My parents did have financial issues but they told me a million times over. No credit cards, its a scam. We bought junkers. So no car loans. The only thing i had/have on my credit, is 3 years student loans and lots and lots of medical bills. That i couldnt control, it was an emergency. Im so thankful for my parents. Dave is just inforcing what my parents already told me.

My mother cosigned my student loan so I could go to university. I've been out of school 8 months and already paid back 50% of 4 years worth of full loans :) Not even using my degree for the job I got though -_- the rest of my family are the ones with bad credit and bankruptcies. I don't see how her cosigning helped instead of hindered ( multiple bankruptcies in my immediate family), Idk why but the banks seem to give my family high interest credit like crazy with nothing as collateral and the credit being multiple times they're income.. I wouldn't lend them money if I wanted it back

thehALomolov2 you happen to be the exception. Generally speaking co-signing on a loan is a bad deal. It puts the borrower in control of the co-signers credit.

Well, as I see it, your mother must've placed you in a basket and put you on the steps of St. Anthony's Orphanage, when you were a baby, what? A "mama's boy" relationship tends to be more convoluted. This is simple reciprocation, wherein your parents nurture you and repeatedly cover your back when you are young, and you return the favour when they grow older. Yes, it went wrong, in this case, and that was unfortunate. But one must not shirk away from one's responsibility to one's parents. Guess the dear Fathers at St. Anthony's failed to teach you that?

My ex boyfriend of just 3 months asked me to co-sign a car loan of $80,000. He has a history of bankruptcy so he needed a co-signer. I was smart a enough to say no and I am forever grateful for that courageous act. 🙄

So the mother has to make payments on the house AND back-payments on the debt that got her into bankruptcy in the first place 😱😱😱. Sorry to say but NOBODY in that family did their homework before he co-signed.

Minnesota resident here, the mom could easily rent a studio/1 bedroom for 900 a month. EASILY. I think the son needs to explain to his mother this is nerve wracking, and you want her to succeed but the current MATH doesn't work and this is keeping you two up at night and it hurts the chances of them becoming future homeowners! Mom needs to become a landlady or sell it to avoid forecloure.

If you're going to do something like that, it would be better to own the house yourself and rent it to Mom. Of course allowing for missed payments, and the possibility that in the future you will have to evict her. For example my mother went blind in her middle age so after helping her pay rent for a while my grandfather just bought a house with in his budget, he saved money monthly, got to sell the house later on for a profit, and meanwhile his daughter was cared for.

My dad cosigned for both my brother and I's car loans about 7 years ago. I had good credit history but I had started a new job and didn't have enough income history for the loan. My brother had terrible credit. I learned about Dave Ramsey a couple of years after that and felt so guilty for asking my dad to cosign. I paid my car off early, and my brother still owes on his, and has missed so many payments it's affecting my dad now. I will never cosign for someone ever after seeing what my dad is going through.

I don't get the concept of cosign. Why is it always when primary signer jets, the cosigner is fully responsible? Why not just the cosigner jets, the buyer is responsible? Why does the cosigner always get the full brunt of the responsibility?

It does work both ways, that is the point of cosigning. You just don't really hear about the cosigner "jetting" because it isn't really an issue that comes up. If they do, the original purchaser is still responsible, but of course they should be since they are the one who bought the item. It's worse when you're the cosigner since you're responsible for the debt but without actually owning whatever it was that the debt was for, so you're having to pay without getting any benefit. Also, the reason a cosigner is needed in the first place is usually because the lender believes that the borrower isn't likely to pay back the loan based on their credit history, so they need someone else to sign for the loan. What this means is that generally the cosigner is far more likely to actually be responsible, so if either party is going to "jet" and stop paying, it is usually going to be the original purchaser.

Only did this once but went in eyes wide open...so wide open I had the payment auto deduct from MY account if they paid me back fine, if not I didn't really care I just consider the debt mine from the start...that being said wouldn't do it again.

Why in the world does any attorney put someone in this situation in a Chapter 13? The problem is that in a chapter 13 the mother would have to be able to pay off the house in full, plus any other liabilities in five years. With the mortgage being $220K, that means the house part is $3,666 per month or $44K per year. The mother making $50K per years means it is impossible for the mother to keep up the payments. This is not the first time I have seen this happen. Usually, the situation is that the debtor goes into a law office and tells them they 'want to keep the house', so the attorney files a Chapter 13 plan of the debtor without making sure they can make the payments that would be required to pay off all of the debt in five years or less. Of course, since the person was having problems with the mortgage payments when the note was over 30 years, there is NO WAY they can make the higher monthly payments to pay the mortgage off in five years, even with the fact that there will be no interest on the mortgage within a Chapter 13 plan. A secondary 'fall out' is that when the plan fails, and the court dismisses the Chapter 13 for failure to keep up the payments, now she will have to wait a period of time to refile a Chapter 7 plus may not have the benefit of an automatic stay. If the mother would get with it and realize what is going to happen, she can file to convert the Chapter 13 to a chapter 7, which is where she eventually is going to end up anyways. The only hope I see is that maybe the house is the only debt, and if it was sold it would take care of the mortgage and withdraw the bankruptcy but it sounds like the mother wants to stay in the house 'just because she deserves the house.'

Wrong.. she doesn't have to pay off the house in 5 years. She only needs to pay back the back due amount in 5 years and continue making her typical payments.

My mistake on not clarifying. Normally, I would consider the decision to be in a chapter 13 like this is if they can pay off everything, including the mortgage, in 5 years (60 months), if not then there seems to be little point in going chapter 13 to 'save' a house with a mortgage , especially if a large part of the problem was the mortgage on the house. If the mother couldn't make the payments pre filing Chap 13, filing a Chap 13 to get current on the payments is not going to help. (Of course, if the mother has all kinds of other debt then a chapter 13 does get rid of that all after five years, but in this situation taking five years to save a house that she can not afford does not make sense.) The only way I can see a chap 13 help get current is if a very large part of the liabilities are all the mortgage. The problem is that even making more money may not help because any extra money may get spread out over all of the debts since paying extra on the mortgage could be considered a preferred payment and not allowed. (However I do expect that a court would at least allow making payments to bring the mortgage current. After that I would expect extra income over the formula for disposable income to go to all of the other liabilities.) I do fear that maybe one of the reasons the mother in law is in chapter 13 is not because she is doing that to keep the house, but that she is making more than the income limits to file chapter 7. If that is the case, the only real solution is to sell the house. Financially, if the house is worth less than the mortgage, why spend all kinds of time and money trying to save it? If the house is worth more that the mortgage, then selling the house would allow the mother to start paying off other debt. In any case, going through the time and expense for up to 60 months in a chapter 13 just adds all kinds of costs and takes five years out of her life towards rebuilding her finances.

I assume in your situation there is equity in the house to be 'saved'. You are also fortunate in that you got a 0% to unsecured to be approved. I have seen problems where the trustee and the court didn't seem to 'like' (meaning approve) plans for 0% situations.

Unless they're going to 1) move in there, or 2) kick the MIL out and rent it out to not-mom, then _it's not a good idea to take a loan for a place for MIL to live._ What you suggested is repeating the same problem, sans cosigning (which I suppose is a better problem than this).

My mates parents co-signed for his first house. He was 2-i-c for the building company that he worked for at the age of 20. It worked out. But they would lend either of their other 2 kids a dime because they were smarter than that.

I actually like Dave Ramsey’s advice, I think it’s great 👍🏻 but I wouldn’t merge it with the teachings of Jesus. you can’t juggle faith in God like Abraham, and this “get rich” mindset. I’m sorry, but God’s kingdom economy works differently than the 🌎 worlds. Look at the story of the prodigal son who blew his fathers money, and his father threw him a party. That is the grace, mercy and love of God. Not this old ranting guy calling people stupid for not wanting to be millionaires. Missionaries give up the idea of wealth to spread the message of Jesus. I’m not trying to talk bad about Dave Ramsey, but if you’re a Christian? just take a step back and think about what I’m saying..and what about the women in the Bible that gave the 2 mites? Who Dave cal her stupid? That was all she had, but she put her faith in God.

why wouldnt they sell their house since she wont sell hers and move into her's, that way she keeps the house and is happy. They pay it off over time while helping her out then stay a few years to save up money rent free in moms house.
