Im afraid it wont work. He says shallow rooting and all the herbs ive gotrosemary,cilantro,basil,lavender, ect) are deep rooters

How can you tell if the wood in the pallet has been treated?

In my part of Eastern Canada the treated palletts are going to be Blue or Red, what you want are the ones that are just bare lumber.

Look at the abbreviations. You would want to keep a look out for ( HT) for Heat Treated.. These are the ones you want to use for your garden or project as this is safe. Don't use plastic or coloured ones as these are more likely to be used for chemical or may have been fumigated at the ports. Most important, when you see the initials (MB) do not use. This is short for Methyl Bromine. When you see branded ones, more often than not, they cannot be used, as they are strictly used for commercial use and normally re-used by the organisation.

Do you have to protect the wall against water/damp? Here in Europe, the weather is much wetter than in Australia.

This video is from New Zealand, there is plenty of rain in NZ! I imagine it would depend on the kind of wall you're putting it against. The one they show in this video looks well-sealed anyway. If you were putting it against brick, or wooden siding with peeling paint or something like that, you might want to attach a tarp to the back of the palette to protect the wall.

Ideally with some masonry bolts (M10, 100mm). Mark & drill holes using a 10mm bit then fix to wall with a socket wrench. You could use coach screws or hammer in frame fixing screws but with masonry bolts you don't need to bother about plastic wall plugs, 10mm diameter heads and 100mm length should do the job.

It would be, depending on the type of wall inside, it it's a plastered solid brick/concrete wall I'd go with coach screws and nylon wall plugs. If it's not a solid wall things are more complicated as you'll need to find the studs in the wall to secure it with different fixings. I'd probably use a "French Cleat" for a stud wall given the weight of a pallet.

Sarah Lestari I made one of these a couple of years ago. Just keep them moist over summer as they dry out quick with so little soil, otherwise they do fine. Have had annual flowers and now switched to succulents this year
