Hey Renato amazing work. All your videos are very useful. Just subscribed. Quick question that I am confused about with regards to external affairs power if you have the time: can a treaty that is only signed but not ratified by aus executive gov enliven the external affairs power? (assuming the limitations for treaties pose no other restriction - bona fide… specificity… etc…). In other words can federal legislation be enacted with regards to a signed, but un-ratified treaty? (Sorry if I’ve missed/misunderstood this somewhere) :) Edit - just subbed as a member, sorry didn’t realise that was needed for comment reply :) !

Hi Josh, thanks for your question. The question is very interesting, and although not specifically in my area (but more towards Public International Law), I went around to find an answer. The treaty's signature (a prerogative of the Executive) allows the Cth Parliament to use its external affairs power to implement the treaty. The ratification occurs at both the domestic and international levels by the enactment of the Federal Law giving effect to the treaty.
