I wasn’t given light duty. I worked through injury until I was fired. My life has been hell ever since. Day to day harrassment with out rages noises in front of home. People mocking my situation as I recover from 3 surgeries 11 injections and constant rehab, by placing baby pampers boxes in front of my home a bed 🛌 with lamp and chair placed on the street outside my home. Hate texts n word and voicemails. My life in Beacon NY

Marc, this sounds like your case is an extreme case. I am sorry you are going through this torture. I hope you have counsel to help you through this difficult time. Remember, the horrible things you are experiencing will not last forever. Your injuries they are roadblocks to doing the things you used to could do. There are always other ways. I hope your recovery gets better and I hope that some day soon you can look back and say, that was a tough time but I made it and it has shown me I can push through difficult times. My employer coerced my doctor to send me back light duty. This was done two weeks after seeing my doctor, who kept me off, ordered more PT and wanted to send me to a specialist. Crazy

Okay I've been on my second workman comp case regarding my pain and suffering at work. I've been doing the same position for 16 years working in the mailroom with my hands shoulders neck fingers. I reported again that my fingers and thumbs are having nerve issues along with my arms up to my shoulders. I finally got to go to a different workman's comp doctor and after a month and a half he said basically I could have surgery on my shoulder but probably wouldn't help because of my age and more than likely a lot of arthritis. But I know I have a rotator cuff problem because of my first workman comp doctor. They put me back to light duty at work for now but they still want me to do my normal job when I go there to work. I've been working with this private sector for 28 years giving them the best years of my life but I'm so afraid I'll lose everything. I don't know what to do

Ms. Johnson, first of all, I am sorry you got injured and are in pain. Sometimes a surgery will not bring you back to 100%. But sometimes any improvement beats what you are living with now. My work comp Dr sent me back to work, light duty, with the most ridiculous restrictions: No lifting, pulling more than 5 lbs. no driving, no sitting or standing for more than 10 minutes. I returned to the Dr the next day and asked him to change it but he wouldn’t

I am sorry to hear that. That is pretty light duty. Keep a copy of your restrictions with you if they return you to work. If they can not accommodate those restrictions they will need to start paying you weekly benefits if you are in Georgia. It would be hard to accommodate so maybe the doctor did you a favor. The insurance companies put an enormous amount of pressure on the doctors to release you to some form of work.

@@TyWilsonLaw why does worker’s compensation insurance apply pressure with doctor’s to send injured employees back to work? My cornea transplant surgery has been delayed four times and my inured eye is in greater pain. The doctor appointed by worker’s comp refused to allow me to be relieved from work. I am appalled by his decision. I refused to go to work until two weeks after my surgery. But the surgery has been postponed four times already. So only God knows when. Frustrating. I just retained a worker’s comp lawyer yesterday.

@@Inkironnrum I am sorry to hear about your struggles. You have two different companies on the other side. You have the Employer who pays for workers' compensation insurance. Then you have the workers' compensation insurance company. When a worker gets hurt, it is the employers job to notify the insurance company and they take over from there. Often times the employer does not know what is going on and is told what to do by the insurance company. The insurance company controls the employer through premiums and the threat of paying more wc insurance coverage. When someone gets hurt on the job and is taken out of work, from that point the injured working is typically then receiving income benefits from the WC insurance company not the employer. So when the insurance company is paying benefits, they want the work to return to work as quickly as possible. They will do what they can to motivate/convince/strong arm the doctors to release the injured worker back to some form of light duty. Then the WC ins will go to the employer and say create a job or make a job to get this injured worker back or we will raise your premiums or drop you. The point is to stop paying the money if possible. That is usually how it plays out, but not in all cases. Sometimes you have a doctor that believes everyone can work unless they are just after a surgery. There are many moving parts in a workers' compensation claim. I am only speaking about Georgia, but must states are similar in nature. I am glad you got counsel and wish you luck moving forward. Ty

I recently began the process, unfortunately light duty for me was to not lift or move anything heavier than 5lbs. Well I unload packages for 4-5 hours straight no breaks. I was 3 weeks into my new job and received 2 weeks of aches and pains in my wrist and as time went on the pain is severely impacting my daily functions like opening a sprite bottle, severe pain turning on my gas stove and the rehab treatment said I can't get a separate X-ray for my elbow because the elbow wasn't mentioned in the injury report. The light work was too repetitive and very fast pace the slightest use and over use of my right hand and arm creates the most bone aching, stuck, tin man feeling that lasts for hours and even hard to get a good nights rest. It's my dominant arm. I haven't been able to go back to work because there were no positions they could move me too at the time. Im financially paycheck to paycheck and don't know what to do ? I need money to survive. My car engine just went out on me earlier this week. I'm taking it one day at a time but definitely feel I need legal advice. I'm going to reach out today. I'm on workers comp and my job keeps calling me telling me I'm on schedule but the Dr hasn't released me yet and they are getting mad like I told the last week I have a appointment on the 9th to see what what he says but he still wants a MRI so today is the 9th and my job called me again to tell me I'm on schedule and trying to tell me how do I feel all I said was the Dr hasn't released me yet I'm a CNA

My lawyer pushing me to search for a job on my SSD Disability. He did requested Jude to give me permanent Disability, crazy i got 75%. So my lawyer made my case all the way down. So I am not going to looking for a job because I am ill, my DR MD she is even MD not Works Comp Doctor to do so on my behalf, she is Regular Doctor hard to get these Doctors to get you on benefits, so now MY LAWYER SELLS MY CASE, but I have strong case. However my question is: Can I close this case or find someone else to pick up my case and get my settlement. In NYC area. Thank u for great video

Keep in mind this is your case, you can find another lawyer in New York that knows New York law. You should start looking immediately. So the Employer/Insurer get to control your medical care if they have a posted panel of physicians. You have to be taken out of work completely or put on light duty and your employer can not accommodate your light duty work restrictions.

So, unfortunately each state is different. I can say if you are in Georgia they serve the form WC-240 on you and tell you when, where and what time to show up for work and what you will be doing and it is required that your WC doctor sign off that you can physically do the work. If your employer does not have light duty work, you will not likley be required to return. The question you need to consider is will you ever be able to physically return to the same job? If the answer is no, you may want to reach out to an attorney and find out options for resolving the claim. My Georgia expereience tells me they will not continue to pay income benefits forever. If you are not receiving income benefits, again you need to reach out to a Wyoming workers' compensation attorney. They maybe able to help you get income benefits or weekly checks. You may want to do a search or if you know anyone who has been hurt on the job, you may ask them if they were happy with their attorney. The consulatations are free so you have nothing to lose but time, however, you may get information you need to move forward, otherwise you will be guessing at options. Keep in mind in most states the attorneys work on a contigency fee basis, meaning you sign an agreement for them to represent you, but you do not pay out of your pocket. I wish you luck moving forward and hope you are able to move on from this work injury.

Very GOOD video! Thanks for going into detail! Do you know what happens when yr released back to work full duty but there is no job to return to? Meaning you were let go because you exhausted all yr leave and business had to go on. (No light duty available) .

Unfortunately, if you are at full duty, meaning no restrictions the employer can terminate you without having to pay income benefits or weekly checks. However, remember if you were receiving income benefits you could be entitled to an independent medical evaluation with a doctor who you chose. They may have a different opinion, it just depends upon the injury. Now if you are on light or limited or modified duty with any work restrictions, and the employer can not accommodate or no light duty is available, then they should be issuing you weekly income benefit checks. If you are light, limited or modified duty, you should reach out to a work injury lawyer for help. Stay safe, Ty

That depends on many things. Are you sure you closed your work injury claim? If you are considering bring an action against a third party like a home owner, you will have to prove that the home owner was aware of the danger that caused your injury and failed to warn you. That can be very difficult to do. You should reach out to a work injury lawyer first make sure the work injury is actually closed. Sometimes the adjuster will tell you they are closing their file. That does NOT mean that the claim is closed. There are time limits so you need to speak with a work injury attorney quickly. Good luck. Boy, am I going through it right now (CA).They stopped my benefits in February (it's May now) based on the "Neutral Dr's report to release me to full duty, which is base on one of my MANY ailments (which is the better of them all) and I know I can't do full duty already so I'm still off work...my Dr's request as well. I am a longshoreman, drove the UTR trucks for almost 20 years. Been off work going into 3rd year (last day of work 3-13-20), however, the 1st year wasn't worker's comp, it was disability benefits (long story there with previous Dr.). I do not believe the Neutral QME doctor is Neutral. He's making light of all my ailments in his reports and they are EXTREMELY different than my Dr's reports. My dr. sees 2 maybe 3 more potential surgeries and the "Neutral" dr. Sees basically normal to minimal issues.🤨 I don't understand that. Deep inside my spirit, I actually feel like I'm being cheated by the Neutral dr for some reason. He even talks to me in a manner that's bland.. I've never gone thru this experience in my life. My issues are bilateral shoulders, bi hips bi knees, left wrist, (had 2 surgeries at the same time on my right elbow and right shoulder...first surgeries ever in my life). I need surgery on my left shoulder (cortisone shot in it and left wrist now so I can use it to do my PT for my right shoulder), and possible left knee surgery. I've since developed nerve issues on my C4 & C5 cervical spine which is making my pinky finger knumb. But they won't approve PT or OT for that. Shall I go on?? I do have a lawyer. I'm scheduled for a QME re-eval next week. I can barely do my normal work around the house well so I wonder what he'll write in his report. I'll be 54 next month and there's no way all these ailments are normal wear and tear and before all of these issues, the energizer bunny nor the roadrunner didn't have nothing on me. Please 🙏🏾 4 me because I have things to do and places to go.

Ms. Douglas-Manor, I am sorry you are going through this. It sounds like you have counsel which is good, that is what I was going to recommend, especially when you are dealing with surgeries. Speak with your attorney if you have not do so about possible IMEs (independent medical evaluation)for you. Hello, I was hoping to get some advice if possible. I am trying to decide if I should get a workmens comp lawyer or not. Approximately 2 months ago I was involved in a on the job accident that nearly severed my right finger off. My surgeon placed me on a no work status for 6 weeks. Last week rods were removed from my finger. I broke it as well. After that the doctor placed me on light duty status with no limitations for atleast a month. I am also seeing pt twice a week. My concern is that my employer has been pushing me to work full duty. I work in the Towing industry so the job typically requires both hands. I have tried doing the job one handed but i feel i may use the injured hand eventually. I'm concerned about protesting my bosses demands as he can be intimidating. I returned to work two days ago and have been attempting to do the job one handed but it has me concerned I may inadvertently use my injured hand in the process. Any advice would be greatly appreciated as I am at a loss of what to do.

Wow, I am sorry to hear about your injury. You are in a tough position. If you are released to full duty that means your doctor thinks you can return to full duty work. Unfortunately, the doctors are pressed by the insurance company behind the scenes to release you back to work. Once they do this, they do not typically change their minds back in this type of injury. You may have options to get to another doctor, but there are time limits. If you are light duty, you need to carry your restrictions with you, for your employer. If your injury is bothering you, you need to go back to your doctor and let them know what you were doing that is aggravating your injury, the doctor should adjust your restrictions, if not you may want to consider a different doctor. It gets more involved. Since we are on a public form this is general information, if you contact my office we can speak more specifically. If your employer terminates or fires you because of your work injury they may have to pay you weekly checks. If they fire you because of something unrelated to your work injury, then they do not have to pay you income benefits. They will always allege the termination was not related to your work injury, so be careful.

Hola Mr. I'm on workers compensation for 4 years already. First year 4 epidural injections. For a herniated disc L-4 L-5 lots of therapy for my wrist n shoulder. After a year of therapy and pian injections. I get percutaneous disectomy for my lower back. W.C. Cut up therapy for my shoulder n wrist. A year after the percutaneous disectomy. Because I was still in pain. I get fusion surgery L-4 L-5. And workers compensation. Want to close my case now. But the POS. Only offering me 135,000. For my hurt back. My shoulder needs surgery for cuff rotators something 😊. And my wrist sometimes like kinda freeze when im holding something. After a year from the fusion surgery I'm still on pain can't. Bend or twist. And the Dr is requesting more injections for my pain n more therapy but w.c. Keeps denied that. So my question is. Do you think that's a good amount of money for my injury?😢. Gracias sir. Have a good day. Btw. My dr. Gives me 20% permanent disability for my shoulder and 10% permanent disability for my wrist. Because w.c never approved the surgery for my shoulder

Wow, you have been through a lot. The employer/insurer provided you that offer based on three things. Estimated future weekly checks, future estimated medical costs, and permanent impairment. As I am sure you know, Workers compensation does not have to pay anything for pain and suffering. I know you have been through and continue to experience pain and discomfort from your fusion surgery and your shoulder and wrist. Since your case is non-catastrophic you are entitled to 400 weeks of medical care and up to 400 weeks of income benefits. If those 400 weeks run they stop paying checks and will stop paying for medical care unless you case can be considered catastrophic. As far as their offer is concerned for workers compensation that is a good offer. Is it fair for what you have gone through no. You will not receive what is fair. The question you need to ask is do you want to pursue the shoulder and wrist injuries that WC is denying. Worker’s comp will not set you for life. However, you have to decide do you want to have your shoulder and wrist treated or do you resolve the claim and give up all future care and future weekly checks? That is a big decision only you can make. I am always happy to speak about this if you have further questions. Ty
