In California you must have "just cause" to evict. Can't evict just because you plan to paint, change the counters, or upgrade flooring. Change of use of the property requires adherence to the Ellis Act.

What if you offered a place to stay to someone in exchange for services around the property, no formal lease was signed but the tenancy has been problematic, he has intimidated my child, it is on the same property that I reside. He has been slow to perform the services, ie. He was supposed to do yard work has every excuse under the sun not to cut the grass when it needs done it’s a hassle if I ask him to trim a bush, otherwise he is paying nothing to live here and I want to end the arrangement???

House I was renting got foreclosed. Then the commissioner of the court showed up at my house says he had possession of the house and wanted me to pay her. If you can see,for example,that the tenant is destroying the property,holes in walls,pet damage,broken windows,etc,can you not try for 30 days,or even less to allow less time for additional damage to be done? And would photos be good to prove to whomever is subsidising the rent,that damage is being done?

Ray, my 20someting daughter and her new husband both permanently lost their jobs do the covid 19 shutdown they live in the bay area. @@mikeandema6925 To answer your question my tenant had been there 5 yrs. I charged him $500 per month below market if he'd agree to take care of the property, he didn't, neighbors constantly threaten to call the city for the all the construction vehicles parked all over the neighborhood. He wouldn't take care of the yard I had to hire a landscape service . I have automatic lawn sprinklers he turned them off... Last spring he said he had no work and couldn't pay rent then I found out he'd bought a travel trailer and went on vacation. BTW, I didn't charge a security deposit or do a credit check because I felt sorry for him. There is so much more but I'm not going into all that. My daughter has moved out of the one bedroom dump she was living in into a beautiful redone home....She almost has her AS degree and is continuing on to get her RN degree While she is working ! Hope this makes you feel better.

Yup this is what I am dealing with no written Agreement and she has been threatening me and I have all of my proof and evidence to back up I found out the apt I am in my roomate receives section 8. So am I going to sue and of course my master roomate does not want them to find out I am going to use and utilize all of my rights within the law to save up and move out.

HI, i have a question not sure if this falls into the "feel free to call us" I have a roommate , that moved on 9/28/17 and we are now on 8/14/19. we are located in NYC . We made a month to month agreement . The roommate has not pay rent in months and owes a high amount . now i need help on the following: 1 . which type of notice i need to give out? 30 or 90 days notice? 2. we agreed on month to month on the first day of the month . how do i give out the notice? a day before the next month starts or i can give the notice anytime ? as long as its 30 or 60 or 90 days? , for instance, we are in mid month (august) . 15 days till september. do i have to give 30 days + 15 = 45 days notice?

It was done to me and my wife by my own mother and my youngest brother because my wife and I practice Judaism. We never miss paying rent. We had to call the cops when my mother tried to hurt us with a knife. We eventually moved out then won our case in court. My mother hated us because we're Jewish.
