For you that don't understand You don't just pay back taxes . Step 1 is find that previous owner has actually abandon said property and owes taxes and pay those taxes . Step 2 is to continue paying taxes and step 3 is to make x amount of improvements for a set amount of years, in oklahoma it was 5 and then you will be granted the deed . In some states you may also have to live in and improve home . My father in law done this on 2 homes.

Most of the time (but not all of the time,) houses have been abandoned because they are in foreclosure or getting ready to be. The banks leave the houses sitting empty for years until they go into a state of disrepair or are ruined by vandals, so if someone can pay the back taxes and move into the house legally, then why not...The banks should be doing something with these homes instead of leaving them to sit and rot away. With all of these abandoned homes, hotels and apartment buildings in our country, the government and banks could create programs for the homeless people that want a home but can't get one to be able to move into these places. They could do sweat equity programs similar to Habitat for Humanity. It would get so many homeless off the streets and our country wouldn't be just sitting, decaying away. To me it's shameless that we have all of these abandoned places, yet so many homeless people who need homes.

re my post above, yes I agree with you ... it is such a waste of resources but no one really wants to start paying bills on a regular bases ... as I said, I tried to organize a group of pensioners, together with myself, to actually claim such a property ... and there are lots of really good buildings out there with 4-5 bedroom 2-3 (sometimes) bathrooms and nice big kitchens but ... what the heck ... no wonder so many people from 3rd grade countries are getting rich ... they are prepared to do some work, not take any alcohol or drugs ... and then the govt/states are no longer obliged to give you owner informations ... under the guise that it is a privacy issue. No wonder so many large investment companies from overseas are able to buy Australia up, these overseas companies and individuals are actually protected because estate agents are the only one's that have access to who owned these properties as well as who buys them ... so the rich get richer and the poor get poorer ... and all this farce about the govt. doing constructive things to return Australia to Australians ... what a joke ... all this is allowed to go on until Australians, that are pensioners now, people that have worked hard to support and educate their children ... are reduced to poverty ... while foreigners are buying up this country.

"... the government and banks could create programs for the homeless people ..." When many homeless people do get into a place, they trash it so bad that it costs thousands of dollars to put it back together. Homes require maintenance, and homeless people can't/won't/don't provide that, either. I don't know what the answer is, but that isn't it.

A few years ago a friend of mine contacted me and asked for my help. At the time he owned a piece of land (about 15 acres) outside of town in the country. He bought it with the intent of building a house on it but never did and was in the process of selling it. There was an old double-wide mfg'd home out on the land that had been there since the previous owners and someone had recently moved into it unbeknownst to him. The people trying to buy the property had gone out to look at the land and discovered some squatters like you. My friend goes out and asked them who they are and what they're doing on his property, and they not so politely tell him to fuck off. So, my friend does what most people would do in these circumstances: he called the cops. Cops come out and talk to the squatters and then tell him he has to go through an eviction process and all this other bullshit. They even had a bullshit lease agreement they claimed my friend signed. The problem was that the land had been for sale for over a year and the people looking at the land were the first to meet his asking price; but if they couldn't get these losers out of the trailer within the next 2 weeks, they were going to have to pass. SO..... that week he and I watched the property for a few hours a day to figure out when the squatters came and went. The next week he and I camped out and waited for them to leave, then we kicked in the door and looked around to make sure no people or pets were in the trailer. Then we hooked tow chains to the trailer frame, dragged it up a small hill on the corner of the property, and rolled it over... down the hill. It was pretty crazy. The whole shithole just came apart and all their junk just went all over the place. I really hope that everything they owned in the world was in that trailer, all of their sentimental items, all the crap that held back their moral progression. Next we got in his Ford F450xlt and drove over their shit while doing donuts, blew a tire and got 2 punctures. Overall, it was an immensely satisfying experience.

You can't simply take possession of an abandoned house, even after you pay the back taxes on it. The rightful owner has so long to repay you before the property becomes yours. You could end up spending tens of thousands of dollars to fix that dump up and still end up out on the street.

Hmmm ... ... if the house is empty because someone is involved in speculation (such as banks or real estate agents) just so that in 19 years they can sell the property from under you at a major profit ... then that shows that there is a major flaw with the legal system in whatever State (and Country) the property in question is situated and smacks of collusion and intent to manipulate the law. Now I know of someone that went overseas and is classified a "foreign worker" in another country, left his uncle on the property ... unfortunately, his uncle was a bit of a loner and when he died unbeknown to the owner, the place laid empty ... this is about 6 years ago ... so I am told ... does this man have the right to claim his real estate again?

Now with that being said, there is a way to make some financial gains by going to your local office with the state and paying the back taxes on some of the properties. You can hold that for two years and you have to contact the owners to let them know you pay the back taxes to give them a chance to pay you the back taxes plus interest. If after two years in some states, again I stress check the Laws of your state. You can then file a claim for the property if they do not pay the back taxes in a time. Allowed by law in your state.

In Texas, it can be 3, 5, 10, or 25 years (if I remember correctly) depending on the circumstances. If you break in, you can go to jail or prison even if it is abandoned. And if at any time during that period, the owner objects to your presence, your adverse possession claims won't work. I think that it is the 10 year period the way you describe it, but if the owner is in the military on active duty, it would be the 25 year period.
@ericjohnson7530
@ericjohnson7530 5 жыл бұрын
@ It would be pretty difficult around here for someone to take property by adverse possession if the owner is aware of what is happening. The only person I eve know who ever actually acquired land by adverse possession was of property that the owner(s) had move away and had taken no steps to do any upkeep on the property or to sell it. They had pretty much forgotten about the property. And if they showed back up and wanted the property, he wouldn't object at all. I think that they did have to repay him for the property taxes. He even made it easy for them to find him if they came back. He would put a sign on the fence that also had his phone number. All they had to do was call hm if they came back and wanted the property.
@ericjohnson7530
@ericjohnson7530 5 жыл бұрын
@ Look at it this way. You don't pay your property taxes or the property is condemned because it has become dangerous and the county seizes it and sells it. If you come back and want it back, you are completely out of luck. It's no longer yours and you have no legal right to get it back. Someone acting legally takes possession of your property in hopes of a future adverse possession claim. If you come back and want it back within that time period (which can be years), you recompense them for the property taxes and maybe some of the expenses for taking care of the property and you get it back. Of course, the people in these videos don't have the foggiest idea what they are doing. Anyone legitimately pursuing an adverse possession will know that the rightful owner is going to get it back. The people in these videos are scumbags, not someone who knows what to do.

Its called a quiet title... check with the State you are IN before you take over a property. ALL of the States have a statute of limitations when it comes to foreclosures. In some states its 5 years, and others, its 6 years. You can head down to the City or County property appraisers office and file the Quiet Title and allow the City or County to investigate, once they clear the title, it becomes yours. Pay whatever property taxes are owed, and you have a new home. ALWAYS DO your homework before taking a home. Consult with a real estate lawyer to make sure that you are protected and not hauled off to jail.. Good House Hunting everyone :-)

If a property does not have its taxes paid for a period of three consecutive years than the property goes to the county and can be taken by anyone who pays the property taxes up to date. Property law is the same across almost the entire world, and I know for a fact that in the 1/3rd of the world that operates under the same laws as mine you have no claim to the property unless you own the deed, the end. If there's no deed, it's crown land or owned by the government. You're just illegally squatting.

If the taxes are paid up to date then you just committed a felony. Its called breaking and entering and now everyone can see the evidence. The family farm (my family) was left unoccupied and used for hunting and camping and the like. Then somebody started squatting in the old house and when called on it they said they "owned" it! The gall! We finally got them out with the help of a lawyer, the courts, and the sheriff at the end of a gun. Make sure you know what you are doing. Check out the legal status of any property before you do this!

My parents left their house for about 1 year alone. They paid the taxes and all. But some squatters tried to come in like this and act like it was theirs. Little did they know that I was still visiting the home and making sure there were no insects or rodents living in the home. I would go, spray, or set traps in the places where it wasn't visible. But I saw that someone was trying to squat. So I gave them the time up to one day before they could claim it. I walked in, with AK-47 full auto 100 round drum in hand, military style bullet proof vest on, extra banana clip if needed in the vest as well. They weren't there? Huh? So I sat there and waited. Ate some of their food, played with some of their stuff. And even took some binoculars they had. Lol! They didn't see me coming is the funny part. Finally around 7:30 pm, they walked in. With a group of 5 people and liquor in hand. They went around the back, and what a surprise when they walked in? A huge barrel sticking out at them. Some of the people ran, but of course the supposed new owners walked in non chaulently in. I told them, "If I ever see you around any of my properties again? I'm not going to wait for you to put your hands up. Get your shit and get the fuck out!" The girl asked me, "What other properties do you have?" I just yelled, "Get the fuck out before I just shoot!" That did the trick for these types of people. Plus one of the neighbors let us know people were walking into their house. So that was that. So just in case you're in Texas? You've been warned. We own several properties. No more warnings. Breaking into a home who's owners have guns is a BIG no no. Remember that next time.

These comments are so uneducated. Investing in abandoned tax lien houses is the way to invest. Bankers do this all the time. Why would I take out a so called mortgage loan for $250,000 when I can get a tax lien home for dam near $5,000 or less. Then I can take the deed to the bank as a collateral and get a so called loan to fix the place up. Then I could sell that property for way more than what I bought it for and pay the bank back the so called loan and make extra money on top. Not only did I flip my $5,000 to a higher amount I also boosted my credit by paying the bank back. Duh seems like a win win situation here. The schools don’t teach you this because they need you to be dumb so they can eat off your labor. There no such thing as work hard in my world only watch your money work hard for you. Sorry but you are wrong. Lake Isabella is in Kern County and I live in Kern County. They used to make property owners go through the eviction process with squatters the same as renters and many of us complained so much the city attorney did some research and found out they and many other city attorneys were WRONG!!! Squatters don’t have to be given the whole lot of rights renters do, and require a judges order to be evicted. Kern County now allows property owners to post a 72 hour squatters notice on the property with the date and time it was posted listed. The property owner is also encouraged to post a no trespassing and no parking sign as well. When the 72 hours passes, not only is the sheriff required by law to remove the squatters, but whatever tow service the county uses has the legal right to tow any vehicles on or in front of the property. And any name on any mail in the mailbox can be used to provide to the US Postal Service for a federal investigation for legal charges. Because you see using a false address is a crime. If the squatters collected any state or federal aid, such as food stamps, welfare, SSDI, those agencies will open investigations. If a drivers license was issued with that address, that is DMV fraud. If a ticket was issued, that is fraud to that law enforcement agency. But best of all, if a credit card was issued to the squatter to that address, credit cards usually are based out of Delaware or other back East states nearby. They come to the squatter through the mail across state lines. That makes it a federal fraud within the jurisdiction of the FBI. And if any of them are on probation or parole, they have knowingly provided their parole/probation officer a fraudulent address because they knew they were illegally squatting. That violates the terms of both parole and probation. So it’s a really poor decision to make and will bite you in the ass if the property owner has any idea whatsoever they can do this to you. I did, and I did it to my squatters. And they learned a life lesson the hard way. But they were serial squatters and not about to stop. They had no shame for what they did, no guilt, and didn’t care how much harm they caused or how much damage they did to property that then had to be repaired. Nothing was ever their fault or their problem and the world owed them. So now they have free rent and they can wear free orange jumpsuits and eat free bologna sandwiches. Be careful what you ask for. You might get it.

Alina McPherson my property didn’t have any issues with unpaid taxes and my brother lived in a trailer on the property. So I’m not wrong. And there was no live able structure on it. So don’t make a blanket statement like that. Your statement is very specific and doesn’t apply to every situation. Many squatters literally camp out on vacant lots here in California due to our good weather. It’s the number one squatting situation. No house or structure means nobody has to have lived on the property. Thus adverse possession doesn’t apply to any entity other than the bank if you have a loan or the county if you don’t pay your taxes. Just try saying your right to squat and take possession overrides the county’s right to take possession over unpaid taxes. And I can tell you my county will not accept back taxes from someone who can’t prove they are the owner because the property then goes to auction and brings in more money for them. At that point, when taken for auction , any squatter would be removed by the county sheriff as a squatter with no rights to be on the property. No squatters rights and no rights to adverse possession overriding the county’s right to auction the property over unpaid back taxes. Same with the IRS. Don’t pay your federal taxes, they get first dibs on all your property and have ability to remove all inhabitants once they take control, without any local order, just their own federal order of adverse possession, and then they auction the property to go towards the true owners back taxes owed to the IRS. So don’t jump in with irrelevant info.

There is an abandoned home nearby, the owner died, the relations don't want the place, the taxes weren't paid, next year the county would take it for unpaid taxes, so I paid the taxes, and by adverse possession essentially own the property. Must pay the taxes and maintain the property for ten years to truly own it, but what the heck, I can use it for the cost of the taxes. If the county took it, they would sell it at auction and use the fund for whatever.

I am very sure this did not work out. CA Adverse Possession law state one has to both live in and pay the property taxes for 5 years. (AZ state limit is the lowest at 3 years in certain cases, so this is not a red vs. blue state issue). It looks like they were kicked out in a year so they did not meet the five year possession rule. If the taxes were not paid since 2005, then the property would go to Kern County. A tax search on 2232 COMMERCIAL AV LAKE ISABELLA on the Kern County Assessor-Recorder website for the property (ATN 263-352-03-00-2) shows the property taxes are up to date for the 2017-2018 fiscal year. Past deed changes were: 217154575 Deed - Quitclaim 11/13/2017 and 206179429 Deed 07/24/2006. The total tax bill for 2018-2019 299.84 The Net Total Taxable Value: 19,000 so that is probably a Proposition 13 value. Adverse possession rarely works except in limited cases like HAGMAN v. MEHER MOUNT CORP. No. B239014. Hagman (Dallas/Dream of Jeannie star) won since Meher was tax exempt. "In 1987, one of the fences marking the boundary of his property was built in the wrong place. Since then, Hagman (who died in 2012) and his family have been occupying and improving a 0.44-acre portion of the 173-acre parcel owned by his adjoining neighbor, the Meher Mount Corporation." The only reason this worked was that Meher Mount was tax exempt so does not pay property taxes. I call BS on any troll who posts here that they have taken over a whole property using adverse possession. It simply does not happen. But trolls seem to claim any and everything on the internut.

Any person can research the property for liens before making the purchase. Liens are a matter of public record, and a search may be conducted through the county recorder or clerk using the name of the property owner and address of the property. A title company may be used to search for liens on real property. If the lien hasn't been recorded at the time deed is transferred, in most cases, it can't be enforced against the property at a later date.

The problem is largely due to zoning, permitting and city regulations that require the use of expensive materials (such as triple pane glass windows) or restrict the size of the home (in most places you could not legally build a 250 square foot or 400 square foot house bc the minimum is much higher) and the size of the lot. The cities think they are protecting the investments in the (neighbor's) homes by limiting what people can do on their own properties. Most cities won't allow you to farm any food on your front lawn, and some won't even allow you to collect rainwater or put up solar panels... bc they don't like the way it LOOKS. And since most cities are built for cars, not people, few places are within a safe walking distance of a grocery store, public transit, and jobs; and by "safe" I mean with sidewalks. Only with pressure from the public will these laws get changed. Then, perhaps, builders of muti-family housing units (apartments, condos, co-housing complexes) will be able to offer low-income units along with the regular income units without going broke in the process. Right now, my city has $8 million in HUD Section 8 vouchers getting unused every year bc the homeless can't find any home/apartment that will accept the vouchers!
@bobbobby1846

@@auntcatziegler3791 that is a how a government city can get money.they claim they need funds for housing which is maybe true,but the government also knows that if know one takes the vouchers that year the state will claim nobody wanted it and will move the fund into an account. the account then could be used to pay their bonuses or be give a raise because they have the funds or use it for other city plans that they want.

As a former real estate broker and student of real estate law... At least in my state... I will say that it's good that you read the address out loud and that you're doing the video if your goal is come into possession of the house adversely. Because you are being what is called legally " open and notorious". People are entitled to their opinion I have mine but I won't say it. I will say I've seen situations where people have passed away who have absolutely zero heirs and no friends nobody. And I've seen neighbors move into their house and decades have gone by. I'm not entirely sure you need to pay any back taxes. Certainly the town would like that and it depends on the jurisdiction so I have zero knowledge or expertise there but it may be worth getting a second opinion on that! In my state it would mean that the town owned it so maybe that's really what you're doing is buying it from the town?

I would expect if a person passes away with no heirs. The estate would have to be probated so any claims anyone has against the individual can be sorted out by the assets one left behind. Literally just a shaky tour of a tiny house with a dog barking excessively in the background. To say this is a "how to" is a gross overstatement.

Oh I thought this video was about HOW to claim an abandoned property , did I misunderstand something or was it meant to be literally as the title suggested . I find English so complicated to comprehend. None human animals are so much simpler to communicate with 😂

You can never own your home in America, they say you do but what happens when you don't pay property tax even after you paid off your mortgage ? They which is the government seizes it , so which means like I said you can never own your property
@Macky1101
@Macky1101 7 жыл бұрын
How do you claim an abandoned building? All property are registered to some one as the owner. If they owner does not pay taxes on it, it goes in to default and the city seizes it. They then turn around and sell it at auction. If the owner does not maintain the upkeep and keep it to certain standards, they order the owner to do so. If not, they send in people clean up the lot so it conforms to the neighborhood and add the costs to the tax bill. If the tax bill is not paid, they again seize it and sell it. Most people's understanding of adverse possession is all wrong. Even modern policy and government employees misunderstand the original intention of the law and what how it works. This allows people to get affidavits from the local government to adversely claim a property. So the police don't understand it and don't do shit to squatters. Adverse possession was created in the 1800s, is about boundary claims of land not being used or undefined, such as a property line, piece of land, etc. It was to encourage land development and usage of unused land (not houses). With the current civilized society, as mentioned above, adverse possession shouldn't actually exist any more because city takes over everything that is unclaimed. They are stupid if they don't do it, and simply allow "adverse possession" to the citizens.

But if someone squats in a house it is illegal to put locks on the doors or remove them it's almost the same as letting someone live in your home rent free for over a month then trying to kick them out. By law you cannot do that. My friend owned a house and didn't want to pay taxes on it so he moved out and I still lived in it for a year without the bank coming and trying to get me out they didn't even bother. And when they tried to have a lock Smith put a lock on the door when I opened the door he said sorry didn't know anyone was living here and left he told me he couldn't lock the door if someone was living in the house no matter it belonging to the bank

Should try to find the owners to try to buy it directly then taxes. Even for a dollar. Not worth legal hassle and title issues. What about secondary liens. They have to be resolved also. Just paying taxes does not make it yours. Then taxes are assessed at the current rate not what was paid. If heirs were not all knowing about the property defaulting. A lot more than described. Trying to get something for cheap and easy. If it was so easy there would be no abandon properties.

So you just decided to take someone’s house. Such a kind soul you are. “What a blessing?” I’m sure the actual homeowners aren’t saying that.

The taxes hadn't been paid since 2005. The owner's don't want this property anymore. A lot of people just walk away from homes like this. You can go to any court house and find property like this in every town. The original owners are always contacted and given so many months "I don't remember how many " to pay these taxes and reclaim their property. Most don't. A lot of people purchase these homes just to flip for a profit. 😊

Where is the lawsuit evidence? Notice the sleeping bag and backpacks? Every State and local authority has different laws. I did not see any no trespass signs, but when they removed the boards to gain access, that was breaking and entering. Being prosecuted for it is another thing, the owner would have to push it.If they go in, make themselves at home, and start making improvements, it will be their loss if the owner/s decide to go in and clean them out.

You didn't say how to claim a vacant house? Like how do you learn of houses that are available and wh add t is the procedure to get title etc. Pay all cash only? Inspectors needed or you msy need to rewire and replumb. Seems dogs barking constantly could be indication of thoughtless neighbors. Checking crime hx of neighborhood w city police. It is not as simple as you let on.

gotta check your local laws on squatting rights I believe here you gotta squat and 10 years and show evidence you are improving and maintaining the place and if caught you can be evicted know a guy who done this he got evicted right before he was able to take ownership. till you take ownership your pretty much just providing free labor to the owner of the property

So she broke into the house to check it out . Since a person can not profit from a crime I am not sure how you can legally claim a house you broke into and you risk jail doing so . Not a choice I would be willing to make . You might as well squat .
