How to Prove Mobile Recording in the Court ?

Recording the voice/video communications have become necessary particularly where the proving of the facts in relation to the disputes whether commercial, personal or legal etc. The various issues as to the admissibility, authenticity, veracity or reliability arises and it has been seen in various cases that in absence of proper presentation, the best of evidence fails in the court. The issues which arises as to in what circumstances these voice/video recordings are admissible, whether original mobile phone is required to be preserved, retained or produced in the court of law.

Sir Please clarify When two persons working in an organization (armed force) are having conversations and WhatsApp chat relating to corruption- giving & accepting money. The vigilance department gets tip of such illegal activity. Now both are mobile phones were seized by the vigilance department and mobile phones are sent to Forensic lab for conversion. It is a matter of interpretation by the court taking into consideration all the relevant facts. It is very difficult to draw an inference as to the intention in absence of any evidence contrary to the facts.

sir, your class on sec 65b is very much enlighting about electronic evidences.Here is a doubt in a case. Husband left the home deserting the family. wife found some photos and vedio clips in his laptop, showing the unwanted intimacy of her husband with a lady working under him . She has teken those photos and vedio clips into a pendrive. Later her husband has taken away that laptop and didn't come back to home. she has up-loaded those photos and vedio clips into her personal laptop which was purchased latter. Now in support of her claim that her husband is having some unwanted intimacy with that lady ,she has given the CD with the photos and vedio clips, which are taken from her laptop(which are uploaded from pendrive to laptop).Present doubt is that the photos and vedio clips which are in that laptop are considered as primary evidence or not.

It is a primary evidence subject to expert opinion. Her husband would say before court that the video clips and photos are morphed. Then how will you prove it? For that you have to go to s- 45 of evidence act. This video clips and photos are to be sent to labs for test. The lab may give you a report that they are genuine. But it is not useful for you until the office concubine gives her photo and her naked video for comparison with the ones you filed before court. Will that lady agree for that?
