There are thousands of machine guns currently in the National Firearms Act registry registered to people born before 1900. Think about that for a moment - every one of those owners is deceased, and those machine guns are still out there somewhere.
Periodically, the family of a deceased veteran will find a machine gun amongst there possessions. There is a straightforward process for passing a registered machine gun to a lawful heir, but it is dependent on the gun actually being legally registered. It is up to the family to locate the paperwork to prove that registration - or else contact the BATF to get a copy of it. Today I am discussing this situation with John Keene of the Morphy auction company. Sgt (retired) Keene is an expert of the NFA and this type of paperwork, and has helped many families through the process. This video is intended to help people in this situation understand how to deal with a gun which may or may not be registered.

@@jaybee2850 No closer now than it ever has been. Repealing a constitutional amendment is not easy and very unlikely. All through the 8 years of the Obama presidency, people were complaining about how ATF was going to collect all of the civilian owned firearms and ammo in the U.S. Civilian firearm ownership increased year over year for all 8 years and the only thing that happened to ammo was that the price went up and availability went down as idiots started hoarding things like .22 LR (obviously a military grade cartridge needed to take on the gubment...). I remember shops limiting the amount of .22 LR that could be purchased per visit to one or two boxes, if they had anything at all. But keep on saying that the 2nd amendment will be repealed just any day now. That way, we can keep the run on sales going and all spend $650-800 for a marginally functional AKM variant from Century Arms instead of $400 and NRA can get a much bigger "tax" from Century. What a win!

Same ATF story here: I owned a registered gun for 35 years. I sold it to a dealer. The dealer sold it right away and during that transfer, the ATF said:"There is NO reference to this gun in our records." SO the ATF took the gun and shut the Dealer down. The dealer called me and said: "Please tell me that you have your old paperwork?" "Yes" and sent him a photograph of it. Having the stamp number, the ATF "Found" the records, the transfer went through. Even though the ATF has had money given to them several times by Congress, their records are a MESS. (Or they do this with everyone, trying to depopulate the NFA list.

Things like this happens because of the laws preventing a national gun registry. Their database if digital has to be "non-searchable" so this means they cannot use a database management system where you can search by keywords, dates, or any other field other than the index number of the dealer. Then they have to manually look through all the photos and documents under the index number to find the correct firearm. Makes alot of mistakes like the one you're talking about a relatively common thing.

A buddy of mine inherited a legal machine gun years ago and had his dad’s paperwork and tax stamp. The ATF had lost the original paperwork and attempted to seize his gun even though he had proper paperwork. He had to hire a lawyer and fight with them in court to retain possession of the weapon.

19:00 So, effectively, if grandpa brought an MP40 back from Berlin or a Type 56 from Hanoi, and for some reason was not able to register it, and I call the BATF, they will come in, take a look at the gun, see that it is not in the registry, and will then proceed to take possession of the gun, and will basically either take it into permanent BATF custody or melt it down. And you wonder why people don't want to contact the BATF if they find a machinegun?

Literally a lawful transfer, a the weapon is unregistered and the federal agent IN YOUR PRESENCE cannot allow that weapon to be in the public unregistered, so either he is going to take the weapon, or you are committing a crime, and he will have to place you under arrest, it's as simple as that

Bobby Johnson why not just register it to you now? If you're a lawful citizen with interest in own that piece of machinery, why not just hold off on melting it down to metal slag and just register it from hence forth? Seems stupid to me. As long as they know who owns it NOW, if that gun acted out in a horrible crime, it would be registered to you and it would serve the same function as any other registered gun.

Whether you like the law or not, the effect of the 68 and 86 acts was to limit the stock of legally owned machine guns to those registered in compliance with the law at that time. They’re doing the job the democratically elected American government tasked them with; it’s ridiculous that this seems to outrage you.

As far as the 4th amendment, you have possession of the item, but the whole reason the ATF is there is because you have no proof that it is yours, and if it was yours to be legally owned, the ATF would not be taking it from you. Therefore it is not unreasonable seizure, and certainly not unreasonable search as you invited them in, and therefore not a breach of the 4th amendment. Try again please.

My dad and his business partner have a gun shop and have been in business since 1972. The ATF visits once a year and does a through about every 3 years or less. They have not been nice, cooperative, understanding or polite one time. as a matter of fact they were in 2 months ago and the shop got a citation for paperwork that I actually filled out. I purchased a gun and check marked "Non Hispanic, white". But didn't check mark the box at the end of the other races marked "white". In the last 30 years I have been at that shop, they have stayed between 2 days and 2 weeks and never, ever left without writing up a violation. One was for sq footage of storefrontage vs ammunition and rifle displayed. They said it posed a fire hazard. when asked if they enforced building code, they said no, they just thought it was too much. Fire marshal said we were in spec. when we called them out to check per request. Still got the write up that year. long story short. they are not your friends, nor trustworthy. Think finders keepers in gun situations and keep a lid on it!

@See the Light I remember reading about that. Didn't last long in the news though..... wonder why.... In my case with the citation, I checked Non Hispanic white, not sure at that point why the other had to be checked. It was my fault through and through, I have filled those forms out I don't know how many times. I guess I was just excited. If I remember it was for my Johnson Rifle or Ruger revolver I bought.

Found an STG44 wrapped in newspaper from 1947, while pulling out walls for new floor plan. Forman called cops, ATF destroyed the gun. I almost wept.... However I kept the 3 mags we found with it.

The ATF is not out to get you. Just ask Brad Martin, of Cornelius, Ore, who had a shipment of Airsoft seized, claimed to be easily converted to machineguns. That shipment was worth around $12,000 and the ATF promised to destroy the entire shipment. ATF has never demonstrated that Airsoft could be converted to machineguns.

Yeah, you could convert them. These were GBBRs that absolutely couldn't fire a round, but the lower was essentially an untracked lower with a full auto pocket; I think it had the correct 3rd hole, I'm not sure. It's pretty telling that WE changed the fire control pocket on them right after.

Living in the liberty hating country of Scotland, I found a WWI flare gun in my recently deceased cousin’s woodshed. Told the police like a responsible gun owner and asked if I could add it to my firearm certificate, the local firearms cop (who is my brother) says he doesn’t see why I can’t add it to my certificate for sentimental reasons, as he inspects many certificates with old firearms kept for sentimental reasons. So I inform the firearms licensing department in Inverness, those pricks tell me I have no right to add the flare gun to my certificate and to hand it into the police for destruction or expect them to take it from me. It sucks being a law abiding citizen.

I'm not even American and even I would never do anything to help the BATFE infringe on the 2nd amendment any further. I know you can't very well go on youtube and say something like "hide it and shut up", but the BATFE apologist "they are not the bad guys" and "there are many agents friendly to the shooting hobby" made me cringe. Don't give them a single inch.

To be fair, there's the enforcement wing of the BATFE, and there is the licensing wing... I've never had to deal with the jack-booted enforcers, and hopefully never will, but my dealings with the folks who handle the licensing has never been anything but positive. For example, there was the time when I tried to fill out the form to renew my C&R collector's license on a bad day, and checked all the wrong boxes - the ones where I basically said "yes, I'm definitely a fugitive from justice, and a convict, and a domestic batterer, and a serial killer, and illegal alien, and shouldn't be allowed within a mile of a picture of a gun!", and then lost the form for a couple weeks, and found it just in time to try to mail it off at the last minute, only to get to the post office too late on a holiday to get it to the BATFE on time. I mailed it in late anyway, not realizing the mistake on the paperwork, and a few days later I got a registered letter back from the BATFE licensing office, explaining that they're sure I made a mistake, with a fresh blank form attached, and an extension allowing me to resubmit the form with a generous new deadline. Nobody at the BATFE really needed to do that, they could have given me all kinds of grief, they could have sabotaged me in a way that could have at least prevented me from renewing the license, if not prevented me from ever owning a gun again or using the opportunity to send in the troops, but instead they were pretty friendly, understanding, and helpful about the whole thing, and gave me the benefit of doubt and took the opportunity to go above and beyond the minimum to give me a chance to correct my mistake. Beside that, every question I've ever asked the licensing side of the ATF has been promptly, thoroughly, and helpfully answered, and every other interaction I've had with them has been nothing but efficient and professional. So, in my experience, yes: the BATFE - or at least the licensing side of the bureau - is friendly to and supportive of the shooting and collecting hobbies, and I'm sure that the chances are good that anyone going through the trouble of trying to engage in the hobby in an orderly and lawful way by going through what is, really, a completely unnecessary licensing process in the case of a C&R license, is a completely different story from anyone who needs to have the jack-booted enforcers kick in the door to search their house because they've been doing something shifty. The enforcement side of the bureau might well be a different story, and certainly seems to have more than its fair share of horror stories (much like police and enforcement agencies anywhere tend to whenever the level of anonymity between the agents and the people they police increases). And, don't get me wrong: I don't really like having to be processed for background checks before each legal sale of a gun or all of the hoops to jump through wherever licensing and so on are concerned, and if I had my choice they'd all be overthrown. But, of all the government agencies I've ever dealt with, I think I'd rather deal with the licensing folks at the BATFE the most. They're positively a pleasure to deal with compared to, say, the government agencies that inspect my cars, or issue my driver's licenses, or handled my passport, or did customs and luggage searches and strip searches etc. on my few experiences with air travel or trips to other countries.....

If you have the luck (either bad or good) to stumble onto a machine gun, assume that the ATF is going to try to punish you for finding it - that's the default position of that agency, because that's the reason that they exist. There are instances where that may not be the case, but it's better to err on the side of caution and simply assume the worst possible scenario when it comes to things like this. I hope I saved everybody some time :)

I think I'm more confused now. Our govt knows that these classic and massively valuable guns are NOT used in crimes! They should at the very least allow these guns to be converted to semi auto without having to be butchered with a sloppy torch and rewelded and refinished for no good logical reason! They act like that is somehow the only way to make them semi automatic lol. It is so frustrating 🤦‍♂️

Keeping in mind that no well known and respected gun person or business wants to speak negatively towards the ATF, I do believe this video could have been more correctly titled "How to safely and legally lose possession of a firearm to the ATF" , because once you bring it to their attention, if you are not the heir to the registered owner or it was never registered......it's gone. There's no way to legally keep it.

I personally don't have any desire to own a fully automatic firearm. That said, I believe when someone trying to abide by the law contacts the BATF-E and subsequently has the government take a non-registered fully automatic firearm from them that person should be entitled to compensation. If not full market value that compensation should at least be a significant portion of fair market value.
