but review your contract and see if there are any penalties for terminating your contract early. Usually their may not be any but be sure. Usually agents want to end on good terms and will release you without penalty.

With technology, it is common for buyers to send agents properties they may be searching for. I will often meet with clients and they give me their price range and they will send me properties they want to see that are above their price range, so it is usually team effort. If you only want the agent to send you properties, then you need to communicate that with them.

You shouldn't lose it, but read your contract and contact your realtor, you should be able to get a refund based on the finance contingency. Since you are leaving the state, you would no longer qualify for an owner occupant mortgage.

A new real estate agent should be mentored by another real estate agent with more experience for their first few transactions. If you have never closed anything before, a new agent is a huge risk especially for a first time buyer. I was mentored through all of my transactions when I was first getting started. A little confused by your question but if you are asking it you can get out of your real estate contract when you don't have a buyers brokerage agreement with the agent that did the contract for you? Then that answer is likely no, you do not have to have a Buyers Brokerage agreement in place for the contract between you and the seller to be binding. At least in Georgia, check the laws in your state.

How about if I wanted to get rid of the agent and the agreement was done and already had the buyer as a seller and the agent was a duel agent he never gave me a closing day took ten days to get the lawyers and was just playing with my time and kept me in the dark I called the regional manager and everything then he got a new lender and didn't tell me anything and still no closing date can he get the commission still if the house is sold?

Your question is a little confusing, but the short answer is if the agent is the person on your sales contract they are likely entitled to the commission. If you are having customer service issues, reach out to the agents broker.

@@ShaheedahHill i mean the contract with the agent was for 2 months it was already 100 days i had the buyer before I came to the agent and I told the agent that I need to sell asap and he took ten days to contact the lawyer on purpose after I signed the agreement he became a completely different person i tried to contact the broker all through the the 3 months left my number he never got back to me to this day and the agent was taking his sweat time in fact another agent that i knows helped and everything and I finally got rid of him because I told him that I am trying to get the house sold asoon as possible because I have a custody battle and he took ten days to get the closing attorney after that and he never gave me a closing date 📅 he kept me in the dark never let me know that the first lender was not good and if I want to continue and then got the second lender without asking me if I want out or not he know that I was upset with how he treated me and the attorney and the agent was ping pong 🏓 ing me back and forth then I changed my mind to continue with him after the contract was over and I called the regional manager and reported him and his broker never got back to me ...... can he still can collect the commision? Not only that he gave me a codwell banking card and it ended up being that he worked for weichert

So I want to get a different agent. My current agents communication is AWFUL!! Last time we spoke was November 30th. She took me to see 1 house and we put in a offer that was not accepted due to half of the closing costs being requested. I believe she got frustrated with me cause I did not want to use that much of my down payment towards closing cost and she lost interest. Should I pay her something like an administrative fee for her time? Was signed with her since September and saw 1 house with her and put in 1 offer. I want to be fair, but I don't want her as my agent as I feel she no longer has any interest in me.

There is no obligation for you to give her anything unless there is something like that in your contract, but it is a kind gesture. Simply say that you wish to terminate your buyer brokerage agreement and you appreciate her time and service thus far.

Agents are being selective of who they work with in this market. It is very difficult to find homes, so some are not taking FHA buyer, certain price points, etc. Keep looking and have realistic expectations in this market.

Hello, my husband and I are currently under contract for a new build in GA which will be completed in May (hopefully). Unfortunately, we're not pleased with our agent. There's a 60 day protection clause but not really sure what that means and if it would apply since the home is under construction and he didn't find the subdivision for us, we did. Can we terminate our buyer agent agreement with our realtor and hire a new agent at this time? Thanks!
