It's a lot simpler than people think. Include it in your descriptions and also in a separate file in your listing as a pdf. Explain your terms if that makes sense. That's the only way on Etsy unless you're selling on a marketplace that makes it clear for you

I’m having a hard time on how to price commercial use products. I do digital planners and lists/docs and let’s say that I have an intake sheet for animal shelters. Typically I charge a nominal amount for personal / educational use but let’s say the ASPCA approaches me and says hey! We want to use your intake sheets. How do you price something like that?

Nope that's the jist of it. If you don't include this information in your files people will just do whatever they want. Keep in mind this does require people to get caught in the act which is pretty difficult. However if you find someone is mass selling or producing your designs - you can have litigation with the individuals by showing these TOU and informations were in your listing description and files to ensure proper use. Does that make sense?

How would you know how many times someone uses your file?? Also, if you have a personal use file and allow print on bags, cups, etc for personal use, is that considered POD? or is it fine as a personal use. thank you!

You don't - there's no good way to track it which is why I don't bother with quantities. Print on demand is when someone uploads a product to a service and they handle everything else for you. Hopefully that helps

I have a svg design that is selling well, a customer called me and wanted to use it to print on demand, I don't have a problem giving it the license of course if we agree on the price, but I don't know what steps I should do on my etsy store?? When completing the purchase, what is the guarantee that I offer to the buyer?? Or do I ask him to buy a copy for personal use and work on it freely with an additional amount??? Please reply because the customer is waiting for my answer

You can add a listing in your Etsy shop for a Print on Demand license that would allow someone to buy one seat to one design and utilize it for POD hope that helps and sorry for the late response.

I noticed etsy sellers, sell their commercial licence separately from their other listings. What I'm curious about is what is in the file itself, the commercial licence. I imagine it's just terms of service, describing what the customer can do with file as you mentioned I the video? I also wonder if it would be a good idea to have the customer sign the document and include the name of their business, and email it back. Or if that's just overkill?

That's right. I honestly don't believe people will sign a document that's extra. Because the thing is it's really hard to catch someone using your files in the wrong way unless they're a big corporation. Which is why you want these documents in place. Hopefully that makes sense

Hi still very new to learning selling Cricut projects and buying svg’s. I’ve seen so many people use Disney etc. I learned in a video the other day you cannot sell any svg you buy so now I’m really worried as to buy svg’s. I believe everything in Cricut design space you can sell. But svg’s have to have a commercial license/limited or not as explained in video. I personally could never go against the rules as far as selling an svg that didn’t have commercial license as others do. However. If I were to sell an svg w limited commercial use how would you know if they sell over the limited amount ? And follow the rules ? Or sell for personal use and they’re making profit ?

Def document in a PDF you include in your items as well as put the licensing information in the description. If you're wanting to have someone purchase a commercial license, if say, you only offer personal use then you can add that as a listing in your shop based on your parameters. Hopefully that makes sense

Unfortunately I have seen many stores saying personal only and I saw seller selling products with the Svg , specially with Disney Svg but what are they going to do ? They don’t own the characters, many purchase the Svg and resell it I have seen it too many times, I would love to Learn how to creat Svg but I will have my design resold . Thankfully not a lot of people will break the rules. I do sweeps every now and again for my best selling work to find people utilizing my items for POD or whatever it may be. The Disney stuff (and other licensed charaters) is a trademark/copyright issue and those shops will get shut down eventually it's just a matter of time.

NO most sites just require you to follow their terms and in this case the license you include in your downloads is the same thing

I see some people who sell limited use commercial licenses separately from their actual listings. Do they do that because they expect most of their buyers to be for personal use only and they don't want to charge people buying it for personal use only more? What is the benefit of that? Since it is hard to regulate these things and most sellers aren't going to sue anyone, it seems strange that people would pay a lot for a license that seems to mean nothing since it does not come with the image.

I think it's more of a trust thing right. Most people craft for personal use and there is a decent percentage who specifically seek out commercial use content so they can create physical products to sell. It just entirely depends on the endgame.

Hi Keith great question. This totally depends on MANY factors. You can go about this in many ways. Do they know about how many they are going to sell? Are they wanting to use specific sets? Generally for Corporate use licenses I charge 6x the price but if it is for something like print on demand products, I do 8x my POD license. For example I may be selling ONE SVG for $4.00, the corporate use license would be $48.00. The POD add on may be $50.00 making the Corporate POd add on $500.00. The more expensive add ons do not require any modification of the graphics. Whereas the cheaper ones would for physical products mass produced. I'm not sure if this entirely answers your question, but if you're in the FB group and can share your work and more details we can help you through it!!

@keith favazza I did bad math and was looking at a different priced design hahaha sorry and thanks for calling me out! Should be 8x product price so $4.00 would be $32 however keep in mind that's with edits for commercial use With no edits it would be 8x the POD license price so in my case $50 POD single use entity and $500 corporate Seems like they're a small company so 8x may be a bit much. Ultimately it's what you feel comfortable with.

Have you ever also used vecteezy? if I change, mix graphics, creating new designs, can I sell it? as e.g. Christmas cards? and I understand that even if I create such a new pattern/desing (from the various graphics available there), I cannot attach it to any registered (by me or the client) brand? I did take a quick look at their license and there wasn't anything clear on using their items modifying them and reselling as digital. To be safe I would email support and show them an example to make sure it is safe based on the license you have acquired when your purchased the items.

@@ShootingStarSVG I meant physical Christmas cards. Not digital. I have their PRO version of subscription and according to what the support says, I can sell up to 100,000 items as end product. I talk to support but its hard to get precise answers... The next question is whether even if it turns out that we get an email about copyright infringement, what does it look like .. is there a lawsuit right away or is there a request to stop selling a given design first?

Absolutely. The profit margin on POD can be low so you may want to consider creating svgs and then providing a separate POD license. Either way you are building a second stream of income.

That is somewhat correct. You need to make sure the alterations you are doing are enough. I would definately refer you to the DB website where they talk about this. Their transformative guidelines are extremely useful

Hi everyone. I just got off the phone with the copyright office and am so confused. I will be selling digital mockups (images for other sellers to use in their shop). I was told I could copyright 750 images in a calendar year for $65. That's great, BUT, I would have to submit all of them at once. The problem with this is, lets say I only have 200 to submit, then I should be able to submit the other 550 images within the calendar year of 2022, right? Wrong, well kind of. I would have to pay the registration fee of $65 each time I submit additional images in that calendar year. That would become very costly because my designs requires updating and adding new trendy designs. Plus, I don't plan on taking 750 photos all at once. This is so disappointing. If anyone knows anything different, please let me know. I will post this to other KZbin videos and see if anyone can help. This just doesn't make sense to me.
