I’m in a situation where police came with an arrest warrant. Smelled weed and searched my house while waiting for a search warrant. Then handed my wife a search warrant for a house way across town

What can you do for a unlawful search coming from the Dollar general said ran over the white line at the stop sign but we did make a complete stop now they want to search your car and you but I don't understand the crime for this search then call the dogs dog search found nothing on us or the car did not even give ticket for what you say you pulled us over for and that was we rolled on the line at the stop sign but did make a complete stop we asked why we was being pulled over we was told we rolled on the line but we made a complete stop but you want to search Us and the car this is clearly harassment so how do you get help for that we did not go to jail but all that happen right in front of my house my son who's 12 we ran on the line of the stop sign Wade up the road coming from Dollar general office followed us all the way to the street of my house and then Hit The lights so we turn in the driveway so is it anything that can be done about that?

They came to my house and seized my son phone and searched it without a warrant they didn't ask for consent they just asked where is his room and questioned him without notifying him of his rights

I don't think that the plain view doctrine, in the case of a home seizure, is an "exigent circumstance" since in every state that I know of the officer must ALREADY have had a "legitimate purpose" for being on the property in the first place and, unlike the state of Texas, which precludes misdemeanor warrants, the state of Georgia requires judicial review, rather than mere police assertion, to satisfy the requirement for the issuance of a warrant in the first place, and it would be inconsistent to say that cops have "exigent circumstances" for home entry when they are already otherwise legitimately there AND where the cop wouldn't have even been able to get a warrant in the first place because a magistrate disagrees with him....This is NOT "exigent circumstances". See Lange v California 2021 for more details

GJToken Great question! The US Supreme Court has held that during a traffic stop, a K-9 unit sniffing the outside (or walking around your vehicle) is not considered a search that violates your 4th Amendment rights. HOWEVER, the police still have to have reasonable suspicion to stop you in the first place and they can’t extend your detention beyond the reasonable time required to complete the stop...so if you’re stopped for speeding and instead of just writing you a ticket, they make you wait for 20 minutes to get a K-9 unit, then that may be unlawful. But if a K-9 unit is already present, they can walk around your car. And if the k9 alerts, then that may establish probable cause for the police to search your vehicle (with some caveats that will take too long to explain so I may have to do another video on).

Its public property, and since they're not doing anything wrong, they shouldn't have any problem whatsoever letting you do so.
