On March 23, 2022, the law firm of Sauder Schelkopf LLC filed a class action lawsuit captioned Cho, et al. v. Hyundai Motor Company, LTD against Hyundai and Kia on behalf of Hyundai and Kia owners and lessees with vehicles that are prone to excessive engine oil consumption, oil sludge and engine failure. It has been alleged that consumers with Hyundai and Kia vehicles are experiencing oil consumption that results in ticking sounds and possible failure of internal components. This may result in catastrophic engine failure and even stalling while driving. It has also been alleged that consumers who present their vehicles to Hyundai and Kia for repair are informed that this engine oil consumption is considered normal and are denied warranty coverage for the necessary repairs or, in situations where engine replacement is required, Hyundai and Kia do not have the parts needed to complete the replacement. As a result, current and former owners and lessees may be forced to pay for replacement engines and repairs out-of-pocket or be stuck with a non-operable vehicle for long periods of time while awaiting the parts required for the repair to be completed.
