I’m retired from 30 years in big city police and later, federal law enforcement. I’ve done many interviews for many kinds of cases. I cannot stress enough the importance of consulting with an attorney prior to giving a statement, and having that attorney present during an interview. A good attorney would have helped him bring out more detail. His description of the offender’s actions lacks critical details justifying his actions, that we learned from witness testimony at trial. His responses to the detectives lack a serious tone and he appears almost happy he was involved in a confrontation. He did not know at the time of the interview the offender died, but regardless, if you’re talking with law enforcement about something you’re directly involved in, not just as a witness, get an attorney before you make any statements. There is nothing casual about being interviewed by law enforcement.

You make really good points. I commented before reading yours. I feel the truth may lie in the middle. Still the fact Penny acts so giddy, like these detectives are his buddies he met at a bar is kind of off. He just killed a man, and whether he may not be fully aware of that, he may still know that it was the case. I have seen interviews of war veterans who killed enemy combatants and showed respect and somberness about the lives they ended. Penny seems to show some kind of narcissistic or sociopathic traits. Maybe he read too many super hero cartoons growing up. Weren't 2 people who held the Neely down worried that Penny was holding too tight and say something? Penny comes across too full of himself in this interrogation. If I were a juror and I saw this it would make me feel he is guilty on some level. There is something reckless in his behavior. His intention might have been to not kill Neely, still this interrogation makes him appear careless and reckless somehow

@@stefpix I couldn't disagree with you more. I've interviewed many hundreds of people, including offenders, victims, and victims who defended themselves and/or who defended others against attacks. I'm no psychiatrist, but I'm sure I've met people with narcissistic or sociopathic traits. I'm certain of that. LEOs get formal interview training, with rapport building and analysis of body language. Employing those learned skills many times over, good interviewers can work with almost anyone, and also identify narcissistic and sociopathic traits. Good interviewers will play those traits against the subject. Penny isn't full of himself. His apparent cockyness is likely a defense measure, knowing he had morally good intentions, and also knowing the situation is serious; more serious than a fight on the subway. He'd know that because he was sitting in a police station. Given his military background, which I think has no disciplinary or UMCJ history, he has likely known others who have engaged in unlawful conduct, and he likely witnessed fellow marines being taken in for questioning for serious matters, verses small offenses and simple questioning by uniformed officers on the street or at a base. He's clearly not simple-minded. He has a comfort level, because he is used to authority figures, and he shares a common bond with one of the detectives, who was a marine. Penny gave an honest interview, backed up by many witnesses, all of whom are independent of Penny, and are considered impartial, unless otherwise proven. My only point is that Penny would have been served better if he had asked for an attorney before questioning. A skilled defense attorney would have aided him in being more guarded with his responses, and sticking to more detailed material facts of why he needed to restrain Neely. Penny could have stated more of Neely's threats, directed at specific people, rather than using a few general examples. Neely was aggressively in people's faces, shouting specific threats. That's what the witnesses say. An important element of the offense of Assault, anywhere in the country, is when the victim is placed in immediate fear of receiving a battery. In some states there are different degrees of assault, such as fear vs. unlawful touching. Other states break it out as assault (fear) and battery (unlawful touching). There were multiple people who gave statements and later testimony of being in fear for their physical safety. It would have served him better to be more detailed about things Neely said to specific victims. Nevertheless, this interview is a solid defense, backed up by witnesses. There is nothing wrong with Penny. He defended others against violence, which often requires its own violence. The key point in this case is whether Penny was reckless or negligent, or were his actions reasonable and lawful. I have my opinion, but admittedly, I haven't heard everything the jury has, and likely neither has anyone who is commenting on this post.

I understand from what you say he may feel camraderie with the detectives because there may be affinity between people in law enforcement and in the military. I have been living in NYC for more than 2 decades and I have seen a lot and in recent years there are more and more people with severe mental issues roaming the streets. So somehow stepping in and trying to deal with a potentially dangerous situation, putting oneself at risk is something to be appreciated. Penny seemed to have training and strength, and put Neely in a chokehold for a long time. Penny in this clip shows no concern nor interest for the person he subdued and killed. He seems very casual about it. I understand that soldiers may be trained at dehumanizing their adversaries and enemies. But Neely was someone desperate with a mental breakdown. In the chokehold video it seems the 2 bystanders who joined in to help restrain Neely had concern about him breathing. All this gives me the impression that Penny, as you say acted "cocky", both at the interrogation and during the chokehold. The 2 other people restaining Neely showed more awareness. All this gives me the impression that Penny lacks humanity. Of course the situation was stressful, traumatic and Penny may have been in shock. But to my eye there is something offputting. I just watched this today for the first time. I was pretty half way about Penny, in the polarized public opinion. After seeing this, I can see he had good intentions, but also he is a person that lacks a sense of depth and may feel a bit like a super hero, or maybe he is just immature. Or maybe it is how soldiers are trained. Having grown up in Europe, sometimes I feel life in the US is cheap, and lethal force is justified more than elsewhere. I was put in a chockehold once by a bouncer because I had a camera at a nightclub where a friend was DJing. I was ok to leave, I just had asked to allow me to let my friends know I was leaving. He put me in a chokehold. I could not make any sound nor inhale or exhale at all. In my view it was unreasonable and I was not really expecting it. They pushed me out. I can imagine how being in a choke hold for minutes can kill you. I go spearfishing, so I am used to hold my breath underwater. I shoot fish with a speargun. I do eat the fish. But I know I am taking a life. I look at the fish in the eyes and I know they want to live, I wonder if they feel fear and what kind of physical pain. Of course if I eat sushi at a Japanese restaurant, someone else killed the fish, and those thoughts do not come to mind. Still even if Penny killed in some sort of self defense situation, he seems so cavalier about it. He seems so reckless, like his brain works on a reptilian level. It is offputting seeing him treating the detectives like they are new buddies he met at the gym or at a bar. I can see the detective does not fall for it and they seem professional and neutral. If I were a juror, and I was shown this, I would think Penny has some degree of guilt and would also need to go through psychiatric evaluation and mandated counseling as part of a sentence.

@@stefpixYour comment really resonated with me, I only looked into all of this for the first time this morning and felt uncomfortable with how binary people were in their view of it.. I’m European and one of my first thoughts in response to people’s reactions was that life seems to have less value in the USA. I understand that at this point he may not have understood the man was dead, which arguably makes a huge difference to how you would behave. But even when I watched the body cam interviews of witnesses I was struck by how unphased they were by a man lying dead a few metres away. Of course I understand he was threatening.. but even still I would feel a shock and sadness to see a life taken before my eyes. It is a very very sad situation. On a side not, I’ve seen many people commenting that if you don’t live in New York don’t judge, as it is very intimidating when threatened in public. So I keep in mind I can’t fully understand.

@ I’m a native NYer been riding nyc subways for over 50 years. Went to elementary, High School, College, Work and rode the subways to the nightlife on those subways. There’s no bathrooms so you’ll be stepping on human feces and urine. During rush hour you’ll be crushed with other people like a can of sardine where pickpockets go to work. It’s very common to see thieves snatch jewelry, handbags and cell phones as the doors closes. When I see an addict asking for money I give them a couple of bucks cause that person might rob someone weaker like an elderly. That video I saw of Penny choking Neely is sickening. Two men holding Neely while Penny choked Neely till he passed out and kept choking for 51 seconds. Watch an MMA fight see how fast the ref stops chokeholds or better yet, walk into any MMA gym and ask someone to put you in a chokehold while two other people are holding your hands for 6 minutes.

Better to remain silent than slip into the traps that the investigators are throwing out constantly. You have your rights to remain silent, use them until a professional shows up to help you.

@@marcmestanas2277 Cops are expert interrogators and employ a lot tactics to get you to say things that will work against you in court. They will try to trip you up, get you to admit to things you may not have done and use you to build their case against you for them. They will lead you to believe they have information and evidence on you they don't have and even make it seem desirable for you to admit to things you didn't do just to make the case resolve faster. It happened to me when I was 19 years old. I had nothing to do with a crime that committed, but cops thought that because I worked at a facility where it took place, they'd see if they could get something out of me. They did the good cop/bad cop routine, told me if I admitted to the crime, it would be over soon and even told me they had audio recordings of me phoning in bomb threats. I was a kid. I was intimidated more than you can imagine and I almost admitted to it just to make them stop. And I did it all without a lawyer present because I was so overwhelmed, I didn't understand my Miranda rights. If you are suspected of a crime, NEVER speak to the police. Period.

It's true that you shouldn't talk to them if they are determined to prosecute you. Most people talk to the cops because they believe that will preempt prosecution, and they're usually right. It's a gamble. Keep in mind that even being prosecuted for something like this is a huge problem for most people. At the end of the day, I would be pretty surprised if this prosecution results in a conviction. The prosecution itself is his prescribed punishment.

There is a point, early in the investigation, where the police are trying to figure out their theory of what happened and haven't really decided who they are going to prosecute, or whether they will prosecute anyone. Obviously, in this case, they had already decided what they were going to do.

It would be better if you could identify a particular circumstance where they are clearly gunning for you and you should not talk to them. For example: if they bring you into an interrogation room, is that always time to ask for a lawyer, or does it happen innocently? If you are talking to police on the street, what are some signs you may be a suspect? Obviously, if you feel that you have committed a crime, you should probably not talk to them without a lawyer. But what if you don't think you've committed a crime? People have killed under similar circumstances and not faced any kind of prosecution in other parts of the country. One has to believe they were cooperating with police in order to get that outcome. Am I wrong?

Cops are highly organized when they want something. Additional powers, leniency, raises. Cops do this to someone, and listen to the crickets chirping. Deafening silence from the hog lot. Not one of them will speak out against and it couldn't paint a clearer picture of their ethics. They'll do anything for a paycheck, they'll even do this to their fellow marine. I think there are probably street hookers and drug dealers with better ethics. I bet those detectives were high fiving each other when they strolled out of that interrogation room, then exchanged congratulatory BJs.

Does not matter really in his case. And at times remaining silent makes your case worse (See Derek Chauvin) Talking to cops without an attorney would only cause problem to you if you would have commited a crimed and you need to change your story which would cause inconsistency later on, or if you are incriminating yourself by giving details. He did not incriminated himself and his statement was consistent with the witness statements and thr camera recordings. So overall it was actually good point for him.

Always understand that these detectives are looking to have a case that implicates you whenever you are interrogated. They are trying to provide the prosecutor with any statements that you make that can be used against you in a court proceeding. When they read you your rights before the "interview", always say that you understand the rights and elect not to talk without legal representation, then shut-up. Never, Never, NEVER talk to the police or prosecutors without a lawyer present. They are not your friends.

Well he didn't, according to the clips I've seen he continued with that neck grip, and that was his mistake. I dont think it was intentional at all, but yet, he hold it for too long.

Former ADA here. Recent submission to NY POST: To The Editor: Marine vet Daniel Penny is a hero and deserves an immediate acquittal-by a brave judge or a reasonable jury. (“Daniel Penny stepped up to save his fellow New Yorkers-and now he faces prison” Opinion, November 18, 2024). He should then be invited to the White House to receive the Presidential Medal of Freedom on January 21, 2025. President Trump will be busy signing executive orders on January 20th to undue the wreckage that the dotard in chief has wrought, but Daniel Penny’s heroism should be recognized the next day. He protected us with his service in the Marines and protected all New Yorkers by stepping up. Semper fi! . No intent I agree. But he was slightly negligent seeing he was trained in grappling while in the marines. He should have known it only takes six seconds of squeezing someone next to put them unconscious. It’s unfortunate for everybody involved. He could of eased up on the choke and still maintained control of the guy

@ well, I’ve been properly trained to box by a boxer. So if some crazy dude attacks me and he’s swinging and happens to miss and i clock him causing a concussion…… looks like I was the better fighter, just like when animals attack each other. A fight will never be this “even Steven” fight where both are the same sex, same age, same weight, size, of the exact same skill, throw the exact same amount of punches with the same force etc etc. a fight is a fight, not the survivors fault that they beat the attacker. 💁🏽♂️ with this guy, hopped up on drugs and saying someone’s going to die today, I wouldn’t risk him having the ability to get away from me either, so. The attacker made the choice to threaten lives and he got restrained and juts like “that other guy” that a cop restrained, more than likely died from the drugs. But that’s me

He talked to the police and he buried himself. I learned that the hard way. I talked to the NYPD detectives over something that was basically an accident. Got 3 years for it.

@ He absolutely did. He said he just wanted to restrain the guy. A rear naked choke is considered deadly force. You can only use deadly force in response to a deadly threat. He should have said he was scared for his life when the guy threatened to kill everybody, and he used a rear naked choke to fight for his life and the passengers lives.

I’m prior Marine. Intervening is what we do! We are trained to protect and we are trained to take out a threat immediately! You can not let the threat get a foothold of the situation. However, we are also trained to be smart. And my brother Daniel should have been smart enough, immediately after his rights were read, to ONLY say,,,,, “I need my attorney here before I say another word”! The prior Marine officer,,,, I felt uneasy about that dude!
