The problem with Blair here is that she doesn’t have the means or will to pay off employees, so it’s inevitable that the NDAs are challenged.

That's not how NDAs work. Dating your boss doesn't void the NDA. Your boss using the NDA to prevent you from talking about their illegal activity will void it though because you can't use an NDA to cover up a crime.

slapp lawsuits are getting away with financially burdening the other party, and still can take 1-2 yeras to be litigated and appealed. It's a disgusting weapon, even if the innocent partyy wins and gets attorney fees, its only after severe emotional strain, time commitments, and hundreds of thousands of dollars they didnt have for those years. Our current legal system is absolutely awful and needs serious reform.

Am a lawyer. I doubt she'll be labeled a vexatious litigant...that takes A LOT. And CO's anti-SLAPP isn't as strong as many people seem to believe, so it's entirely possible. I foresee a few 12(b)(6) motions in her future. And "with prejudice" isn't as likely as you may want/believe.

There’s a lady in the town I live at the owns an Italian restaurant and she has her employees sign an NDA that basically states that they can’t make or sell Italian foods when they leave. She walked into an establishment that like a bakery/coffee shop that one of her ex employees work at and tried to tell them they couldn’t sell Italian bake goods even though the NDA didn’t even have the employees name on it. The owner of the coffee shop looked at her looked at the NDA told her the NDA was blank that it wouldn’t hold up in court. Some people just really like to go on power trips.

This seems like a mutually assured destruction, it feels like pure vengeance. I haven't seen any signs that she isn't guilty of crimes regarding the way she treated those around her, and i am pretty sure she isn't on the best standing leg for this lawsuit, much less for how massive her demands are. She is trying to cause damage, but in the end most of the damage will end coming back to her, she is either going to sink alone or sink everyone else with her, and as i see it, we can't let her get away with it. I genuinely doubt she can prove all that was presented is a lie, much less that she didn't violate multiple laws herself due to how she treated her employees and ex-employees.

NDAs are weird, most companies use them and you've likely signed one without realising it with your employer. My contract states that I can't share inside information with 3rd parties or use insider knowledge to create my own business that competes with my employer. I think that particular clause remains in place even if I leave the company, but they'll never actually take legal action if I did decide to create a business that competes with them.

Well, this could be interesting as NDAs are by definition a mess. Unlike things like the "At Will" agreement it targets different basic rights a person is assumed to have and it's been handled different ways. As a general rule NDAs are designed to protect trade secrets, but they are oftentimes written to include things they cannot do where you sign them as an intimidation tactic. Likewise if you have a dispute with the company, what can be covered by the NDA can be very touchy, as can arguments about what should be considered public knowledge based on things that had been revealed to the media, or come up in court cases. The reason why this could get interesting is that I am assuming Illuminaughty is probably going to claim that this should be covered under the NDA because in order to defend herself against what amounts to slander she would have to reveal trade secrets and business practices just to defend herself, and they know this, so this behavior should be prohibited. This is not a direct use of an NDA to gag someone or hold them accountable just for speaking, but similar things have happened. I don't even pretend to entirely understand the logic but from where I'm sitting it's the only thing that makes sense unless in their state they are in the conflict itself existing doesn't in a large part negate the NDA. Given the public nature of the whole thing, I'd be surprised if it doesn't get thrown out if that is her primary argument, but this is an area where I know some stuff due to things I was involved with, but not a whole lot. Otherwise the whole mess reminds me of how much of a shark pit youtube can be, and how quickly popularity can go bad. It's a big part of why I've never been fond of social media. I mostly only have been listening to this because I mostly knew Illuminaughty from her covering multi-level marketing a while back, and she seemed basically okay, and none of her information was bad as far as I could tell. I didn't follow any of her other stuff, and while there are some serious allegations about Plagiarism and such involved now, I also get the impression a lot of this is extremely personal for the people covering it.

Hi caleb, i am a fan i'm a 61 year old woman, and i have to say that i agree with you about 98% of the time i think you're right on point i think you're very intelligent i think your sense of humor is bar none and i enjoy your videos thoroughly, today you said something that really bothered me something in the lines of our great justice system in truth will win and yada yada yada, i want you to know that that's probably true for our country's wealthy but when it comes to poor people like myself and my son you're absolutely wrong you only win in this justice system if you can afford to win my son is serving a life sentence without parole for an accidental shooting so his lawyers dropped the ball big time it was awful it wasn't even close to justice , no justice doesn't always work not if you're poor not in America.!! I can only sit around and dream about how it would have went if i could have afforded a decent lawyer for my son but instead i am a woman that has had her heart ripped out and completely obliterated ! I'm sure if it wasn't for the fact that my son needs me now more than ever i would probably die of heartbreak and he's 41 just so you can get an idea i'm not talking about a child i'm only talking about my child, my only child to be precise. So yeah i have no faith in the justice system or the public pretenders in America.... none zero zilch!!🥺 I will add this is all happened this year, he was sentenced in april , even though i don't have faith in our justice system i certainly hope that the appellate system works, but so far i'm concerned because his appellate attorney hasn't even bothered to call me, he told her to call me because i did sit through the mess they want to call a trial. i've reached out to an organization that provides pro bono so i keep my fingers crossed and i pray .

I feel for you. As a victim of DV by my female parent as a child and as an adult while living with her out of necessity due to my disabling chronic illness I learned unless you have money to hire skilled representation you're up a creek without a paddle. I sought an order of protection to stop the physical, financial and emotional abuse that's worsened my existing medical condition, harmed my mental health and caused me to have multiple cardiac events. I couldn't afford a lawyer and or find a pro bono lawyer so I represented myself. My mother, however, hired a criminal defense attorney who worked for the state for 20+ years to represent her. I dropped the case during the plenary hearing because I couldn't go up against a criminal defense attorney. All I wanted was relief from her abuse only I couldn't afford it. 😫
