Courts have to send strong signals so that provisions cannot be misused by agencies under the control of the govt of the day. The scope of the Enforcement Directorate's suspicions and presumptions, lacking supporting reasons, is void. Kejriwal is lawfully entitled to defend himself against these suspicions. The notion of constitutional morality regarding resignation is not binding, especially given the flawed enforcement of legislation against the defendant. In an interrogation the accused have the right to be silent generally but not under the PMLA act. Under this act one's silence itself may prove to be perilous. It's like auto-immune disease, where in one's immunity itself aggravates one's problem. Secondly, these are hardcore politicians with a lot of legal help and so cannot play a victim card. They should be able to not only counter the arguments put forward by the enforcement directorate but also may turn the tables, if they are genuine. So a sympathy shown to an ordinary citizen cannot be extended automatically to a political leader.

Kejriwal being the accused , his interrogation pending, recording of statement and confrontation with other accused, and unearthing the electronic evidence - all this has to happen. If he has responded to summons , went for questioning in the first place and co operated in the investigation, all these things wouldn't have happened. If he has given correct information regarding the crime, when the first summons were issued, by now chargesheet could have been filed and case trial would have started. Present PMLA Act is too rubbish.....it violates the fundamental rights...... "YOU ARE GUILTY TILL PROVEN INNOCENT" ..... Which was amended in 2018 by BJP govt and made it too tough to get bail ...... The accused should be in jail or judicial custody till the trail completes 😢😢😢😢😢

Technically, Much like in US constitution, The Indian Constitution also gives an accused person The Right to remain Silent. So ED can't force Kejri to make confession. It is ED's job to investigate and bring evidence.

How about Andhrapradesh liquor policy.? Where Govt is running liquor business on its own ? Where all ruling leaders are running distilleries , manufacturing liw quality liquor on Minami names ? And top of that liquor sale against cash only refusing digital payments . Lots of scope is there in this procedure of sales against cash to sell without bills evasing GST and the volume of liquor unaccounted by the exice department. Is central vigilance or GST dept or much boasted ED dept are nor aware of this misappropriation volume of liquor sales that too against cash only as if it is mandatory .? Is central govt blind enough especially in Andhrapradesh. Can't central vigilance has no role when looting of national wealth like natural mines , sand , quartz, iron ware when the state ruling legislative leaders are getting involved in the loot silencing all the executive systems ? What's the role and purpose of the state executive governer in safeguarding the national wealth and the national character in a state under this quasi federal structure of the Indian constitution.? When no one is or no system is responsible for the happenings of daylight loots of national wealth , what's the purpose of the much boasted Indian democracy Where a citizen has no right either to question or to stop the loot of national wealth , what's the purpose of democratic systems? Only to authorise the legislative systems to rule and ride on the populations and on their lives ? When there are no check Dams floods overflow and do all damages to the habitats , like wise it's happening repeatedly in this licensing system of rule , for name sake democratically. Say once again Bharath Mahan or go on yelling it for ever till the country get looted by it's own sons of the soil. What a disgracing system!!!
