States that require both parties to consent (2 party consent) doesn't refer to the legality of doing it, it refers to the admissibility in court. You can record anyone anywhere even in 2 party consent states so long as there isn't a reasonable expectation of privacy such as in a bathroom, bedroom, changing room or while doing intimate things such as sex as well as a couple other very specific scenarios such as recording a house that has their window blinds open is typically illegal and likely some other specific scenarios. The difference between a 2 party consent state and a 1 party consent state is that you must have both parties permission to record in order to in the future be able to use it in court...the only way you can sue someone for recording without your permission is if there is a legally established reasonable expectation of privacy.
