Yes you are right that police law requires reform and that should be done at the earliest. Secondly, I support the use of handcuffs in cases where criminals are very dangerous or where police suspect that they may run away.

Thank you Swami ji. Let's hope this is the beginning of the reforms. Modiji in one of his Independence speech said reform needs to start at home...every parent need to ask their male child where has he been what was he doing....then there would not be rape....in India...

Personally, I am very pessimistic on police reform, under any ruling dispensation-all politicians like to accumulate power, and are loath to lose it unless there is a lot of public pressure (Praveen)

You made a very good point. Police in India still behave like they are masters of people and our political class want them to behave like that. Specially Mr Modi like politicians. If we read Stories by Premchand,we can see the terror a DAROGA used to have and for poor people, it is still the same.

@@AmalTan Yes, Police is under state. But why do you guys get triggered by even mention of Modi name? I said, Modi likes politicians. Didi, Kejariwal, Stalin, etc all are in that category. And all politicians want the police to behave like that only. Modi is PM and he is changing the IPC. So his responsibilities are more.

If that means not having police reforms than every CM in the country falls in that category. Nothing "special" about modi. Isn't it? As far as IPC and CrPC are conerned, they come under criminal justice system which is part of concurrent list, so yes there modi has a role to play but not policing.

@@AmalTan Modi like Politicians mean, Control freak Politicians, who wanted everything in der control. And after Indira Gandhi, Modi is that type of PM. And he didn't have control? He has all the controls. What he has done in Gujarat as CM and what his party is doing is more than any other leader has done. All CM takes precedence from the current PM, whether they belong to the same party or other. Modi, as PM is guardian of the country and he has these responsibilities. And when he/his government is claiming to remove "Angrejon ka Kanoon" then they must take the responsibility of police reforms and if they are not doing it or even talking about it, they are implicit in this. You talk about opposition states showing an example. Yes they can but they still depend on the centre to allow governors to pass der bills. If Modi decides to do it, 10+ States will pass it and then entire country will do it. Why is he not showing the way as a leader? Why is he not setting an example? Opposition ruled states can have one more fear that if they will fo police reforms then they will lose control over police and They will not be able to punish der opposition but Modi ji will punish them by using CBI, ED, IT, etc. But it will not matter to Modi ji and BJP. And after doing this, They can politically force Opposition states to do it. So don't do so much Bhakti that you get triggered by some name. Be JANATA and not CHAMCHA. Not the Chamcha orlf Modi or Rahul or Indira or Kejariwal or Lalu or Mamata and so on. I didn't even use Yogi name in my first comment bcz I was not talking about individual CM but one example for everyone for clarity.

@@BharatThatIsIndia Couple of logical fallacies in your arguments: 1. You say Modi like Indira is control-freak so does not allow police reforms. But between Indira and Modi there was 3 decade gap, police refroms must have come in this period if these leaders are to blame. 2. CMs take precedence from PM only when it suites them. If PM is the guardian of the country then CM are of state. 3. PM can only be blamed because he took the responsibility of removing "Angrejon ka Kanoon". For others it is not even a issue. 4. On last point I agree with you that if opposition ruled states does police reforms, they would have no tool while Modi has CBI, IT and ED. But you must acknowledge that these agencies can only trouble you, not punish. If you are innocent you at last prove it in courts like modi did in Gujarat riots and manmohan in coal scam otherwise like lalu and chautala get punished. For politicians jail is not an issue it only increases their popularity. At last we both can agree on the need of police reforms especially for comman man. Every leader should be pressed for it.

Wait, mandatory deadlines for charge sheets is not a massive improvement? Mandatory chain of custody is not a massive improvement? Tightening the definition of sedition is not a massive improvement? These qualitative improvement are not something anti plagiarism software can assess nor can it understand the massive relief it provides to common citizenry. The common citizen don’t have the luxury of proximity to Lutyens to help them work through the system. But somehow, these things aren’t enough unless if it gives media full impunity to engage in it’s own circus and media trials. At some point in time, folks in the media should take off their horse blinders and get out of their group think mentality.

The new and old IPC, CRPC, and Evidence Act have to be administered by a police force. Police force which do not, and cannot, investigate crime impartially and objectively will file a terrible chargesheet, irrespective of whether it takes them 9, 90 or 900 days. I think anyone who has followed the fate of criminal justice in our country can see that! (Praveen)

That many provisions of old laws have been reproduced in the new Bills is itself not something to be labelled as plagiarism. Can the definition of common law crimes such as theft, assault, battery, robbery, homicide change just for the heck of it? Police reform is not a part of criminal law reform. It is a different ball game. Let us appreciate that nobody can make a perfect law. Law is organic and grows with time.

I haven’t said it’s plagiarism. I said a plagiarism-checking software detected that over four-fifths of the text was common. Those are two different statements.

I think the approach of analysis is incorrect. It doesn't make sense analysing random quotations from the colonial era, where as the actual amendments in the law are dismissed via a plagiarism software. The quantity of unchanged provisions have no significance at all. A lot of definitions of crime like murder, robbery, etc will obviously remain unchanged. What you need to analyse is the quality of the amendments made. This has been missed, and you are going around bushes for police reports and racial inequality of 50 years back. Agreed the police need reforms. Doesn't mean these amendments will have no effect. In fact many are towards faster processing of cases, a huge problem currently in India.

Let's be honest, there will be no police reforms. Most of the police reforms are to be enacted or implemented at state government level. If Modi wanted police reform, he would have brought the same as CM of Gujarat, way back in the early 2000s. And the way Modi govt is using CBI and ED, it is clear that they don't want an independent and impartial police, but as Praveen sir has said, a subservient colonial style police who serves its masters and not the public. Forget Modi, almost no politician is going to bring police reforms due to some enlightened sense of justice and fairness. Police reforms and comprehensive criminal justice reforms will happen only when it becomes an electoral issue, when people start pressing politicians for the same. But people in India....we are busy with other "so called" imp issues - we have to watch IPL, we have to see biased partial debates on TV, we have to spread hate and falsehood on social media, we have to support emotional political calls ....and what not. We don't have time for trivial things like Police reforms, or prison reforms, or overall criminal justice reforms.
