Ignoring the fact that, thanks to Article 1 section 8 and the 16th amendment, Congress _did_ have authority to pass the revenue act of 1862 that would later make up the bulk of Title 26. They created the tax, as was their right and was the will of the people, and they created a body to enforce and administer the law.

@@nazgullinux6601Section 1 of the Internal Revenue Code (“IRC”) contains no provisions creating a specific liability for taxes imposed by subtitle A. Aside from the statutes which apply only to federal government employees, pursuant to the Public Salary Tax Act, the only other statutes that create a specific liability for federal income taxes are those itemized in the definition of “Withholding agent” at IRC section 7701(a)(16). For example, see IRC section 1461. A separate liability statute for “employment” taxes imposed by subtitle C is found at IRC section 3403. 13. What is a “Withholding agent”? Answer: (See Answer to Question 7 first.) The term “Withholding agent” is legally defined at IRC section 7701(a)(16). It is further defined by the statutes itemized in that section, e.g. IRC 1461 where liability for funds withheld is clearly assigned. In plain English, a “withholding agent” is a person who is responsible for withholding taxes from a worker’s paycheck, and then paying those taxes into the Treasury of the United States, typically on a quarterly basis. See IRC section 7809. One cannot become a withholding agent unless workers first authorize taxes to be withheld from their paychecks. This authorization is typically done when workers opt to execute a valid W‑4 “Employee’s Withholding Allowance Certificate.” In plain English, by signing a W‑4 workers designate themselves as “employees” and certify they are allowing withholding to occur. If workers do not execute a valid W‑4 form, a company’s payroll officer is not authorized to withhold any federal income taxes from their paychecks. In other words, the payroll officer does not have “permission” or “power of attorney” to withhold taxes, until and unless workers authorize or “allow” that withholding ‑‑ by signing Form W‑4 knowingly, intentionally and voluntarily. Pay particular attention to the term “Employee” in the title of this form. A properly executed Form W‑4 creates the presumption that the workers wish to be treated as if they were “employees” of the federal government. Obviously, for people who do not work for the federal government, such a presumption is a legal fiction, at best.

@@Chance57there is an argument around that the 16th was not properly ratified. Then there's these : “Since the right to receive income or earnings is a right belonging to every persons, this right cannot be taxed as privilege.” (See also Jerome H Sheip Co. v. Amos, 100 Fla. 863, 130 So. 699, 705 {1930]; RedGeld v. Fisher, 135 Or. 180, 292 P. 813, 819 [Ore. 1930]; Sims v. Ahrens, 167 Ark. 557, 271 S.W. 720, 733 [1925]; O’Keefe v. City of Somerville, 190 Mass. 110, 76 N.E. 457, 458 [1906]). P. 19Jerome H Sheip Co. v. Amos, 130 So. 699, 705 By propaganda, misleading information and seditious syntax, government has gotten nearly everyone in the 50 States of the Union to use ZIP modes of address, and that creates a PRESUMPTION or a PREJUDICIAL ADMISSION that one is in such a Federal venue, or that one is such a government agent. In general, it is well settled in law that Income Tax Statutes apply only to corporations and to their officers, agents, and employees acting in their official capacities, e.g. from Colonial Pipeline Co. v. Traigle, 421 U.S. 100, 44 L.Ed.2d 1, 95 S.Ct. 1538 (1975): "... However, all 'income tax statutes' apply only to state created creatures known as corporations no matter whether state, local, or federal." Since corporations act only through their officers, employees, etc., the income tax statutes reach out to them when acting in their official capacities, but not as individuals. This is the real purpose for Identifying Numbers -- cf. 26 CFR 301.6109-1(d) & (g) and 26 USC 6331(a) and 26 CFR 301.6331-1, Part 4. Use of a ZIP Code address is tantamount to the admission of being a "citizen of the United States" who does not necessarily have the protections of the first eight Amendments to the Constitution (in the Bill of Rights) when proceeded against by Federal or State authority -- Maxwell v. Dow, 176 U.S. 581, 20 S.Ct. 448 (1900), but, "All the provisions of the constitution look to an indestructible union of indestructible states", Texas vs White, 7 Wall. 700; U.S. v. Cathcart, 25 F.Case No. 14,756; In re Charge to Grand Jury, 30 F. Case No. 18,273 (65 C.J. Section 2) -- not known to be overturned. It used to be very difficult to find laws enacted by Congress; but now, with the advent of the internet, all of us can find the copy of any law to read for ourselves at our fingertips on our personal computers or smart phones. As a result, I have done my due diligence and have read tax laws for myself, especially tax laws at the website of the US House of Representatives. I looked up several sections of Tile 26 of the United States Code (otherwise known as the IRS Code). IRS Code Section 7701, defines many terms that to a common person, like me, needs no defining: Terms like “Person”, “Domestic”, “Stock”, “United States”, “State” as well as some uncommon words or definitions like “International organization”, “Domestic building and loan association”, “United States person” or “cooperative bank”. I also found in IRS Code Section 7701(a)(16), the definition of Withholding Agent - The term “withholding agent” means any person required to deduct and withhold any tax under the provisions of section 1441, 1442, 1443, or 1461.” I found these 4 Code sections here: (Sorry, I had to remove links or YT would delete the comment but Google the IRS code) Naturally I looked up and read code sections 1441, 1442, 1443, or 1461 as well to see if I, as an American citizen am subject to the Federal Income Tax withholding. To my amazement, I found that these four sections are about “nonresident alien individual”, “foreign partnership”, “foreign corporations”, “foreign tax exempt organizations”, NOT American citizens, such as myself. I also looked up IRS Code Section 61, from which taxable income is derived from in IRS Code Section 63. I found these two sections at: Section 61: US CODE (yep censored again) I was shocked again. In Section 61 it lists eighteen different items as “Gross Income,” such as minor things, such as fees, dividends, royalties and fringe benefits, but glaringly absent is wages or salaries. The US Supreme Court has clearly and unanimously ruled in a case called Gould v. Gould in 1917 that: “In the interpretation of statutes levying taxes, it is the established rule not to extend their provisions by implication beyond the clear import of the language used, or to enlarge their operations so as to embrace matters not specifically pointed out. In case of doubt, they are construed most strongly against the government and in favor of the citizen. United States v. Wigglesworth, 2 Story 369, Fed.Cas. No. 16,690; American Net & Twine Co. v. Worthington, 141 U. S. 468, 141 U. S. 474; Benziger v. United States, 192 U. S. 38, 192 U. S. 55.” Copy attached. The average American wage earner and salaried person is being Hoodwinked by the IRS and the Deep State. These entities are stealing the money of the American people by misapplying the Federal Tax laws for the benefit of the corrupt bankers, corporations and other moneyed special interests. Who then in turn pay for election campaigning advertisement for politicians that will hire the bureaucrat ?

The founding fathers of America were careful when writing the constitution because of seperation and freedom from England. The only income that is legally taxable is capital gains and income generated from your day job is not taxable under any law period. Also the law clearly states no taxation without representation and that was clearly written to keep the gov’t from getting too strong.

FernandoP1 - If you want to learn about how to stop paying taxes there are a ew things you need to do. 1st, if it is state, go look at the original intent of the tax law. Read the tax law if needed, but read it. One can usually find the original act most likely back around 1875-1876. Also read the previous year constitutional congress of that state, if they had one. But, what you will find is the tax law was for corporations and other legal entities. And it still is but most of this country has been asleep and not paying attention. You've got to know this stuff yourself and you should not rely on any seemingly too good to be true paperwork because that is what got people put in jail. If you know their law, then you will know how they a misapplying it. Same way with federal. You are a U.S. Citizen for taxation purposes only and most can't seem to grasp they are a citizen of their state that is one of the several states in the United State of America. You not not need to be a U.S. Citizen. And there is nothing wrong with that. You are sill loyal to your country. Oh, sorry I'm late.

@FernandoP1 Sorry, you can't stop paying taxes. How do you expect to run a government on *no money?* What you CAN do is stop paying taxes you don't owe. Example: I have an electric car, so I don't pay the Petroleum Tax. "Income" doesn't mean "all that comes in," or the Federal Income Tax would be a "Direct" tax, rather than the "indirect" tax that it is. Start with a short, accessible user's view of Internal Revenue Code: kzbin.info/www/bejne/pH6YmWSNpqd7eZo (Thanks, Emily!) Yeah Medicaid is like that too in the US but if you’re too ill to work you could file for disability which will make you eligible for federal healthcare. At least that’s how it is in the US. I used to work in eligibility and public assistance. Not sure what UK is like. But again, that help comes from taxes so you either take the risk of not participating in the tax game and try to be self-sufficient and rely on God and community to take care of you…which is hard to come by unless you’re in Amish Quaker Mennonite type of communities.

How about a system that actually allows the taxpayer to decide where their tax dollars go? Rather than mail Uncle Sam a check and that money goes to a general fund where Congress under the influence of special interests decides where and how the money is spent, you actually have choices on your tax return with 10, 20, 30 government agencies listed that the tax payer chooses to support with their tax return. For example: you owe $5000 in federal income tax. You can designate that all $5000 tax dollars go to the Dept. of Education. Or you can designate $1000 to Dept. of Education, $1000 to Environment Protection Agency, $1000 for Dept. of Transportation, and $1000 for Social Security Admin. and $1000 for Veterans Affairs. Designate a list of federal agencies (say the 100 biggest) and let these agencies compete for the taxpayer's dollar. The taxpayer will feel better paying their taxes knowing that their money went to an agency they support. If "John Smith" wants to support the troops he might choose for his tax dollars to go to the Defense Dept. If "Jane Doe" feels our infrastructure needs improvement she might choose for her tax dollars to go to Transportation Dept for new bridges/highways/airport improvements, etc. Congress has shown they can't be trusted to spend money wisely. Congress is under the influence of special interest. Plus the tax payer wont bitch so much when they can pick which agency receives their tax dollars. Lets see what the tax payer thinks is more important. Currently the Defense budget is about $580 Billion while Education is about $70 Billion. Smaller agencies might get absorbed into larger agencies in order to get funded... but these agencies will have to appeal directly to the American taxpayer for their tax dollars. Each agency will have to outline their responsibilities and how they plan to use the tax payers money. If the taxpayers get it wrong or some agency gets under-funded there is always next year for the tax payer to get it right. Eventually the right balance will be struck and Americans will get a government more inline with their wishes.

nanocalp the wars have been possible only because of the debt created since the inception of the federal reserve. Yes income taxes do support the one institution whose health is dependent on war. With out interest payments raised through income taxes the secret cabal of international bankers never would have been interested in funding the state's century of almost continuous and total war since 1913. It is not a coincidence that the central bank, the income tax and a century of total war came about simultaneously.
@brandell4638
@brandell4638 8 жыл бұрын
Unfortunately the basis of this is flawed. No money from income taxation goes to services. Money collected is used to pay interest only on loans from the federal reserve and other private banks that people mistakenly think are government agencies. As there is more owed at all times than actual money in existence, it is impossible to ever be debt free, unless we stand up and eliminate the use of these banks and walk away from the amount owed by refusing or filing federal bankruptcy. Oddly enough, there is no actual basis in law for federal taxation and the IRS admits it's a 'voluntary' system. So.... how do we accept criminal treatment in the USA for a voluntary and baseless by law tax?

It is totally legal to avoid taxes but not to evade taxes.The only taxes we have to pay are sales tax and property tax. If you have a working farm your real estate taxes can be greatly reduced. Income tax can be avoided by living in your house for 2 years and then selling it because capital gains on your residence are not taxable. Also if we live frugally and simply we will not be making enough money to be required to pay income tax.

For those of us in the private sector, the IRS *wouldn't even know we exist* if it weren't for our workplaces sending erroneous information returns (e.g., Forms W-2, 1099) to it. There is a *lawful* way of correcting any erroneous information returns already sent to the IRS when you send in your annual Form 1040, though. There are private-sector Americans who have done just that, resulting in getting refunds of *ALL* withheld amounts, including Social Security, Medicare contributions as well as FIT.

The courts have decided that when you sell a service, your profit is the difference between the money you paid to enable yourself to do that service and the money you receive for it. Which means if you go to work at someone else's business, you use your employer's equipment and you don't pay anything out of pocket for doing so, all the money you receive counts as profit - and is taxable.

So….. does he still not pay taxes or did he go back to paying them? Sounds like he must have started paying them again or they wouldn’t have let him about of jail. So if he’s paying them again, seems like the ultimate lesson he got from this is that it’s better to just pay them. But they leave that unsaid and try to imply that the lesson is to not pay taxes… I’m not inclined to trust a message that is being told in such an underhanded way

None of the taxes from the IRS goes to any of the things we think they do lol the things we think it all goes towards comes from buying various things. Roads from gas, public schools come from narcotics i believe. can't remember the correlation list, but uh yeah. The IRS is supposed to send you a list of how your money gets distributed, but they don't.

The state uses the taxes taken from gas and oil to pay a lot of the cost of roads and such. Can you imagine the amount of money the state makes of people buying gas alone to drive? They Def use most of our dollars for corrupt and/or poor choices

This is amazing, I'm interested. But looking back, I think Quakers would be more effective not simply refusing to pay taxes but being politically involved about creating change and that's with Progressive policy.

It's not common, but civil disobedience gained prominence in the civil rights era. My father, a practicing Quaker, around 1960 sailed the boat he made to the South Pacific where the US was doing nuclear testing. He was arrested. Our family friend went to jail as a conscientious objector because he wouldn't submit to the US military draft. He was in jail for about 2 years. Another Quaker friend was drafted, but refused to bear arms, and served in the kitchen instead.

Why keep books? (is he making millions?)lol they don't know what they cant see! Thats why in Sweden a lot of business owners get paid under the table. (50% goes to tax) If your depositing money then thats a record. Otherwise only claim / deposit 20k there really isn't any tax on that,( if any) matter of fact if they come and want you to file taxes, you may qualify for the EIC 4k per child, plus many other deductions. and end up getting money back, more than you would have to pay in. I couldn't tell you , when suing ,how many companies will avoid turning over records and getting away with it. Claiming they dont have it. You cant enforce it, only the IRS can and they can only go on what you wrote down and whats in your account. They need a trail. lol best to find out how they do their "Examinations" previously Audit and be prepared.

John a If you are talking about the welfare system when you talk about the poor then that’s destructive as it makes people lazy, dependent and crushes peoples ambitions. The police spend mostly extort people and impose the politicians will on people. The government doesn’t make the roads there are companies that do that. Government doesn’t produce the money tax payers do that. Tax payers can just pay the companies that build the roads
@nfwaeft
@nfwaeft 4 жыл бұрын
@@FirstLast-ys7zn Thanks for preaching to us your view of a welfare system. But, I say this as earnestly as I can, given that we live in a market economy, every action is considered by its monetary value. Should everyone pursue a career in banking? Should every teacher pursue a career in private test prep? It already nevertheless occurs, e.g. with decreasing opportunities to even study the humanities in academia in favor of a bubblingly rapidly expanding STEM field, but remove a democratizing medium like resource allocation and redistribution, and all future generations are likely to be even further obligated to assign a monetary value to everything, and if born in, e.g. a city repeatedly suffering from conflict and a lack of consistent education, vs. born to a family with the means to relocate during conflict to safety and have access to private education, there is no equal opportunity. The disparities can be much more mild than this and still there cannot be an equal opportunity to participate in the market. I don't know about you, but to me that sounds far from free, unless you happened to luck out in the birth game and benefited from a lot of head starts in life. Many pacifists and quakers of the past struggled against not only laws they saw as unjust but the community they belonged to that was in favor of such laws. The interviewee in this video, for example, has a problem with where his tax money is going, as opposed to the conceptual nature of taxation. Unless we isolate ourselves into smaller communities of dozens or hundreds, we live in a society of hundreds of millions where wealth and income will, over time and generations, disproportionately skew to a decreasing percentage, as is the case in the US today. In most current situations, and for most people, welfare money is not quite enough to send someone into prolonged laziness. But we have welfare, so that those who receive it, and their household members, including newborns, might have the freedom to learn without interruption, to eat healthy, to enjoy a reduction of poverty-related crime in their neighborhoods, and therefore stability, and then perhaps back contribute to society, because it is a society we live in. Welfare can allow for workers to look for other job opportunities by allowing pauses between jobs, and makes education more accessible. Problems with resource mismanagement/incompetence and external lobbyist influence/corruption are not unique to welfare states, and in a theoretical pure free market economy, efficiency = profit, and businesses have no direct duty to their society, subject to the societal costs of trade (namely industrial waste) with no guaranteed share of private profits. This is a Quaker video; not many would prefer their society be one where money, individual gain, is by definition more valued than doing good. Good governance forced into transparency/honesty by a strong and highly participative democracy are the least worst options for us now, at least for the immediate future.

As someone who is an advocate for high taxation, specifically for the purposes of a strong welfare system and large investment in public infrastructure for the benefit of all citizens, I initially came to this video expecting to disagree with this man, but he makes a good point regarding the endless wars. I know if I myself was a US citizen (I'm from New Zealand - where our tax dollars aren't used for wars, but to help our own people), I would make a similar principled stand. Much respect!
