Yeah but it's totally academic. Rick has built a big channel over years of work, good work, which is 20 x bigger than this channel. If he would be in Rick' shoes, maybe he'd change his tune. And he can't deny that because he doesn't have the channel size, the point of view. Also, how YT reacts to things is so erratic that I would not chance it if I had Rick' channel size. The third party he involves here is going by something that is anecdotal, he could have had a strike. But here, in the end, he doesn't care if YT strikes his channel out of existence, he himself admits that he doesn't put much into it; no reasonable lighting, visual environment, himself. My advice for any music oriented KZbinrs, built your brand solidly, appeal to the eyes, the ears and the mind, post with regularity, don't bash on other KZbinrs, respect your audience, heed and study the KZbin/Google agreement, don't play with fire. Why, because it's a business you are building, not an activism organisation outlet.

No one is going to be like, "I want to listen to that Fleetwood Mac song...time to head to Rick's critique video!" or "I wanna play Mario, time to go watch a video!" No one does that. People watching these videos is NOT at the creator's expense. If people like the song and want to listen to it (or play the game or whatever), they aren't going to these videos. They're going to pull up the video for the song, go play the game, etc. Yet these videos are COMPLETELY cracked down on. It really is out of control.

So I'm not a lawyer, but my best guess as to why KZbin stops promoting the video heavily when it is disputed is maybe they're worried about the safe harbor provision which usually says platforms aren't liable for infringement done by users as long as the platform complies with the DMCA and promptly follows the rules / takedowns / appeals etc. Maybe promoting an infringing work (since they don't know whether it truly is at this point) would get them hauled into court disputing safe harbor? The copyright system is widely abused, as much as I like Rick's channel he does roll-over too readily. Understandably a "Big channel" does not want to be thrown off KZbin for strikes but these vexatious claims have become an industry. I can think of an automotive channel where they panic to turn the radio down when they switch on the ignition to make sure that not a single note of music is heard. The situation is utterly idiotic, normal creators live in fear of these strikes. When someone is using an angle grinder to cut steel trust me I am not concentrating on listening to the music they have playing in their garage. A lot of the time the artists themselves get blamed for this nonsense, which obviously poisons viewers against them.

Some of my buddies and I were Livestreaming Call Of Duty a couple of years ago and one of the guys had a radio playing in the background. He got a copyright strike for it. The dumbest friggin thing. It was completely inadvertent and unintentional.
@JKSawShop Жыл бұрын
Why are we getting punished for either radio playing or for other people on the other end of a gamer’s chat. I see no fault on the creator.
@Powermad-bu4em Жыл бұрын
@@JKSawShop Exactly. If I remember correct it was a Michael Jackson song that literally only played through our stream for maybe 10 seconds before my buddy turned his radio down. After that we stuck to Twitch.

From Google/KZbin documentation: "The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes." If you are in business for profit, you cannot claim fair use. Also, what Paul Davids was talking about was non-copyright holders filing fake claims. Totally different that what Beato is referring to. Also, "Essentially, a copyright claim is someone asserting that you have used their content, whether that be a video clip, an image, or a piece of audio." If you get multiple claims, you risk copyright strikes and you can lose your channel. "A copyright strike is much more serious for a KZbin creator, and your channel can be suspended for repeated copyright offenses."
@TheGuitologist Жыл бұрын
It’s not at all true that it has to be non-profit. You think teachers work for free? You can profit from fair use content. It’s just one of several criteria.
@TheGuitologist Жыл бұрын
As for strikes…they expire after 90 days, in the unlikely even you even receive one. But you must receive 3 within a 90 day period to have your channel taken down. It’s not a strike until you lose a dispute. And you won’t lose a dispute unless you’re going to be sued. Believe me, I know this inside out. Fair use is there precisely so people can have free speech when it comes to commentary and criticism. What Beato does with the song analysis videos is absolutely 100% fair use.
@TonyThomas10000 Жыл бұрын
@@TheGuitologist From the legal sources I reviewed: "Commercial use does not automatically make the use copyright infringement, but it is an important deciding factor." That is why you can get a copyright strike even if you are using the content for educational purposes.
@TonyThomas10000 Жыл бұрын
@@TheGuitologist I think a lot of people have given up because they don't want to spend all of their time dealing with takedown notices and copyright strikes. Many of the music education channels have moved over to Nebula or put their content behind paywalls.
@TonyThomas10000 Жыл бұрын
Also, KZbin does not arbitrate copyright disputes unless they are fake claims. With Rick Beato, he gets a lot of takedowns. And there is no way to fix those unless the copyright owner agrees.

Are people now so cowed that they just roll over at the drop of a hat by anything their corporate masters say? And it's not even universally applied. If I post a video critiquing a new book just released by quoting some passages, am I going to get a claim filed against me? No? What's the difference?

My last copyright was someone trying to claim my CNC router noise as a song, appealed that and it was dropped first go. Years ago now. Knew then you've really gotta appeal. The fingerprinting wasn't that great yet, probably still isnt. I think the only report I actually pulled the video down was the death threat from Will Gelvin, but I did that because it had 20th Century Predator movie content, not really due to his complaint. It was probably going down anyways.
