Not a student learning at law school, but this was super helpful for writing stories with courtroom scenes in it. Also had a D&D session where I had to defend my comrade that was accused guilty for murder. I'm super grateful for this detailed video!

Hello, sir, may I have the name of the case where Lord Denning said general denial don't work?
@GKganesan3 жыл бұрын
Warner v. Sampson & Anor. [1959] 1 All ER 120 where Lord Denning at p. 123 discussed that general traverse. He concluded that the general denial, "does no more than put the plaintiff to prove" - which meant that the onus of proof had thus shifted to the other party making it encumbent upon the latter to re-shift that burden. Followed widely in Malaysian cases e.g. LEONG SING v. PERUSAHAAN KUARI (MELAKA PINDAH) SDN. BHD. & ANOTHER CASE [1997] 1 CLJ 307 HIGH COURT MALAYA, MELAKA SURIYADI HALIM OMAR J
