I'M THE CHALK ARTIST I've been harassed by the police over a dozen times since receiving my settlement. Had one officer jump out of his cruiser cursing me, one that unlawfully cuffed me before giving me a Criminal Mischief ticket, and then a Criminal Trespassing where I got locked up 20 hours and the arresting officer lost my wallet, oh, and just recently got a new citation for "Possession of a graffiti implement" I most commonly post on instagram since I struggle to get traction on most of the other platforms. Thanks for covering my story and being sure to provide people with the information to see more!

The even more messed up part about the chalk is there were 19,000 cars stolen in San Antonio over the past 12 months. We have a fentanyl epidemic and feces covered neighborhoods...they can't stop the fent dealers or the car thieves, but they have time to stop sidewalk chalk.

Wow…yes, Leon Valley truly sucks. Did any of the other arrests/tickets happen in San Antonio proper? I’m taking my grandson to a public park later today..thinking about stopping by dollar tree for chalk. He loves to chalk the sidewalk at home…

That officer was so convinced that he was right that he wouldn't even listen to his supervisor when he told him that drawing with chalk wasn't an arrestable offence.

He knew. He twists his words, mumbles a little, pretends he didn't hear the supervisor. I suspect he's padding his activity stats, the numbers aren't going to tell you what kind of arrests or if they ended up sticking, just that an arrest took place, thus showing the officer is being "active"

I've been saying this for years. If a citizen wasn't fully aware of the law, that is not a valid excuse. If a cop, who works with the law every day, and his job title is LAW ENFORCEMENT, isn't fully aware of the law, that protects him from civil liability. That has NEVER made sense to me.

No, the system should be able to handle bad calls. Its not the citizens job to understand what is and isnt graffiti in the local municipality. Citizens shouldnt be expected to know the law before calling the police, the police need to be expected to know the laws fhat they are enforcing.

In the old newspaper Dear Abbey advice column series, her most often advice was MYOB (Mind Your Own Business). This advice would apply here. If it is so serious that a person thinks they MUST call 911, the caller should be required to provide their name, address and date of birth (cops CRAVE IDs) so they can be summoned to court to testify as a witness.

The thing is, I'm a programmer. I should know about how code works and test it properly before pushing it. If I push code to a server that crashes a server, I get fired. Conversely, if a cop arrests someone because they "didn't know the law," that cop continues working as if nothing happened. Cops should suffer severe penalties if they "don't know the law."

True! Have you seen the video where extremely dense cops end up killing an exotic snake and all its eggs in a mistake? I cant recall the price but I think it was tens of thousands of dollars. The guy who was taking care of the snake got extremely frustrated and mad at the cops and went out the back door to vent off. One cop was told to "Go with him and keep an eye on him". I have no doubt they wanted to get just SOMETHING on him - maybe an overreaction.

I called PD on a angry vagrant at the front of one of the buildings at work and it took two and a half hours for someone to come out (I left after an hour, because I have other things to do) they went to the back of the building, called me then wanted me to come show them where the person I called about was then said it could be considered a false report, until I told them it was over two hours after I called, I waited an hour and I had to leave and by that time the vagrant had left as well. You didn’t do what you needed to do in reasonable amount of time, so now it’s my fault the person was gone when you showed up. Wtf!?

25 years ago There wasn't a habit of limiting the max IQ of new hires. 25 years ago police where not primarily revenue officers, they were Law Officers and Peace officers, and while bad cops and even bad departments existed they were seen as embarrassments, not 'tough on crime'. Though it wasn't long after things started to change, you may have seen the early hints. My mom's 2nd husband was a deputy Sherriff who left to work as a heavy materials delivery/pickup driver for a construction company. Because that rural Midwest county had gone from being about stopping the H.S. students beer bash in a farmers field, pulling over speeders or drunk drivers, dealing with the occasional fight or even shoplifter at the gas-station to dealing the newly booming meth trade. Then the sheriff himself found the FBI snooping into his professional life and jump off a chair while wearing a rope, at least it was presumed by his own choice. That was doubted by some after the next Sherriff gave till end of week notice and left town for a new job across the country in like 6 days, hired someone to sell his house and afaik never came near this state again. When things got serious with my mom, and found out his 1st grandchild was on the way he decided it was time to get out while he could. He retired almost a decade later due to health issues (bum knee from old injury finally put him to needing a cane and his heart health got pretty iffy). This was almost 20 years ago.

I think that it would be almost impossible to know every single law, code, or city ordaniance. The cop was so sure of the graffity law that he didn't even care to double check himself to know that chalk would fall into that catagory. Which is crazy to me, should the cop had call in to see if he could issue a citation or arrest? Could he not look up the code before engaging the stop/investigation?

In one respect it’s not unreasonable that they don’t know every single statute, law, caveat of every single law. They receive basic training in “the law” I. Additionally to first aid, fire arms training (safety, cleaning and maintenance, firing), dealing with crowds, handling EDPs, crime scene management, etc. all within the space of a few months. Lawyers on the other hand are educated for years - and some of them still mis-interpret and abuse the law. So IMO sometimes officers deserve the benefit of the doubt. In the flip side they need to use common sense and under stand that sometimes complainants are incorrect and they (not the person about whose the complaint was filed) are in the wrong.

Criminal mischief is arrestable though. Which is ridiculous, the law being broad saying any "markings" without consent of the owner can be arrestable. The law needs to be changed, and the officers really shouldn't have pushed the law. But legally, they were allowed to. Hence a C-. They were rude, started with the wrong charges (which legally they can just change in the middle of an arrest applied by qualified immunity. Which to me also needs to be changed that's bull) but the officers had every legal right to do what they did. The problem is the law that kept these power tripping punks within the law.

@@francisseidel8014 okay but you do realize you can't host a party in a public park without a permit. Peddle/ solicit without a permit. You can't have a band performance without a noise permit. There's also event permits, the permission is from the city. It's called a permit. Granted you can still host a party and play a band without one, just, don't be surprised when you get cited 😂 public park doesn't mean you can do whatever you want there.

A friend chalked the footpath (sidewalk) with "bunny rabbit foot prints" for his daughter on Easter. One neighbour went and washed them off. Some people want others to suffer for nothing. Such a shame.

8:32 The training officer also lied to his supervisor to try and justify the arrest. "I dunno, the water is not washing it off so it's going to take a little bit of time." He never tried to wash it off and it hadn't rained enough yet to know that. I say he should get an F for that alone.

That did stick out to me. It really makes me wonder just how often people will barely inspect something or even blatantly lie about checking it out at all, as opposed to taking the time to absolutely confirm that something is the case? I imagine the cops saw someone doing an activity that they didn't approve of, perceived the person to have an attitude and/or was being difficult, and so decided that the person was being "disorderly". Some people really do not need to be cops if simply feeling disrespected is enough for them to arrest someone.

Why the judge find him guilty? I bet he represented himself which was not a good idea but he needs to appeal. Judges at superior court don’t know jack shit about the law; they just decide based on their impression and feeling. The jaywalking guy needs to lawyer up and appeal and take this case to Supreme Court if necessary. Although justices sitting at the Supreme Court ain’t the brightest cookies in their field at the moment. What a shame! Our democracy is a sham!

It all depends on the temperament of the judge, if they're of the same mind, wanting to back the blue no matter what, then they're gonna side with the cop every time. I can clearly see what happened here. As soon as this guy said he wanted to file a complaint, they immediately did everything to run interference. First, they tried to get him to verbalize his complaint to the sergeant, saying he's the guy to talk to. No paper trail that would necessitate an investigation into the complaint. Failing that, suddenly they were VERY concerned with finding out who he was. They wanted to see if he came in a car so they could run the tag and find his identity, but he was on foot, so they couldn't do that. So they clearly followed him waiting for ANY sort of pretext to stop him and get his information. Because once they found out who he was, now they can go into their records to see why he might be filing a complaint, and take pre-emptive measures to run interference in an investigation. There was no reason to follow him off the property just because he didn't wish to identify himself and wanted to file a complaint in writing, which he has the right to do. Everything that happened once he left the station was 100% police overrreach.

Yes and no (mostly yes IMHO). It was in a sense created by Scotus, however it was based on the British common law that basically fills in where no law exists or where it can clear up a borderline case. Thus it's not entirely woven out of thin air. However as it is applied it's ripe for abuse, as evidenced by the significant abuse seen. While the constitution only mentions common law once (7th amendment) it does provide the framework the founders were most familiar with and was likely a source of guidance and inspiration in forming of constitutions and laws thereunder.

Exactly, ATA seems to highly favor the cops side unless it is clearly obvious that it’s totally wrong. Would love to see him score LIA (since they’re friends and business partners). I like him because he’s truly exposing a lot on his channel but his scores, his synopsis and his use of case law supports the cops. I’ve seen plenty of case law that contradicts the ones he posts. I do excuse him because one thing that keeps getting mentioned is does a reasonable officer see things the same way, but the reason we’re here videoing and auditing them is because most cops aren’t REASONABLE!!

I mean the whole reason he gave a C was due to the ambiguity with the law. As was seen in the second case, I didn't look into it myself but according to ATA the guy challenged the citation and lost. You can't give that a failing grade when the judge found it to be a lawful citation and constitutional can you? It was absolutely shitty of the cops, no doubt about that. But apparently, it was still technically legal.

I still disagree. The cops that beat Rodney king all got not guilty verdicts. So do you give them a C grade?? Absolutely not. The whole justice system is failing us. But we’re here in the court of public opinion. And especially after looking at the cops body came and he literally told one cop to find his car so they can I’d him and told another basically to follow him to get his ID then it’s an F!!

A C- is a pretty bad grade. If every grade is either an A+ or an F, there where is the nuance? Clearly they did pretty badly, and they got a bad grade. But the worst grades should be reserved for the worst comportment. And this comportment is, unfortunately, not the worst...

It's definitely a double standard for sure! I will say though that the second guy was a bit off. He went there to file a complaint. When he was with the guy who he would be filing the complaint with, he didn't want to because he was sure the officer would just protect the "blue line". So, what was the point in him going there in the first place if he thought any and all officers wouldn't do anything for him and just protect their brothers? It doesn't make any sense. That said, after the fact it was pretty clear that the officer was trying to get him in trouble for whatever he could, reasonable or not.

There are things you need like copies of the report, who you spoke to, etc. You don’t file complaints about police (assuming that, since he clearly does not like cops) with random cops who stopped you. You file them with internal affairs. He even said he would be back to file the report.

That cop did an excellent job proving him right. I love it when they make it easy to prove who they really are and who they really care about. Newmeyer was spitting facts and the cop kept trying to reassure him that he wasn't exactly what he proved himself to be. "You don't know me" We don't need to know you, the badge tells us everything we need to know about you.

Wonderful example on how if we didn’t know it was illegal, we are told “ignorance of the law doesn’t give you a pass” but when a cop doesn’t know the laws he’s enforcing, he gets a pat on the back and is told “we can’t hold you accountable because you didn’t know”

It's getting to the point where the Thin Blue Line is really the barrier between cops and citizens. Cops feel they don't have to follow the law but force everyone else to (outside of friends of the department, like the DA's office and certain judges), and if they can't find a valid reason, they'll twist the law to fit the crime.

Criminal mischief isn't a false arrest. They didn't get a C- for incompetence. It was for being rude and starting with graffiti charges then changed it. The problem is the law allows this, not that the officers used the law to make a, ridiculous arrest. They should've just let him go but the law left the officers within their rights. Hence a C-.

@@bchap1233 that loop hole is called qualified immunity. So yes they were within their rights. But also yes your correct it didn't stick. Yes your correct it was wrong they should've just let him go. However they didn't wrongfully arrest him, they did everything within the law. The law needs to be changed so qualified immunity can't protect officers who arrest you for a crime, then change the crime halfway through the arrest. They didn't violate any rights, they didn't do anything outside of their jurisdiction, but they most certainly didn't have to be so aggressive, or arrest someone just because they can. The guy was on a power trip and its crazy to think he was supposed to be training!

@@GwynneWalkerTrujillo No, this is not Nazi Germany. There is no "papers please" here. You must be suspected of a crime to be required by law to identify. The 4th amendment states that you have a right to be secure in your papers and effects, this includes ID.
