criminalvibez I know this example is slightly (a lot) exaggerated, but when 6 yo boy would me I technically should defend myself, but there is a little amount of damage for him to cause to me. Instead of going full attack on him I can, I do not know, hold him or even just go around. For homelander everyone is like 6yo, even less.

That's actually a good point. People get harsher sentences depending on what a "reasonable person" would do in that situation and everyone/the jury/your peers vote on that. I think everyone here at the very least can agree that a "reasonable person" in his situation would have simply pushed around and disarmed them

@@leminer4049 I would go that far and say that he should not even be brutal, I mean when disarming someone he would need to use a 0,000001% of his strength. Absolutely no laser eyes, no punching, pushing, nothing. He should treat everyone as now adults treat children. You can be firm, sometimes shout but never go violent. Because he is in no danger from anybody. Except compound V people, but this is a different story.

The weird thing with Homelander is that since bullets, beer cans, etc can't hurt him. I think the self-defense argument can be void since he was never in any real danger to begin with. I think the only actual case of self-defense here might be Maive since she was clearly able to knock him around.

@u.m.9931 With Ryan, he's also suped up and likely incapable of being harmed by beer cans. This makes the beer can more or less battery since something as simple as splashing water on someone can be considered batery. Since the guy only threw the one can and stopped, he ceased being a threat. Homelander engaded in an act of retaliantion with a deadly weapon by killing him. Also, self-defense has to come with proportional force, meaning you can't use deadly force to defend against non-lethal battery.

It's funny to notice that the voluntary decision not to save anyone on the plane, since he, more than anyone else, could do it, would constitute a crime in most legal systems that adopt German or French origins. He wouldn't be charged for not saving all of them, but not doing anything and just watching while he could do without any peril to himself is a crime in many other countries, including Brazil.

5:07 If I recall correctly the guys Homelander was killing in this scene were ISIS members. I don't think Syria would prosecute him for killing them. ISIS was actively at war with the Syrian Government and is considered a terrorist group by them, just like the US and everyone else. While the Syrian Government has not authorized the US presence in the country, and therefore may be interested in pursing international litigation for Homelander's presence in the country being part of an illegal military op, they most certainly would NOT object to that operation killing active terrorists/enemies of the state. Most likely, Syria would however absolutely charge him for arming those same terrorist beforehand.

3rd party safety counts as self defense. He was trying (though not very Hard) to save the pilot Who was In immidiate danger. + his Quick reaction speed probably isnt always on. Though He made a mistake In not immidiately killing him, Even that May be understandable as the pain of the laser Would have made him shoot the pilot.

Since he's bullerproof, has ultra reflex and speed and he intentionally doesn't act careful on his missions, I think barely anything he did can count as self-defense. One of the stuff that does count as self-defense is when the terrorist fell through the plane door.

all the charges are handled separately in the event of an appeal if his 8/9 of his death sentences successfully got appealed for example, he would still have the one left and still have to serve that it just streamlines the process
