His car was towed meaning he was out at least several hundred dollars at the very minimum to get it back. He spent at least one night in jail. And then he had to go through months of dealing with the BS and four(!) appearances before it was all dropped. Penalties for malicious prosecution need to become harsher and applied to any case such as this where it's clear that's what it was and put into their own case and any damages awarded is docked out of the involved officers pay. Shit would stop in a heartbeat then.

Equality under the law is something I hold dearly (something I have not yet seen any government in any country abide by) so if we restrict the plain view doctrine then the government is allowed to tell you that your eyes can trespass and we end up with a bigger mess than today. They had to drop the charge since the statue includes "refuses to identify himself..." as a cause for arrest which violates the 4th amendment and could get the whole statue thrown out as unconstitutional.
