Classified documents are maintained under a strict chain of custody - there are logbooks that are maintained with who checked-out and checked-in those documents. Someone - some department - manages and controls those documents (CIA, FBI, military, etc.). How - and who helped - Donnie gather and keep over 300 classified documents to himself - who helped him to have those documents in his possession when he packed up? Did it happen over a long or short period of time - immediately prior to leaving office (within days, months) - or was this a strange habitual occurrence over his term? After some amount of time (days, weeks, months?), wouldn't someone in control of maintaining control over those documents get concerned, and ask about their whereabouts, and having them returned? How could Donnie (a guy who was notoriously known for ignoring classified briefings) have ALL of those documents in his possession without SOMEONE in that control and custody chain not knowing it? How did Donnie keep so many documents without someone helping him? I suspect it is questions like these that the FBI and DOJ are looking into ... that is why Donnie has not been indicted/charged yet - there is a network of treason at work, and they are trying to uncover as many heads of the hydra as possible, before lopping them off.

That process isn't really retroactive--especially considering he's not the president anymore, D W. Regardless, there's still the crime of taking government documents in the first place. Documents he obviously knew he had stolen because he said he declassified them, which since he knew he had them and failed to return them leads to a further charge of obstruction. So that's three crimes right there. Then there is the state of the documents that he had held onto for over 18 months, and those that are missing (maybe he ate them, or maybe he flushed them, or maybe he gave them to his friend Mr. Bone Saw), those would be espionage act violations and possible treason.

Again there is a declassification process in place to ensure in part that US interests, resources, methods, and materials are safeguarded. If they were declassified you should be able to see that on the material itself. AND he still should not be in procession of it, it belongs in NARA's hands first and it is up to them (and national intelligence) what to permit access to. It's not his. He's like a car thief.
