Why doesn't the US tax code define individual? How can you have an individual income tax when the law wont even tell us what an individual is?

I received cp 504 in 2012. This is for my late uncle IRA account. He died in 2010. I'm legal Administrator. How can I resolve this IRS issues. Please help me

The IRS only has 10 years to collect on a tax. So if the CP504 Notice of Intent to levy we can assume the clokc started running. So I wonder if your uncle tax bill still exists. We charge $1800 for an investigation, but you can file a Form 2848 on behalf of your uncle and call to see if the debt is still valid. Good luck!

I filed my taxes feb,6,2018 i received the cp504 notice feb,10,2018 i have more then enough to pay what i owe with my tax return will they take it out immediately

The problem is all the US courts look at the 16th Amendment as ratified. I used to believe the government's claim this was all a crazy conspiracy theories. B But you know what is a greater conspiracy theory? That the American people united and demanded to be subject of this tax code. I can think of no one who wants to be its subject yet here we are.

Thanks for your questions, Rich. The CP504 is sort of an annoying notice that bugs us a lot. Because if you don't respond, the IRS still have to issue a Final Notice of Intent to Levy (or equivalent) to levy or garnish you. And it is that Final Notice which gives you the right to appeal. Appeals is where we get our deals. So normally, if we represent someone we ignore the CP504. However the annoying part is after the IRS issues a CP504, they wait 30 days, they can file a Federal Notice of Tax Lien. When the lien is filed, THEN you get appeal rights. This is such a backwards situation, and should be an illegal process. The IRS should only be able to lien after a right to a hearing. So in cases where we think a lien might be issued after a CP504, we are going to look to see if there are other periods open for an appeals hearing, or in the alternative, submit an installment agreement request with reason why a lien should not be issued, or file an offer in compromise which tend to stop the liens from being filed while the offer is pending. Yes you petition the U.S. TAX COURT and pay $60 filing fee and assert what I posted earlier that TAXABLE YEARS ENDED AUGUST 16 1954 and you are NOT one or any of the people listed under 6331(a) AND therefore not eligible to be levied upon

I’ve got a CP504 from 2015 for 6 grand I own no assets and don’t work currently Why haven’t they intercepted my returns from 16/17/18 years ??

That is interesting. This is what we know. The IRS intentionally does NOT levy and lien delinquent taxpayers because if they did levy and lien everyone who owed taxes, that would create a huge amount of inbound calls to Automated Collection Services (ACS) that the IRS's reduced staff can not handle without 2 hour hold times -- the IRS will actually disconnect your call after 2 hours as a "Courtesy." One of the things the IRS is scored on is these hold times. So by governing enforced collections to what the IRS's system can handle, the IRS will score higher for "customer" service. Perhaps not intercepting your refund is a function of this? One of the great ironies is that even though the tax code has never been as expansive as it is now, there has never been a better time to owe money to the IRS. The IRS is to overwhelmed to handle it mandated enforced collection duties. The problem comes when your tax debt gets close to expiring. Then the IRS can turn quite aggressive and sometimes their prior leniency can feel like just enough rope to hang you.
