"I belong here": Toronto senior faces deportation after more than 20 years in Canada

A Toronto senior is counting the days to Jan. 4 when, after spending more than 20 years living in Canada on work permits, he will be deported back to Kenya.
Samuel Nyaga, 75, escaped Kenya in 2000 as a refugee during the height of democracy movements and the push for a multi-party system. He says he left due to fears of political persecution after an attempt on his life.
He stayed in Canada under work permits that were consistently granted by Immigration, Refugees and Citizenship Canada. He was issued the permits until 2017 when he lost his job as a security guard at a Toronto condominium because his permits expired. Applications and appeals to remain in Canada on humanitarian grounds have been turned down.
As Morganne Campbell reports, the senior has been left heartbroken over having to leave a country he has called home for more than two decades and is asking why he has to leave now.

I know someone originally from the UK He got Canadian citizenship as his mom was born in Canada. He is a repeat offender and has served 5 years in a Canadian jail. Yet they can't send him back based on a loop hole being how he got citizenship. Yet this hard working man who has done nothing wrong is being kicked out.... how wrong is this ??

Not a loophole at all. If you have Canadian citizenship you cannot be deported unless you were denaturalized. It doesn't matter how many crimes you committed after you became a citizen. His British citizenship if he still keeps it is irrelevant.

If he has one parent who is a citizen it means he is automatically a citizen. Not a loophole. Just how it works. As Canada allows dual citizenship.

A work permit is a work permit. Not a ticket to become a citizen. Canada has been generous to have granted him work permits for this long.

They send a guy that worked hard and paid taxes back and will replace him with refugees from middle east that won't touch any job, has 9 kids and collects social assistance for each child alone worth $500/child, oh and free housing. We ofcourse pay for it. This is exactly who recently moved in beside us. And the guy is complaining that Canada is not nice to him. This country is getting ran to the ground.

@@googlreviews7813 I do agree the country is flawed big time. I never agree with the welfare system here. If it was my choice, I would stop welfare altogether or at least give individuals 5 years to get off their feet. If they continue to become useless, then deport them after 5 years of leeching on taxpayers hard earned money.

@Angelinas crystal universe People think that "doing it legally" is just a walk in the park. If you are a top level engineer, that may be the case. But for an average worker, its close to impossible to obtain any visa at all. If you don't give ordinary people even the slightest chance to immigrate legally by obtaining a visa, they will do it the iligeal way.

He has his reason not to apply for permanent residency. Perhaps 18 or 19 years ago, he feared his application would be rejected and he would be sent back to Kenya. There’s a saying “let sleeping dogs lie”.

@@Landis_Grantand lie they shall… 😢 If papa was afraid to come forward for fear that his asylum case would be rejected then fine, I understand, but he also made his choice to stay under the radar rather to legalize his status. I’m unsure of what he feels entitled to. You can’t ask for clemency AFTER 23 years once a long issued deportation order is finally being carried out. My Canada might be slow but you can’t play in her face forever.

Should have applied for permanent residency. If you're moving to a new country, you better be aware of immigration laws. Immigration laws are not meant to be merciful they are meant to be regulated and orderly so that everyone gets the same treatment.

Yes, this is how it should work, but we see that is not happening in the right way. Lots of non status immigrants can get their PR easier than ones who came to canada to study or work. Some of those people don't even pay taxes and they can get their PR. That is not fair for those who are legal and came here to contribute to the country

This man is old and no longer useful to capital accumulation. He does not have enough capital to be significant in this country and so must suffer external deportation. If he had enough capital, this would not be happening. Insignificant seniors with limited or no capital are warehoused in filthy, poorly staffed wallows and left to die in what we call, "Long Term Care" homes. This poor old guy is just another victim in the vicious, one sided, continuous class war that is waged from above on the little people below. We have some nerve calling ourselves a "democracy".

He's not a victim. He came to Canada as a refugee but never followed the rules regarding that status which is a privilege. Even a naturalized Canadian who commits fraud to acquire citizenship can also be stripped of it and be deported coz he/she didn't follow the rules. The old guy should be grateful Canada even allowed him to stay that long. In most democratic countries especially in Europe, Japan etc. he would've taken the boot within a year of losing his status.

He was out of status for 10 years meaning he was up for deportation then but they ignore the letters of deportation hoping they will go away but they don’t now they pretend I didn’t know anything about it that’s the problem with letting them in the country because it’s hard to deport them

Unless you have a masters in engineering, its actually close to impossible to come legally and work. There are literally no visas for average workers. This is why there is such a huge explosion in illegal immigration. Its definitely anything but easy.

@@ShenasRI honestly I know of so many people, not him, who came as a “refugee” and living on welfare… and I have never enjoyed the great wealth of the welfare system in all my life. I feel bad for him like I feel bad for so many people in Syria, Iraq ect ect but he came as a refugee and stayed 20 years we protected him now it’s time to go home… that’s how it works it’s not that you come and stay forever all the time

Canada is losing the great badge of a place that supports all imigrants regardless of country, race or personality, there is no reason this man cant stay in Canada, i have seen people who have done far worst allowed to stay here. Syrian refuges were allowed here no reason this man cant stay. Maybe its that other thing why he is really being deported we are not blind to this systemic problem.

@Van Hughes not inhumane.... he was given 20 years to obtain status and he didn't do so. Kenya is not an evil country, going back will not kill him. Canada must keep its laws while being humane, he had his chances and it didn't work out. People can not be allowed to run out the clock.

Laws assume that the world is black and white. Laws are needed so that order can be maintained. The courts exist because it is recognized that life is not black and white and that there are situations where exceptions should be made. This appears to be a case where all the t's in red tape were not crossed. Not sufficient reason to destroy the life of a senior. Even if he is the wrong colour.

Simple did he pay taxes,did he commit a crime, 20 years is a long time and if he caused no legal issue during that time that should weigh in, yes he should have applied, 20 years should get him a review and assistance to fill it out. just saying give a good man a chance if no crime was committed by him.

This is the dumbest question asked. Why not ask the guy being deported, why him didn’t file for permanent citizenship? Find someone to marry (who is a citizen)? Better yet, given his current situation he should find a sponsor. Maybe you can sponsor him? Always other people to blame rather than the individual who got themselves into their own mess….

Yet that same Greece went on to become the Roman Empire; who went on to become Europe and than Europe as we know it. (There is more to it but I don’t feel like it). Every country that has ever existed has interfered with others. Mongols harassed China relentlessly yet they are now one of the super powers. Romans harassed Germanic tribes and Germans went on to be a highly industrious nation. The United States had to fight for independence yet it’s the foremost super power. Every country that has ever existed has gone through turmoil from other countries. Also besides Persia and other extraordinary leaders and thinkers during that time and period who led it, the Middle East has been a complete disaster. Absolute travesty. Africa hasn’t been much better either. Also in regards to colonization, I am not defending it however if we look at India pre and post colonization there is a stark contrast in many of the first world values and technology that was brought over from Britain to India. The issue with Africa and the Middle East is that many of the leaders study abroad but they choose subjects like sociology or English to major in. If they studied Economics, mathematics, or history they would be a little better off

I know longer recognize my country. I feel like there is no more Brits left We built this house and now we have allowed so much immigration that we have given away our culture. Image if 15 million whites immigrated to India and demanded positions in Government and right above and beyond those of natural citizens. Then when any grievance is voiced you are labelled a racist and dismissed. All over the world we have opened our borders and so diluted our cultures so has to be minorities in our own borders.

The Canadian Border Services, in my opinion… honestly got this right. This gentleman came as a refuge and stayed for 20 years and didn’t file for citizenship or anything else… frankly wish him well and every other person in his case. But the refugee pipe-line is well overused and I’m happy to see them cleaning up the rolls.

If your profile picture is who you are, you are a black man, which means either you or your parents migrated to Canada, which clearly means someone in the refugee office showed mercy to you. Now, why can't you show the same compassion to that person. You may be lucky to have been born in Canada, should he be punished for where he was born. He is 70. Do you think he will remember such things as a work visa at this age? Have some empathy.

Cos he didn’t file for permanent citizenship. And our government will soon be tightening their belts when it comes to social programs. Don’t be surprised when they start finding new ways to screw everyone over, regardless of being a citizen or not. Need new income streams.

I feel for the man, and in my personal opinion I say let him stay. He works in a low paying crappy job, has been here for twenty years and to him Canada is home. I can relate. If Quebec deported me to Manitoba I would be very unhappy. No offence meant to anyone from Manitoba. And I'd still be in the same relative culture, never mind being forced to return back to a radically different culture after twenty years! At the same time; when dealing with the government, it's important to keep your paperwork up to date. He could have avoided this situation entirely. To the people working on his case he is nothing more than a file number. They can't be blamed for that. He could have taken due diligence. I am quite aware of the legal status of my residency at all times. When I move between provinces I register with the provincial health insurance, change my library card, file my taxes based on my address from December 31st of the previous year...... I feel sympathy of course, but he could have taken action quite a long time ago.

It is easy to say when you grow up in a country that has all that figured out for you. You can clearly see he is old, and 20 years ago, well, he was still an older man. Immigrants depend fully on the info given to them upon arrival, don't compare with you going from Manitoba to Quebec lol. Why don't you go to Kenya and put your trust in the people there to guide you while also not speaking the language. Si tu resides au Québec j'espère que tu parles aussi français, j'espère que tu n'es pas juste un autre anglophone qui ne fait pas l'effort d'apprendre la langue en pensant que son anglais est un laissé passé pour tout! Et que par ce que tu es capable de naviguer un système très similaire au tien, ne veux pas dire que tu es capable de répliquer ça dans un autre pays. La compassion c'est pas assez si tu n'es pas capable de te mettre dans ces shoes de façon objective.

@@namastenamaste7228 This is why I am able to understand it slightly objectively. I am not able to speak French fluently after three years. Qeubecois is a very subtle language. However, I do know well enough enough that I need to register here and file two tax returns now. At no point did I mention the language he speaks did I? I can struggle through living in Quebec as an Anglo. But all of my paperwork is in order. If I am confused about something I ask for help. If you watched the video it is quite obvious he speaks English. So that isn't an excuse for him.

You do realize we take in plenty of refugees from around the world right? It's not like Canada doesn't accept a lot of refugees. This fellow isn't a refugee though, he was here on a work permit that has now expired. I feel for him but it's not the same situation as what you compared it to.

However, by applying for their permanent residence, they were misinformed, which caused their legal status to run out and get deported, despite having applied for PR. They always paid taxes, never had troubles with the law. They never even wanted to be illegal and tried everything to go by the book, and had the book thrown at them, as soon as they lost their status due to insufficient and contradicting information from the immigration office.
