Being a record label and a registered BMI publishing company, if I dont have a work-for-hire contract between an unaffiliated recording studio and myself (artist, label owner) does that give them any ownership of the song that I record at that studio? Interesting. I'm new at producing music. I've always made my own songs from scratch.. And now I've got to adding my own lyrics to songs, I have a gaping hole in a lot of them for a chorus.. And being as I'm a very musical person, I always have examples of an existing chorus that I could cram into my song that would lyrically fit... So anyway, that's what I've done. I've put a very well known chorus into one of my songs that almost finished. I'm also playing around with another song which is now largely based upon another famous song, as its lyrically perfect for the song I'm writing... I really didn't want to go down this route as I've taken pride in making my own music from scratch but this seemed like an appropriate time to explore the feasibility of sampling other artists. I'd imagine I'm going to be priced out immediately, but I wanted to take the steps anyway.. So I'm now in touch with a two companies exploring clearing these samples. One owns the publishing for one song, the other owns the publishing for the other song and the recording for both. I was fortunately quite in depth with my intentions. I doubt it'll go anywhere but excited to see what happens next. If its not feasible than I will create my own chorus' for my songs.. It's no biggy... Thanks for the info though, I look forward to seeing how things play out

I would start with the methods in this video or consult with a sample clearance specialist. FOr MJ if your song isnt on track to produce a good amount of money then they wont even clear it.

One beat I leased last year has a sample that needs to be cleared in it. My question is if I don’t decide to clear the sample and use it to record a song, but only use on it for listening only on websites like SoundCloud or Datpiff, is that considered infringement or piracy? Yes if that song is or was purchased by them it would be in a PRO account RELATED to them. You won't just be able to look up clorox song and it will pop up. It could have come from an independent company that licensed the song out to a sync house. You never know. It is a matter of finding the production company that shot the commercial then asking who the music was done by them searching for that publishing company and contacting them.

I would like to know about the use of percussion samples - Not the beginning of Billie Jean. Percussions is the ONLY thing I ever sample, but I do that from time to time. I have a library I go back to occassionally. In that library I also have percussions I´ve picked up from some "Public domain" sites. How is that in terms of legal use?

One shots will have no problem at all. Lol and yeah of course that Billie Jean snare will get you caught up every time hahahahaha. Even the stuff in public domain is still good. Now, if you decide to use an entire loop of the drums you may run into some issues with that as you are sampling an arrangement. Watch out for those drum break packs.

Well what if the author die?🤔 What about if I bought a beat from producer and the producers put the sample in the beat. But the producer ( which most of all of them do this ) did not clear sample. They just use it in make the best. But the producer sold me the beat. Now I would have a case because the producer use something and sold something the didnt clear or own, for profit. But then the new owner would have to go try to get the sample clear with is more money. This is the same this even in lease.
