I got denied after the IME quack contradicted 10 other treating physicians after a bogus 30 minute exam. His report had multiple errors and false assumptions. I will be able with the help of a friend - to break down his report and point out all the discrepancies. We have to present it to a Dept of Labor during a Hearing. This is the 3rd time and 3rd IME Dr. in less than a year. I won the last 2 and got back pay- but there has to be a law against this practice. I am injured and don’t have the resources and strength to keep fighting this. But its all I have. I Don’t want a pay off or buy out - just timely medical treatment -I just want to go back to work. They spent more money fighting not to provide treatment than if they just took care of this once productive and loyal employee. Its a crisis.

The insurance adjuster lied to me and the ime doctor lied about the exam and it took me 6 months to appeal with a lawyer and as soon as the ime doctor was questioned by a lawyer why he denied my claim, he flipped his decision and sided with the 3 other regular doctors that I had seen. Stating he didn’t have all the paperwork when he first saw me, which was a flat out lie. These ime doctors and insurance adjusters should be held accountable for their actions…it’s peer evil what they do!

Remember who pays for the IME. If the IME wants to continue getting work he has to favor the employer not the employee. I had an IME who was fair myself and with other patients . After a couple of visits he was gone and the new IME found everyone to be mildly disabled. Which meant they were reducing everyone’s checks. Do not trust these IME . They are not your friends. Have someone record your session, this assures that they don’t blatantly lie about your injuries. Great video

my workers comp insurance sent me to some quack, it was literally 2-5 minutes long and no longer then that, i recorded the event. such a huge scam. the md didnt even give a darn, i have an attorney that is representing me. I just did my IME and the lady tried to say my doctor didn't have the numbness documented so I was lying. They wouldn't stop when I said it was enough and in tears because of the pain. Of course my workers compensation nurse picked the place and myself or my lawyer had no say whatsoever. I do have a great surgeon who doesn't play comps games and I will be letting him know at the PPI appointment what they done and said. Heck, Sedwick cut me off the day before I seen my surgeon last week! His note said I was still off. He told their case manager he was not comfortable with me ever returning to work after two back surgeries including a fusion and still have damage in my spine. It is a game for sure. They won't even answer my lawyer!

I am from Canada so I am not asking for help from you but want you to know this info has helped but as someone with a brain injury not recognised but denoted as a psychological injury because there were no burns from the electrical injury I sustained for 5 to 8 seconds I think but am now 6 yrs on and am tapped out and even tried to retrain myself with retirement fund in alternative health so as to helpself but organisationally I am not doing well after taking current fo 5 t0 8 seconds I think I am lucky to be here as the doctor said but without proper longterm help i do not wan t to be here anymore. They did not want to pay for my second surgery. So I took the case to the administrative law Court on my own. I won because I was not lying or faking my condition. After winning in the administrative law Court, by law industrial commission had to provide me with a lawyer, it went to the court of appeals and I won !! My quality of life still sucked, I work for 20 more years and now I cannot work anymore I spend most of my time in bed in pain. I have a lawyer now and he told me my representing myself and winning 20 years ago I'm a legend I said a president that has helped other people. So this time around the opposing party is doing their best to deny deny deny my claim. Do I do let's make a deal and settle out of court, if so I know they will have me sign a gag order because I have a connection to do a documentary that will be very scathing !! Or do I take the money and run ??? The laws will never change to help the workers ! I have enough money could I have saved and I own everything I have outright. I feel blessed for having that. My condition is inoperable and it's just going to get worse. The accident I had at work ruined my life, to say the least but I just kept my socks pulled up and I kept working like I said for 20 years. I guess I got lucky. My IME doctor found in my favor and the hearing officer slapped the insurance company with a court order. Of course the insurance lawyer made himself look like an ass by trying to claim no examination ever took place... The current situation is that the insurance company is paying over a grand a month into the endless future for prescription medications for CRPS. The stupid and outrageous thing about IME ? The doctors prior to the IME are the insurance company clowns - so why do the insurance companies need an IME against their own doctors ?

Thank you for your video I just won my hearing September 2 Workmen’s Compensation try to reduce my benefits based on IME the judge didn’t care what the IME said went by my doctor had to say he went by my doctors report I got restored my benefits the only thing they will appeal it they will lose their appeal my lawyer says but I have to wait additional four months but at least I won and I’m so glad the whole community lawyers judges know IME are not to be trusted they are hired guns why do they even have them when they know the community will never believe them?

As soon as you get hurt at work, it is best to contact a lawyer at that time. I truly believe some companies don't really care about you. It is shocking. Concerning your job, try to have everything in writing. When you get treated for your injury, keep every record. Make sure you take down notes. Make notes of pretty much everything. Especially when your employer treats you wrongly. I don't know every company, but I believe many companies will do what is best for the company. If paying you is not the best for the company, I believe they will find a way to cut you off. It is really a shame.

I am having the worst weekend ever. I am injured and just received a notice in the mail to attend an I M E examination dated for 2 days ago. As I watched your video and read IME are serious. I have multiple injuries from a fall at work post concussion syndrome and neck and back strain. I have a herniated disc from a previous injury that I have always been upfront about. My treating doc stopped therapy because of the excruciating pain when activity increased and ordered 3 MRI ‘s . A week before MRI I get a letter requesting I go to an IME appointment. I have a lawyer but he has not made contact my claim was being paid in a timely manner. When I get the request for the IME and consult with him he just says to be truthful don’t take any medical records in and be prepared that most IME go in favor of DR. I kind of felt hopeless as he said all I can do is wait for IME. I need to add the day after IME my MRI’s were postponed pending report. In my current position I have to be restriction free. My doctor got more specific with my restrictions after mri was denied because he fears it will do more damage. He said there has definitely been a change in my neck and back. A X-ray showed a herniated disc in lower back. So while my lawyer seems to be unconcerned I am terrified in order for him to return my back to work without restrictions I would have to be a maximum improvement. I am still in speech for cognitive issues due to concussion and also Vestibular therapy and OT were stopped because of possible back injury being worse than originally thought. I am being referred to concussion clinic and until then I am still in speech and starting vestibular therapy back up and risk even further injury or pain. But my concussion symptoms are still bad. Should I seek another attorney?

Depends on your state, but more than likely no. You can have a friend, family member, etc though. They can't speak but can be a witness and should take notes of what time you got there, when the doctor came, time spend actually examining (they usually talk more than examine) and what time you guys walked out from there and promptly send it to your attorney.

There are several points to this. First, an "independent" medical exam is hardly independent. The insurance company picks the examiner and there is an agenda as to what they want out of the exam. Too many people go into the exam expecting a truly independent exam and that is not what is happening there. When people realize what is going on, it is often after they have had their benefits cut off and they no longer have access to quality medical care and the wolf is at the door. Being sent for an "IME" is a major event in the life of a worker's comp case and is a time when you should be getting good legal advice to protect yourself.

There are a few things. First, just having a lawyer on board makes it harder for insurance companies to take the leap to order the IME as a first step to cutting off benefits when there is no justification. If you are unrepresented, you are relying on their good faith to treat you fairly - a reliance that history says is not justified.. Second, assuming that an IME happens, a lawyer may be able to convince the carrier to not take the actual step of cutting off benefits. Finally, there are porcedures for getting benefits reinstated, but this does not happen overnight. If you wait until your benefits are cut off to get legal help, you are delaying the reinstatement of benefits by at least 4-6 weeks.
