Sinking funds to be used for major repairs of building. Especially to repair major leakages, repairs as per structural audit report etc. If society wall tile fixing is coming under this, you may take general body meeting approval for this.

Mam, I am the Secretary of my society & In our society Mr.Francies ( who is a bonefide member ) had made and submitted his nomination giving his wife 50% and his two daughters 25% each. But now Mr.Francies has expired and I have been told that the percentage in the nomination form does not count legally. The rights on the flat will be shared equal to all three person. Please guide me out.... Thanks

Hello Mr. Pillai. If Mr. Francis was already mentioned % in the nomination form and it was approved in the Managing Committee then you can't deny this. As this was the members decision about % of his /her shares. Secondly now society should take all docs as per Bye Laws to transfer this flat as per nomination of Mr. Francis.

No. The owner of the flat cannot add own name as a nominee. He or she can add family members name as nominee.

Nomination form are in original, duplicate and triplicate. When submitted to society, they keep the original and return the duplicate but who keeps the triplicate copy ? society or it’s to be given to the owner back along with the duplicate ?

Nominee means a person who is responsible for proper transfer. In case he or she is the legal heir of the member, then also he need to complete some documentation after death of the member. It's not transferred directly

Yes. As nominee you can keep any one outside blood relation. But after death of that particular member only legal heirs have a right on the said flat. In case member wants to give rights outside of family person, then he or she may go through Gift deed option

If your wife was second holder as per agreement,then she was 50% holder of the said flat. Now first you have to submit request letter along the reqd docs to your society to transfer whole shares on your individual name and after completion of this process you can fill nomination form for your 100% shares.

नमस्कार दीदी🙏🏻 अगर फ्लैट पर होम लोन चालू है। और वह फ्लैट और होम लोन मां और बेटे के नाम पर है। और मां फर्स्ट ओनर है। और मां का देहांत हो गया है। इस केस में नॉमिनी फॉर्म पहले भरा होगा तो लोन क्लोज करते वक्त बैंक ओरिजनल डॉक्यूमेंट वापस देगा क्या? और अगर नॉमिनी फॉर्म नही भरा था तो होम लोन क्लोज करते समय बैंक ओरिजनल डॉक्यूमेंट कैसे वापस देगा? उसकी क्या प्रक्रिया है? कृपया दोनों केस के बारे में मार्गदर्शन कीजिए। धन्यवाद!

@@shivconsultancy धन्यवाद उत्तर देने के लिए। नॉमिनेशन फॉर्म भरा नही है। लोन का EMI उनका बेटा ही भर रहा है जब से होम लोन शुरू हुवा है। अभी फ्लैट उन्हें बेचना है और लोन क्लोज करके ओरिजनल डॉक्यूमेंट बैंक से रिटर्न लेना है।
