Real world experience. Be careful with this. I owned a banner towing company in Phoenix Az. One of my pilots was towing a large billboard in the Mesa area on a hot summer day. It was very thermally. While over downtown Mesa he encountered sink he could not overcome until he flew through it and out the other side causing him to descend below 1000agl even though he was firewalled. As soon as he was able he returned to the appropriate altitude. This was witnessed apparently by a Mesa PD helicopter whose pilot was known to like turning in pilots for violations within “his airspace”. He did so. He contacted me irate about my pilot and stated he would be turning in my pilot for an airspace violation. At the suggestion of AOPA a NASA form was filed. On the initial contact from the FAA about the incident the NASA form number was provided. Next, my pilot got a letter of 6 month suspension from the FAA. He called them and asked what about an investigation? Answer was there was no need for an investigation because he convicted himself with the information he provided within the NASA form that he had filled out and provided them the number of. Upon asking “hey what the heck? I thought this information could not be used against you?” He was told that NASA form information cannot be used to initiate an action against you. However, should someone else initiate it, what is said in the NASA form is fair game and since he admitted deviating below 1000agl over a congested area he had convicted himself, no need for an investigation, and his license was revoked for 6 months. Now this was many years back, probably mid 90’s. The Mesa PD chopper guy that initiated this, did stuff like this to so many pilots that there were references to it in some of the flying magazines. And this was not the “kinder gentler” FAA we are dealing with now. However, we were both shocked at the way this played out and it took that pilots ability to earn a living for 6 months with no investigation or appeal on the basis of the information he provided on the NASA form. Be careful.

Ten other pilots with 3+ video cameras and ADS-B in + other glass cockpit recording equipment should follow that guy around and report his butt for every real and dubious violation of every kind possible ... until he is no longer in the air. Humans like that shouldn't be alive, much less in the air.

Can I add also, as long as you're honest with the FAA, they'll just give you a slap in the hand and tell you not to do it again. I've had to fill an ASAP report before as a mechanic. And just like you said, they'll send you a letter stating what corrective action they'll take. Unless they find you've done something on purpose, their actions should be minimal to none.

Being a newly minted Private Pilot myself, with about 150 hours under my belt, there is always the possibility of some "slip up", especially for those of us who have done 90% of our primary training in the "uncontrolled" or "pilot controlled" environment!! As they say, the Private Pilot certificate is really a license to "begin to do the real learning"!

This is cool. I didn't know about this. Here's some more info for anyone who's interested: asrs.arc.nasa.gov/overview/immunity.html Section 9 C explains how it works (emphasis added): "The FAA considers the filing of a report with NASA concerning an incident or occurrence involving a violation of 49 U.S.C. subtitle VII or the 14 CFR to be *indicative of a constructive attitude*. Such an attitude will tend to prevent future violations. Accordingly, although a finding of violation may be made, neither a civil penalty nor certificate suspension will be imposed" It lists a few conditions - one is that you can only use the 'get out of jail free' option once every 5 years. Good to know!

it is called Aviation Safety Reporting System; I filed ( twice actually ) then later find my report was flawed but nobody can touch me see *[**asrs.arc.nasa.gov/]* ••• They are efficient and correct; You can with only moderate effort discover a very remarkable issue here: The *ENTIRE* Max-8 issue will have some reports; Digging through all of it is what takes time •• I took the stubb in from one of my reports to the part 141 that I use and laid it on the desk; Greg knows there is no way to find what I said; It is very much worth the effort to do *Recent subjects of ASRS research include: wake turbulence analysis, digital avionics software and hardware problems, TCAS II incidents, cockpit interactions incidents analysis, airport ramp safety incidents, crew performance during aircraft malfunctions, air carrier return-to-land incidents, use of digital flight data to measure safety and crew performance*

A quick check of our route showed we were not going over ATL so we told Atlanta Center we were not filed that way.
