Agency and client jointly and severally liable for unpaid wages If the client doesn’t pay, the agency still must pay. If the agency doesn’t pay, the client will have to pay. Prohibitions on charging fees to clients and restricting clients from hiring assignment employees A temporary help agency is not allowed to charge a fee to a client for directly hiring an agency's assignment employee after six months of the assignment for that client; An agency is not allowed to restrict a client from entering into a direct employment relationship with an assignment employee. A temporary help agency is not allowed to stop its client(s) from providing a job reference for an assignment employee. Terms of a contract or an agreement (whether or not in writing) that impose any of the above fees or restrictions are void. So what is required to start and successfully operate your employment agency? 1. Incorporate a corporation (either Federal or provincial), and prepare a complete set of the corporate documents - Minutes Book. 2. Register your business with WSIB - mandatorily required for the employment/staffing agencies. 3. Prepare the legal documents that are mandatory for the operations of the employment/staffing agency: a. Agreement with the clients for supply of workers b. Agreement with your workers - employment/assignment agreement c. Employment location form - required by the Ministry of Labour d. Assignment form - required by the Ministry of Labour 4. You will also have to provide the poster ‘Know your rights’ published by the ministry to each of your employees. Calculation of the costs for the price negotiations: Hourly rate agreed with a worker + Vacation pay - 4% Stat Holiday pay ~ 4% CPP - 5.45% EI - 2.212% WSIB Premiums 2% - 8% Total cost of the employment - wages of the worker + 30% (at least). I'm pretty sure on January 1, 2024, the Act will be amended by the Lieutenant Governor, No person shall operate as a temporary help agency unless the person holds a licence for that purpose

Thank you Swati, I will prepare something. There are significantly less complications with recruiting rather than staffing, but i will discuss those applicable to the recruiting.

Based on what I see from many of my other employees - it involves a lot of leg-work and cold calling. Finding employers will require you to get out, see what they need and come with a competitive offer. There is unfortunately no magic shortcut to this....

Thank you so much! In the case of a Staffing company that hires foreign workers that will remain in their country and work remotely, do they get the same laws applicable? Or would it be the laws of the country they're in? Also, how is that process of a Canadian company hiring foreing workers to work remotely? (Not freelancers, full time employees)

Thank you for this great video. So if I find a client which is ready to provide good wages and ready to comply with all the rules, I can hire workers immediately? i mean no need for any kind of license ( i know you already said it but its a little complex). And what about paying my employees, how do I make cheques for them? Do i need any kind of license to do that? And if I am an international student (currently on work permit) am I eligible to do this?

Thank you so much for the informative video!!! Would love to hear about recruitment agencies as well. I would love to start one of the two but it seems so overwhelming... How do the agencies get clients? Just cold calling different businesses asking to arrange a meeting? Giving business cards? Should we get clients with available jobs first or do we focus on recruiting as many people as possible to build up a wide range of talent pool? Lastly, can all of this be done without an actual office? To start at least? Thank you so much for your help!!! I have an Advanced Diploma in HR and Business Administration and I'm tired of working for others... I want to be my own boss and retain all of the profits myself.

Neko, overall, yes, you can start a business without an actual office. The only requirement that it is a physical address for the registration. From the business perspective, I am less involved in, but overall yes - all means are suitable - cold calling, emails, business cards, appointments and more.

@@rpsherwood Ryan, with commercial insurance the system in Canada works a bit different. The insurers do not communicate with you directly. You should find an insurance broker who will do the market search for you and will come with 2-3 alternatives for you to review and consider. If needed, please let me know and I will refer you to one of my connections.

Hi, i have registered my staffing agency and i am about to start soon. I have completed everything (all papers) for client and jobseekers. Just need to know that do staffing agency charge (HST) to the client (Employer)? If yes then how much we have to charge (HST) to clients? Please reply me i am so confuse about this issue.

Sajid, HST is always the same in each province. In Ontario it would be 13%. In order to be completely sure, you can simply call CRA and verify 18009595525

@@sajidnaseem7666 Sajid. you charge HST with each of your invoices - for the services that you have provided, so whether a client can terminate the agreement or not does not matter at all. Alyssa, yes - the agency is considered as the employer of its workers, therefore it's liable for whatever happens to them. This is why I always suggest to incorporate staffing operations.

How come my nursing agency/client can cancel my assignment last minute without paying me pay in lieu of notice? I also believe in our contract it says that I can't get directly hired by the client when I am still working for the agency and also I can't be hired by the client immediately after my termination of employment with the agency.

Great video. When it comes to a recruitment agency I guess anyone also does not need to be licensed? Also, what about a special $25,000 deposit for those who recruit international staff? I've heard something about it, but can't find either the confirmation or firm refutation. Thanks in advance!

Hi Speedy, the rules vary from one province to another, so the answer depends on where you are located, and this is the reason for confusion. 25K and a license requirements are effective in Alberta or BC, but there is no such requirement in Ontario.

I was under the impression that if I give you proper training and I give you a contract for a client. The client is responsible for liabilities because as soon as I’m on your property your insurance should be liable.

Sunny, this sounds right from a simple logical perspective. The problem is that with staffing agencies, there is an express law that extends the liabilities to both the employer (staffer) and the client for whom the work is performed.

Jamal, yes, actually there is no requirement for a minimum capital investment, so you can incorporate with $100 investment only. The cost of incorporation is roughly $2,000, all the rest you can increase as you move forward.

99% of the cases - yes. There are few services (medical for example) which are exempt from HST, all others are mandatory to charge HST after you reach 30K sales (revenues).
