Your doctor’s recommendation of surgery marks a turning point in your Georgia workers’ compensation case. Your employer and their insurance company put a great deal of pressure on posted panel doctors not to order a surgery - besides the cost of an operation, there are many other possible costs associated with a surgery - complications, infections, poor results, and long rehabilitation are just a few.
Insurance companies do not like unknowns so many times, the insurance company in your case may be open to a reasonable settlement before you undergo a surgical procedure.
Obviously, your health and future well being are a lot more important to me than an insurance company’s balance sheet. As I discuss in this video, I encourage my clients to consider all the consequences of undergoing surgery vs. postponing or refusing surgery and looking to settle.
While the question of whether or not to undergo surgery is a medical issue, strategy discussions about how to proceed should be limited to you and your lawyer. Everything you tell your doctor becomes part of the medical record and those medical records will be supplied to the insurance company.
Because workers’ compensation doctors and insurance adjusters may not have your best interest at heart, you must remain diligent and careful in talking about how you intend to proceed.
