As painful as it is, this is good advice. All great things must come to an end. Start your own memories that your immediate family will cherish following the example set by your grandfather. That is the best way to honour his memory.

This is weird. Maybe it’s because when my grandparents (all 4 of them) passed away, the only thing I inherited was $1000 from 1 of them (for my college tuition) and the other 3 gave me $0. Because their inheritance was for their kids aka my parents/aunts/uncles. Why this grandkid wants to skip over the entire generation before him, I have no clue. Rude as hell. Get over it, sir.

Because he seems like he would like it to stay in the family for sentimental reasons (its only $70,000) and seems to think his aunt would lose it because she can't pay property taxes on it, or would sell it, he wants it to stay in the family because of his memories.

Paul is wrong to even go after this. It's not right to sit around and expect an inheritance from anyone. It's the reason I'm leaving all my money to my favorite charity. I don't want a bunch of vultures fighting over my bank accounts etc. after I die. It's disgusting IMHO. If you want a lakeside house, save your own money and go buy one.

Do you think your family will fight about it? Dave often recommends just telling everyone ahead of time. It sounds like you have a low opinion of your family. It's your money, by all means, but your reasoning isn't charitable, if that makes sense.

Yeah I wonder if the aunt is the oldest. Writing other family members out of the property isnt necessarily a bad thing for cleanliness, owning a property with family members can get messy. If the mom wanted the aunt to inheret the house (by convincing or otherwise) then thats who gets the house. Grandson just wants it as a holiday home. He just spent holidays there. If the aunt grew up there itd mean more to her. So, he might be being a bit of a brat. Dave talks him down at then thankfully.

Yeah, Def not taking the aunts side bc ppl influence elderly for their own self interests regularly, but the caller seems to only consider his ties to the property, and it verges on entitlement. That aunt likely has more ties due to being older and by the nature of numbers, spent more time with her PARENTS there. They could literally be coming from the same exact feelings.

Great advice dave. Had this exact same situation in our family with a house less than 2 miles away from sofi stadium in inglewood. It ended up going into foreclosure bc my aunt and uncle werent making the payments. Supposedly they went under my grandparents nose to get the house signed under their name. Also Supposedly they pulled equity out to help another auntie purchase her home. It got forclosed on and there was big facebook drama, which for us nieces and nephews was fun watching. The house is gone and we all still love each other. Its behind us with no bad blood and now we are all grown with our own homes

I had an aunt do this. She talked my grandmother into allowing her to be the sole executor of her will and then proceeded to rob her siblings blind. My family opted not to sue her because anything gained would have gone to legal fees. Everyone in my family cut off contact with her after that. I truly wonder if she believes it was worth it.

This happened to my mom her sister got my mom’s mother to change the will and cut the rest of the family out. My father called my mom’s sister up and said very nicely do the right thing. That was all it took and she wrote my mom the check. That was all they were going to do they talked to her nicely and then they said we will leave it to the Lord let his “WILL” be done on earth as it is in heaven.

A diagnosis of loss of legal capacity 60 days after a will was signed is NOT going to invalidate the will. What matters is capacity at the time of signing. Unless there is probable cause to contest it, he's quite unlikely to win. He probably doesn't even have standing to contest it because he wouldn't receive anything if the will was invalidated. Sincerely, an estate planning attorney.

I'm going to be honest. Before having a very old father who has developed a lot of health problems, advancing dementia, and now having to live in a board & care, my feelings about the Aunt would not have been good. They still may not be, but if grandma is relying on this Aunt for a lot care, companionship, and the behind-the-scenes of caring for a very old, ill, elderly adult, owning the whole house solely may be just compensation for everything the Aunt may well be doing for sick Grandma. Unless you have had to take over the life of a very elderly person, you have no idea how challenging and time-consuming i5 actually is. Keeping track of taxes, medications, Medi-Cal, Medi-Caid, all legal stuff; wow it's a headache!!!

I experienced this with both my grandmas.......ironically back to back. My nana on my dad's side who I lived with during college days needed a lot of medication over time, mostly me and my uncle fetched it and the food until he moved away down south. At one point I was renovating the house we stayed in (with a botched up deed) as I went to school and worked part-time......EXHAUSTING don't even come CLOSE! My neighbor was kind enough to help finance the labor from the carpenter who re-built the house up from the foundation, while her elder brother helped with electrical and plumbing tasks. From an early age nana suffered a big foot injury when a truck ran over her foot and suffered severe back injuries stemming from it. Her back hurt so bad she could barely get up the stairs....so happy her suffering is over. Then I had to move temporarily as the property we were all working to rebuild and planned to rent out to college students was in a legal bind due to some crooked family members swooping in and illegally getting the deed signed over downtown. While my uncle battled them in court for 2 years I stayed with my grandmother in another town not too far away so I could continue to get to school, she developed Alzheimer's and dementia. My aunts mostly rotated visiting my grandma on my mom's side, but this one particular greedy aunt who was closer to grandpa (not through blood) was selfish and began not allowing the other aunts to visit the property. She wanted to claim she was performing all the care so she could hog all the money for herself at the end, when others wanted to visit and help out. In the end she sold the property off and cut everyone else out of the deal. All tremendous headaches and yeah....the caring of elders is a big job in general. My uncle actually won the court case against my crooked family on the other side of things and got a money order, of course most of that went to legal fees.

Oh wow this was an interesting video! I learned something new! And as for the caller, you are not entitled to that property… there is another generation ahead of you. My husband has been dealing with this for the past 10 years. He has a father and aunt who will inherit the land… then FIVE people in his generation (the grandkids) who will inherit if the property isn’t sold by then! Just move on and we will buy our own property with our own money.

If the caller is right, then his aunt immorally convinced a 95 woman who wouldn’t have all her faculties, to cut people out of her will that she otherwise would have. Now obviously we are only hearing his side of the story, but taking it at face value, what the aunt did is obviously wrong

My uncle tried to do something similar before my grandma passed. For me it wasn't about the inheritance, it was about him manipulating an elderly person. Essentiaply said I don't want anything but I also don't want a relationship with you.

Before wanting to keep it for your family / children make sure your children really want it. The child / grandchildren often don’t have the same attachment that you do. I agree with Dave, just let it go.

Yeah, it's tragic when this happens. But, this didn't happen when the grandma was gone. It happened while she is still alive. Make sure your affairs are in order and your will, trust, etc, are rock solid and can't be manipulated.

I was just in that place 5 months ago when my mother passed. House went to her partner and not us kids because she was not thinking straight due to alcoholism. House is not worth much, if we could overturn a sketchy will it would have to be divided by 3 of us kids and I’m living overseas. I let it go, reluctantly, but I’ve moved on. Not my fight this time.

A real, answer, as opposed to flip reaction, would require knowing the rest of what the will said, why the grandmother thought this was a good idea, what you think the aunt is going to do and why, and why this caller wants the property. I mean why does he think it's better for him to end up the sole owner, than her ending up as the sole owner? Is the grandmother leaving one person the $70k in real estate, and everyone else $70,000 in krugerands? Who's living there at the moment? Anyone giving advice with this little information is telling you more about their own prejudices and inclinations than the problem at hand. It might be better to just pile up a bunch of cash and wait for the property to be sold outright. Or it might be better to remember that home is people, not property.

Dave, you’re wrong about how tax sales work. I invest in tax properties in TN and in here the person redeeming the property is required to pay you back the full amount you paid PLUS interest at 1%a month PLUS any “reasonable” expenses you incurred in up keeping the property during the redemption period. For example: insurance costs, repairs needed to prevent damage to property like a roof leak, etc. Tax properties are actually a good investment, if the owner redeems you made a 12% return on your money and if they don’t redeem, you get a cheap house!

They don't even need to be rich. My grandma didn't have any money when she died. The man she was married to absconded with her will. We don't even know what her wishes were. His son then went on to attempt to kill him, and stole from him. It was very messy, that's not even the half of it. When my grandma was in her last days, and these vultures were surfacing to visit her in the hospital, my father said at the group level: "Show of hands, who doesn't want to be in the will?" and raised his hand. Looking around, he said, "The rest of you can leave." You better believe they left lol

I live in Florida and there is no inheritance tax in Florida. And if she listed the property as a primary residence, she won't pay property tax due to the dollar value of the property.

It might be right... but... I did just look up florida right of redemption tax lien stuff. I am not a lawyer... but what google said... 2 years plus 18%. At least it would be a reasonable interest rate. So yeah... you could scoop it up potentially. During a probate it would have to come out. Unless you have it in place now and your granny passes in over 2 years. Then it is still tougn because there has to be some sort of notification process... and that will have to be followed to a T. It would be investing money and mental space is correct... it might end up in court. Lawyers are not cheap. What would happen if instead of that... you took the time in the next 2 years to work hard and save every penny and then make your own family's dreams happen? Ask your aunt for a bunch of photos and maybe something else from the estate that is important to you and tell her if you can take the memories you won't fight the will. The tax law was interesting tho.

This happened to my husband. 3 sons one of which was my husband’s father. He passed away and one of the sons managed to have the will changed naming him as executor of their mother’s estate. Mother dies and estate is distributed equally between the 2 remaining sons who subsequently pass away and my husband’s cousins inherit. My husband got nothing. He choose not to contest will because he didn’t want to fight over his grandmother’s estate. Honor. It’s not fair but the right thing to do. Estate was worth about 2.5m.

My uncle did this to his brothers, screwed them over. My uncle has no family now. We weren’t greedy, we KNEW what grams wishes were and HE violated her trust/wishes.

Years ago, a friend said that in Florida, you purchase the tax lien, the owner must pay you plus interest within the specified period or you get title. Most were interested in usable residential property, not the vacant lots. Since the property in question is a low value lot and tear down, this might work

That’s not always the case. Some people actually care about legacy. When a person who is grossly irresponsible inherits something that hold sentimental value, it sucks. People want things they can’t afford and then say oh well when it blows up. It is not greedy to want to hold onto something that holds sentimental to you for whatever reason. He even stated this in the video. He said it isn’t worth that much.

My Aunt did the same thing. She waited until my grandma was frail and starting to have Alzheimer's. She changed the trust to give herself all of the money and the house. The house was supposed to go to her and my dad get the money for his care. He is a disabled veteran with seizures. He has no savings really. I have an adult child with a disability and I'm the only person who can care for my dad. That money would have helped with house cleaning here and there, his house is falling into disrepair and needs a lot of work and we could have used it to pay care providers to help with rides to appointments when I can't do it. She hurt three generations of people. My dad isn't up for the legal fight with his health concerns. Not sure how any of these people will explain it when they meet their maker.

Im in California, i brought a parcel of land in 2022 but 3 k at a tax lien auction. They had a 1 year redemption period. But what Dave said is right, most people will redeem with the redemption period. But the buyer who redeems still has to pay you interest so either way its a win win to buy a tax lien.

My uncle pulled that stunt on my dad. I have no relationship with my cousins because they’re all greedy and now they have nothing while my parents and I are doing a lot better than them financially. My grandparents’ house is in a shamble. And they have no money to fix it.

3:54 Even if the grandmother didn't lose her mental capacity overnight a court would have to go with the actual date of declared mentally incompetent. If not then it would set a legal precedent of 'back dating' all legal forms. Eventually in the near future there would be someome looking for a 15 years grace period. If there is duress and fraud, that is another completely different legal matter.
