Notice how they aren't just blindly shooting at everyone on the street, they are shooting at the guy with superpowers agressively hunting them down. That can be seen a threat to their lives, so if anything they are the ones acting in self defense. They are criminals the shooting was reckless but it would not have happened at all if Spider-Man wasn't chasing after them to illegally arrest them then steal their car.

Just goes to show that nothing is black and white. No matter how much good Spider-Man does, it doesn't change the fact that he's an outlaw who's taken the law into his own hands. But at the same time we understand why he does so and also why if he did things by the book, then his loved ones would be in danger and why he can't afford to do things the normal way or pretty much any superhero for that matter.

It actually adds another layer to crime fighting. Someone that can do something to do good by stopping bad people will have to trespass the law in order to be successful. Similar to how a cop has a free pass to do certain illegal acts, you as a civilian also have to be conscious of law management, because you might commit crimes unknowingly, but you might get a free pass to commit others under certain circumstances. That can both be good and bad, because if your intent is to do good, you still might get penalized for it, but if your intent is to do evil, you might not even get alerted about it. Case and point, justice sucks.

Yeah, almost all of these charges are dumb and would not be pursued within the greater context of the situations. Like I have trouble believing any of the assault charges would stick or even be brought in the first place, considering in 99% of these cases he’s trying to stop a fleeing suspect involved in a violent (and sometimes borderline-terroristic) crime. Contrary to popular belief and what movies like these might typically suggest, vigilantism is actually somewhat legal in the U.S. You’re allowed to use “reasonable force” to stop someone currently in the process of committing a crime or who is suspected of having just committed a crime and is currently fleeing under the pretense of performing a “citizen’s arrest”. The only actual crimes he committed that he would actually be charged with are (unsurprisingly) the ones he committed while wearing the black suit, such as destroying Eddie’s camera (destruction of personal property), attempted murder on Sandman, going to Harry’s house to confront him and beat him up (assault), and assaulting MJ and the club bouncers.

Was it really assault for the beginning of Spider-Man 2 ? I recall that those 2 thugs almost ran him over with their reckless driving and they fired at him with an assault rifle. Has he not stopped them, they would have caused more harm. Also, one of the thugs in Spider-Man 1 was robbing a woman using a gun, it was self-defense. The other thugs he fights were comitting an armed robbery and grand larceny, citizens have the right to defend someone else's property if it doesn't lead to a homicide.

You, however, do not have a legal duty to protect someone else unless you put them into the dangerous situation [you tell the third party to beat someone up] or you have some duty to the person [your child perhaps]. Assault is being close enough to harm someone and doing some action that they reasonably can expect harm from you; battery is the actual hitting of the person or something attached to him [his cane, wheelchair sitting in]. You are limited to reasonable force necessary to stop the third party, although the other poster is correct that if someone is beating up a child or disabled person, the police will not likely charge you [police departments do not require officers to arrest or cite everyone who is breaking the law, the officer has the discretion to act or not]. So in a barroom brawl, you certainly can pull the opponents apart, but then they both will probably want to hit you instead.
