Agency and client jointly and severally liable for unpaid wages If the client doesn’t pay, the agency still must pay. If the agency doesn’t pay, the client will have to pay. Prohibitions on charging fees to clients and restricting clients from hiring assignment employees A temporary help agency is not allowed to charge a fee to a client for directly hiring an agency's assignment employee after six months of the assignment for that client; An agency is not allowed to restrict a client from entering into a direct employment relationship with an assignment employee. A temporary help agency is not allowed to stop its client(s) from providing a job reference for an assignment employee. Terms of a contract or an agreement (whether or not in writing) that impose any of the above fees or restrictions are void. So what is required to start and successfully operate your employment agency? 1. Incorporate a corporation (either Federal or provincial), and prepare a complete set of the corporate documents - Minutes Book. 2. Register your business with WSIB - mandatorily required for the employment/staffing agencies. 3. Prepare the legal documents that are mandatory for the operations of the employment/staffing agency: a. Agreement with the clients for supply of workers b. Agreement with your workers - employment/assignment agreement c. Employment location form - required by the Ministry of Labour d. Assignment form - required by the Ministry of Labour 4. You will also have to provide the poster ‘Know your rights’ published by the ministry to each of your employees. Calculation of the costs for the price negotiations: Hourly rate agreed with a worker + Vacation pay - 4% Stat Holiday pay ~ 4% CPP - 5.45% EI - 2.212% WSIB Premiums 2% - 8% Total cost of the employment - wages of the worker + 30% (at least). Based on what I see from many of my other employees - it involves a lot of leg-work and cold calling. Finding employers will require you to get out, see what they need and come with a competitive offer. There is unfortunately no magic shortcut to this....

How do the agencies get clients? Just cold calling different businesses asking to arrange a meeting? Giving business cards? Should we get clients with available jobs first or do we focus on recruiting as many people as possible to build up a wide range of talent pool? Neko, overall, yes, you can start a business without an actual office. The only requirement that it is a physical address for the registration. From the business perspective, I am less involved in, but overall yes - all means are suitable - cold calling, emails, business cards, appointments and more.

@@rpsherwood Ryan, with commercial insurance the system in Canada works a bit different. The insurers do not communicate with you directly. You should find an insurance broker who will do the market search for you and will come with 2-3 alternatives for you to review and consider. Alyssa, yes - the agency is considered as the employer of its workers, therefore it's liable for whatever happens to them. This is why I always suggest to incorporate staffing operations.

Hi Speedy, the rules vary from one province to another, so the answer depends on where you are located, and this is the reason for confusion. 25K and a license requirements are effective in Alberta or BC, but there is no such requirement in Ontario.

I was under the impression that if I give you proper training and I give you a contract for a client. The client is responsible for liabilities because as soon as I’m on your property your insurance should be liable.

Jamal, yes, actually there is no requirement for a minimum capital investment, so you can incorporate with $100 investment only. The cost of incorporation is roughly $2,000, all the rest you can increase as you move forward.
