As a tax attorney, it is common for me to encounter people who didn’t do things correctly. And I recall this one time, I met a stone mason from Norwalk, Connecticut who confided with me that he hadn’t filed taxes since the Reagan administration.

How can this happen? How can someone not file taxes in 3 years, 5 years, 10 years, 20 years and in this case, 30 years?
The answer is easy. You’ll do it tomorrow. And after you’ve had about 10958 tomorrows that adds up to 30 years. Procrastination is incredibly easy to achieve, but sort of difficult to live with.
Will you go to prison for years of unfiled tax returns?
Anytime you are breaking federal law, you are really increasing your chances of prosecution. The US Department of Justice will prosecute those with unfiled returns, but the chances are that they won’t, unless you are doing something else or you are just too big of a fish to ignore.
Now a big fish isn’t necessarily that big of a fish. For the IRS, a press release is what they want. If you’ve made $100,000 for the last 10 years, and are unfiled, you are definitely getting into the area of a big fish - the IRS can truthfully say in a press release, you did not report over a million dollars of income. And for the average juror and the public at large, there is little difference between a million and a billion. Of course there’s a huge difference, a million is a thousand thousands, and a billion is a thousand millions. Regardless, the perception can be that you’ve been living the high life, all while not paying taxes nearly everyone else is paying.
But even if you do come under investigation, there is always something you can do to protect yourself. File your returns ASAP! I don’t understand this paralysis that comes over people once they are under criminal investigation. These should be the people working the hardest and quickest to get a problem behind them. But instead they are often advised to “sit back” and “wait” to see what happens.
Well I am pretty sure I know what could happen if you don’t fix a huge problem that you know that you can be indicted for. Hint: It rhymes with indictment. Wait. No. The word is indictment.
Why you SHOULD NOT File ALL Your Unfiled IRS Tax Returns. How many years should I go back?
You will see different answers to this question. Because here is the inherent tension. Filing fewer returns could create criminal or audit exposure, filing too many can slow down resolution and you can wind up paying more than you should have.
Some will give blanket rules, filing three, six, ten, or even back to the beginning. We look at each case one at a time. While the IRS’s policy is six years back, there are times when following this rule can create more problems than it solves. We’ve done more, we’ve done less. This is really an area where getting a professional opinion could save you a lot of money and headache.
Refunds rule benefit the IRS
If you don’t file a return, the IRS could assess you for those taxes at any time in the future. Our stone mason with that 1985 return? The IRS could file a SFR for him today! And would add in penalties and interest.
However, if you are owed a refund, you have a limited amount of time file a return to claim that refund. The general rule is that you must file your refund claim three years from when the return was due - extensions count, or two years since a payment that you seek a refund on. If you are a day late, you will likely be completely frustrated from claiming a refund. The US government will keep your money even though they know you can prove you are owed that money. 100%. The IRS can assess forever, but when you are owed money, you have a small window of opportunity. Does this sound fair?

I’ve never filed taxes. I have severe depression and any government interaction sends me spiraling into darkness. I work hourly jobs and they take my hard earned money out of my paychecks, I just let them. I never ask for anything back. I’m just grateful they allow me life at all.

Defending yourself against the IRS isn't fun at all. When you're fighting an organization that's demanding you follow a law that doesn't exist and then they tie your hands in court so you can't ask simple questions like, "Where's the law that you're saying I'm guilty of violating?". This is the number one question the tax courts will not allow you to ask along with many many other questions. They say these are frivolous arguments. That's what they always say when they can't honestly answer the questions without damaging their entire case. That's what's legally called a violation of your right to a fair trial and the right to defend yourself. So, they violate your rights in forcing you to file and pay and if you don't then they violate your rights to prevent you from defending yourself. This entire system that the IRS is using is legally called, conspiracy to commit fraud and everyone involved is guilty of racketeering. That goes from the tax lawyers to the IRS agents to the government officials standing behind it to the judges on the benches that do all they can to keep the truth from getting to the jurors so the whole thing sticks and keeps on going.

The answer is in your comment. The tax court is an administrative court (quadi court or inferior court). It ts like you calling someone into your home and charging the person for breaking your household rules. You will not win But if you say, whose rules are these and show me how consent to follow your house rules is how you deal with the IRS'S tax court.

You and most other people who make a serious error in judgment by consenting to participate in kangaroo court with anyone, let alone the IRS corporation. If a "lawsuit" is filed against you, you can refuse for cause and send it back. If they send it again, repeat. They really do require your consent. Furthermore, if the suit names YOUR NAME instead of Your Name, then you have no liability because YOUR NAME is not you...so why the F would you accept liability?

Get this. Last year, in 2020, the IRS estimates there were 9.5 million non-filers. 9.5 million???? That's MORE than the population of New England!!!! Other than making your life inconvenient, they have no power. Kind of a bad way to run a lousy organization don't you think? To solve this problem, I kid you not - the IRS' plan is to use AI. Yes. They intend to implement Artificial Intelligence over the rotted structure that is the IRS in order to improve their situation. Let's see how that works out.

American State National? That is a movement that leads to nowhere. If you are born in the United States, then you are a United States Citizen. You cannot be born in the United States and also be a Non-Resident Alien. Plus, Non-Resident Aliens are the subject of the Federal Income Tax per 26 USC 871 (a)(1) and 26 USC 1441, so there is no tax advantage for being a Non-Resident Alien.

Let's just get to the nitty gritty. You and I both know that income tax is only imposed upon people who live and have gave up their rights to voluntary pay taxes. In other words, collecting your hard earned dollars is a scheme and always will be a scheme. The IRS does not want anyone to know they have a right un volunteer. But, they are not going to tell you that. The system was design to take your hard earned dollars that you slaved for everyday to keep. If you were born in the United States, you had to be born in the District of Columbia, Guam, U.S. Virgin Islands, American Samoa, and of course Porta Rico. Anything outside of the United States, you are considered a non-resident alien. When you file a 1040 confessional form, you wave your 5th amendment rights. Also, when you sign your name, you are signing under penalties of perjury. That means you wave your rights. If you are hauled into court, the first thing they will do is use that form against you because you agreed to be a tax payer willingly. Attorneys will charge you thousands because they are in the money game as well. So, I say good for that person that has not filed in 30yrs. Be free ! How exciting is that. Keep your hard earned dollars. If you keep your money, you will have more to spend to help boost the economy. Ask yourself what benefits do you receive for paying an income tax? You are right. You have not received any.

The voluntariness of the income tax is something that is wildly misunderstood. The word "voluntary" was the IRS's own description of whether taxpayers complied or not. Yet, this internal phrase unfortunately made it out, muddying the waters -and yeah even a sitting US Senator, the Senate Majority Leader in fact, had no clue of what he was talking about. Now at Texas A&M, Prof Jack Manhire wrote a brilliant article explaining how this mythology started. www.irsmedic.com/blog/2015/05/irs-voluntary-compliance.html In your last paragraph, I think you hit on something very important. When you sign that return you are signing that you understood all of the tax code, the IRS regulations and forms. Of course this is impossible. No one in the world understands or knows all there is to know about US tax law. No one. Additionally, your compliance is a non-delegable duty. So the fact that you had to rely on someone handle your taxes for you is not a solid defense. If this was the private sector, a tax return would be considered voidable as it is absolutely an adhesion contract. But the government covets your money so bad it is not at all bashful about being monstrously unfair.

@@irsmedic There's a lot of weasel words in there. I'm not saying you shouldn't comply, but let's not justify government criminality which only appeals to the the logical fallacy that might makes right. A direct tax imposed by the Federal Government is unconstitutional and the 16th Amendment wasn't properly ratified. Slaves were taxed at 100% because "Massa said so." So, because the Federal Government says we have to be 30% or 40% a slave because they "passed" an unconstitutional law, that makes them correct? Or slaveowners? Irwin Schiff was correct, that's why they killed him.

The federal government decides what the federal government can do. And imagine that, there are few bounds on the government. The constitution becomes more symbolic than the thing that was ratified in 1789.

Thanks for your time brother. One question, me and my fiance have 2 kids and niether of us have filed since 2016 because we changed tax lady one year and i finally got audited. My kids have a different last name and It finally caught up. My fiance is delinquent on school loans is why I always claimed them. My question is should she file 2016,17,18 and 19 now because I heard covid19 is causing the Irs not to hold any funds for people in her a situation. Do you Think that would apply for all past year's? Should we just try maybe 2018 or 2019 first and see what happens? She usually ends up with $5000 to $6000 when she files. Thanks In advance man

I am a bartender so, I just allow the Government to keep the taxed income on my small paychecks. I file maybe every 5 years. They never come after me they just keep what they have already taken. Sometimes they will give me a few bucks but the good part is that they have no idea of how much I get in tips Because people extra tip me all of the time and I never claim it!!! Screw the IRS, they have tax problems themselves.

If you are small time player you can get away with not filing taxes quite easily. The question is how small do you want to be and for how long? If you do meet a special someone, they may want something that requires financing. And the financing may require income verification which you are unable to provide. For some, the cost of not paying taxes can cost everything. Or maybe you have everything you need already. If so, we are happy for you.

If you are married with 1+ children, you probably do not owe any tax. You are required to file if you have self-employment income over $400/year, or your income exceeds your standard deduction. This results in many people "having to file" even though they don't owe any tax. I bet the IRS will punish such people only when it gets super vindictive.

@Sir Caveman Not "real" income, but wages and self-employment profits. What you wrote applies mainly to people who are mostly or entirely self-employed. FICA and Medicare taxes are invariably taken out of all wages. I bet your friend the waitress qualifies for SSI. If you are married with one child and claim the standard deduction for married couples, you will own no Federal income tax on the first US$45K/year of wage income by you and your spouse.

@Sir Caveman What are the starting and ending years of her career as a waitress? Did she work full time for the waitress's minimum wage? If your SS benefit leaves you below the poverty line, Medicaid pays the cost of Medicare Parts B and D, and the cost of private Medigap insurance.

THERE IS NO LAW IN EXISTENCE THAT REQUIRES THE AVERAGE AMERICAN TO FILE OR PAY INCOME TAX. Federal Income Tax applies to non resident aliens living and working in the United States and American citizens living and working abroad. The reason no law exists is because under the Bill of Rights, it is an unalienable right to earn a wage/ living and the U S Supreme Court has ruled that rights cannot be licensed or taxed. It is also an unalienable right to not be forced into a contract of which filing a return is contracting. Threats of fines, interest, and jail for " willful failure to file " is Coercion which is a Felony under Code of Federal Regulations Title 42 subsection 3617. Anyone who violates an individual's unalienable rights while acting under color of law is committing a felony under Deprivation of Rights-- U S Code section 242 of Title 18. Research U S Court Case Loyd Long vs IRS. Also , KZbin search " Ex IRS agents testify that no law exists requiring Americans to file or pay income tax ".

Are US Employers authorized to be a withholding agent? I see in 26 USC 7701(a)(16) the definition of withholding agent. what are the sections associated with this definition.

Jason -- you need to file your taxes to claim the refunds you are entitled to. The IRS does not calculate refunds for you. You must file. You have a limited amount of time to do so. The expiration for a 2015 refund is coming up this year. Please don't let the government keep your money! They get enough.

I have a question about tax. I filed my tax return last year online and I owed the IRS some money but I didn't have money to pay them because I got laid off from work. Will they come after me with the money I owed them last year up to date with the interest be adding up from last year when I filed my tax until today?

Your interest and penalties will be calculated from the date you should have had everything paid by - on April 15th. If you get into a repayent plan, be sure to ask for first time penaltiy abatement. They IRS won't tell you about, but they will grant it and it sounds like you qualify. We hop your job search is going well!

love the Talk... bravo. my situation is im sending out over 30 people 1099 every year. 10 % of the guys are filing . The rest manic to float under the radar. Im scared ..... none of the agents 1099 would go on payroll because they are agents for hire. 4 days 12 days or maybe the 100 days of work I give them as a traveling sales rep on commission. How do I protect myself and my cooperation.?.

The collections statute isn't locked in at 10 years. If you file a fraudulent return, the collections statute doesn't apply. If you don't file returns, the collection statute won't protect you because the statute doesn't start until IRS does an assessment for the returns you never filed. Even if it's the last day for IRS to make an assessment, IRS will be staying past the deadline to make sure no statutes are blown.

I know someone who hasn’t filed since for the year of 1992. He got threatening letters in 1996-1997 saying the next letter would be a court date in front of a judge,, which he never got. Then Congress told the IRS to dial it back and he didn’t hear from them for years. He finally called them and said here I am I’m sorry my life has been a disaster. He was diagnosed with major PTSD in 1996 and Lyme disease in 2013. He figured out he got Lyme back in the early 80’d. He’s talked to multiple attorneys, one which told him that the IRS has programs to eliminate fines and penalties for genuine health problems. He hasn’t made a lot of money over all of these years. He has good credit and no criminal record. A few lawyers who he has talked to quote him tens of thousands of dollars to deal with it. His mom’s accountant told him that she thinks she could handle going back about 6-7 years and not have to charge him much more than the standard rates per year of filings. He’s been in a major battle with Lyme disease which was about to kill him in 2015. He’s missed work because of the Lyme disease. Most health insurance companies cover little to nothing related to treating chronic Lyme disease so he hasn’t had health insurance for over 10 years and he pays cash to see a specialist for Lyme disease. Plus he pays cash for the medicines to keep him alive. His family knows his tax and health situation and does between little and nothing to help him.

The man didn't pay an income tax for 30 years and was hiding because he didn't understand that he wasn't required to do so anyway. For a tax attorney to talk about getting your act together and not procrastinate is puzzling. Is it that this attorney doesn't really understand the laws and is ignorantly going along with the system or is it that he does understand and know there is NO law anywhere requiring a regular US citizen to file and pay a tax on their non-federal income. I challenge this tax attorney to post a reply showing us that law because I'd love to finally see it in black and white after 17 years of researching and being unsuccessful at finding it. The IRS won't show it to me, they give me lower court cases and threats. Tax companies like USA Tax, Liberty Tax, and 3 others have been unable to show me the law. 4 tax attorneys have agreed with me on every point and admitted that there is no law requiring us to file and pay a tax on our income. All of them with almost a word for word response was, "What are you going to do, fight the IRS?" This scam being perpetrated upon the American people needs to come to an end. They need to show the law or get out of our pocketbooks. I know the IRS Medic will not show the law because I know they know there is no law requiring it. I'm not arguing the government's power to tax us, that's an entirely different argument. But, even if they do have the power, there still must be a law requiring us to do so. The fact is they have neither the power or a law yet the masses still run to file and pay by April 15th. It's not a matter of being voluntary or not either. It's simply not anywhere in the codes telling any of us to do so. Please don't be so lazy and respond with some snotty quip. Find the law and show it or remain silent to prevent everyone from seeing your ignorance.

If so, then you are funny and I think we should be friends. But if you are not eight, but rather, a grown adult, then it is hard not to think about how tedious this all is. If I was going to invent a game of pretend, I would seriously pretend something a lot more fun than pretending the tax code, which I do despise, is not there. Wouldn't it be more fun to pretend that we could tax the IRS? You know. Make them fill out forms. Give them a hard time when they try to pay us. Make them hold for two hours and then when they get to us we hang up. Wipe out their bank accounts. Oh then we get to tell them about the IRS Employees' Bill of Rights and how wonderfully inoperative it is. We have such complicated instructions that they are forced to hire expensive attorneys to represent them. Basically we torture them so much, that the IRS begins to beg for a limited government.

My friend is not paying her taxes for 16 years.. still get her financial support for COVID 19 here in Japan.. she hired a professional tax accountant without paying him because she was a member of the community of the owners small businesses.. no penalties.. but still get 2,000,000 yen?! I call BS on that - living a simple life with no assets can be quite enjoyable - its a matter of mindset. If you consider taxation is theft then not paying them is an honorable thing to do. A life of simple assets CAN be quite enjoyable. It is completely possible to avoid taxation and get away with it. But again at what cost? 30 years is a long time to lay low, and perhaps miss out on things others are enjoying. Working hard and not being able to put your name on anything? Could there be a better way to fight this kleptocracy than non-compliance? I hope so. But step one is educated a fairly and perhaps intentional ignorant public about what the income tax really is.

I haven't filed a 1040 since 1993 and I'm fine. This guy, like most lawyers is an officer of the court. His first allegiance is to the courts. He makes it sound like a crime not to file. Show me the federal statute, and implementing regulation that requires me to give the feds information that they can use against me criminally, via a 1040 tax return. Income taxes are BIG BUSINESS for the irs, the legal community, as well as cpa's.

Now I have liens and am stuck with a home I can not sell or refinance. So yes, "filing" is the same as voluntary compliance/consenting to the Theft.

So get this. There is allegedly a law at Title 26. But you'll find something interesting. Nowhere in the "law" is "individual" defined. Rather the regulations define what an individual is. So the statement "There is no individual income tax law in America" is rated as 100% correct. There are merely individual income tax regulations.

After reading the responses below one must wonder why is there so much confusion into this conversation. Perhaps becomes we all take extracts of some 72,000 pages of tax laws and/or regulations in proving a micro-point instead of concentrating on a macro-strategy. Hello, I am considered a Qualified Tax Expert (QTE) and licensed by the U.S. Department of Treasury since 2011. As a tax pro, every day stumble upon tax information making me feel like a dilettante when applying the facts and circumstances to every tax case worked by me. I confirm with the IRS Medic, no one person know all about the many facets of taxation in America. However, this is a very good video with some valid points made in getting people to be active and considered about their tax system. As stated by Shawn below, one may find some very good points that should be directed to the U.S. Congress and stop killing the messenger. Remember, the powers to collect by the IRS comes directly, and/or indirectly from the U.S. Congress. So, stay focused! Do you truly believe that any government would survive without a way to collect funds from its citizens in supporting pension for its retired persons? Think about our roads and other infrastructural components; who do you know would volunteer to pay for our vast interstate systems connecting the major cities? Who amongst you would pay retirement pension for a person not contributing to the tax system? Again, I believe this is a good discussion that should be had before the U.S. Congress up to The SUPREME COURT. As a tax pro, I have heard similar concerns about unfair taxes but we began to blur the lines and make exceptions as to why now to move forward. So, I say, if you feel adamant about you tax belief then consider building a new mousetrap so the unintended consequences don't cause harm to those unable to fend for themselves. Surely, the Internal Revenue Service (IRS) to this date used its power, again authorized by the U.S. Congress, in a aggressive fashion thereby placing many taxpayers at odds of the laws of the land. However, before going down this path of overthrowing the IRS, simply ask yourself these questions: 1. After the overthrow, how would you manage and fund the various agencies relying upon monies otherwise raised by the IRS; 2. Why do you think Russia, China, and many other countries rely upon the USA as a model for successful tax administrations? 3) Could you explain to current and future readers how you plan could best benefit our country as a whole? BTW, thanks to US, developed and some emerging countries already have high-speed train services and interstate highways with few potholes even during the winters. Finally, President Donald Trump always hated the IRS...I though he would do something more as the leader of the free-world in regards to taxation and outlaw the IRS. Well, the reality is harder than any of us may ever image. Let's stop jumping before we leap causing others to leap after us. President Trump, has the best seat in the House; he passed the New Tax Reform Laws of 2018 and got the downsizing of the IRS. In essence, as I understands did take some of the powers from the IRS and give self-employed and small businesses some additional avenues if jobs are created for Americans. Of course, part of his international tax plan gives me concerns on a personal level - but he may be correct in this instance regarding proper taxation! Regardless, the greatest insider in changing or improving on tax system is the decision-maker of the free World is likely on your side in this matter. So, perhaps it is best to speak with him and stop killing the messengers! Disclaimer: I am not an attorney, CPA, nor economist supporting the policies of the current Administration. I am only a licensed enrolled agent with a M.B.A. coming across this wonder video by IRS Medic. OK but. You aren't breaking federal law. I will repeat this. The W-2 Form you are requested if not Demanded to sign is for you to agree. AGREE to pay the IRS taxes. You can refuse. You as a Business OWNER must pay your Taxes. NO WHERE in the agreement does it say EMPLOYEES and customers must pay taxes. They aren't owners.

The government is the least efficient entity. Roads are already made by private companies in most places so why do we need to lose so much money into handing it to multiple entities. Unless you get taxed half of your what you earn like in Germany the infrastructure can't be good. And why would you want to be taxed half of your income?

I bet there is no problem if you do not file in years where you owe nothing. Especially if your AGI is less than the minimum AGI the Code sets for being required to file a return. A competent tax CPA or attorney should be able to achieve much for the remaining years. The IRS wants tax deadbeats on the job paying what they owe in installments, and not in some Federal pen earning nothing. X did not disclose his foreign investment income to the IRS for 20 years. He came clean to a CPA specialising in such matters, who advised him to file amended returns for the previous 7 years. The CPA correctly predicted that the IRS would charge interest, but wave penalties. In 2 of the 7 years, no tax was owed, thanks to the GFC. The rate of interest was unpleasantly high, but the total tax bill was still affordable. The IRS never mentioned the years preceding the 7 years owed up to. Had it done so, the total owed with interest would have been on the order of a half million. The only easy way X could raise a sum like that would have been to cash out X's entire Roth IRA.

Instead, if they demand something from you just reply to them and have the IRS prove their claim that you have any obligation to them by conditionally accepting their claim. Keep in mind that if you filed in the past and do not first mail an affidavit of rescission (of your signature and contract from all previous filings) then they have a strong presumption you are a "taxpayer" and will come after you as such.

No Dr. Chaos! I've changed! I've changed!!! I DETEST IRS PUPPETS OF WHICH THERE ARE MANY. I need viewers like you. This video is one I created when our government wasn't in open revolt against the American people. When I produced this video I actually still believed the 9/11 commission report! You can watch my evolution on my channel as I swallow red pill after red pill over the past 15 years. Yesterday I called out the tax code as being implemented by CIA assets! I was there at Congress and I witnessed the entire bizarre encounter when the claimed author of a tax bill didn't understand what was in her own bill.
