My one fiancee was denied in 1997 and other in 2004, both times "No proof of relationship" was falsified on the papers because both girls were verbally told different non-legal reasons for denial.

Knowing how to demonstrate your relationship to prove to the satisfaction of the consular officer that it is "bona fide" is a lot more difficult than it appears. This is where I spend the majority of my time on each case to give them the best change of success. This is an area where "Art" versus "science" is applied.

@@Visacoach If "No proof of relationship" is written on OF-194, and fiancees are told different non-legal reasons for denial, I call it bona-fide fraud. Ever heard of the doctrine of consular non-reviewability? Ever read the DOS Advisory Cable of 2004? Read how many times the word "factual" appears in that advisory cable. I'm an electrical engineer driving Uber but I'm not dumb.
@Visacoach5 жыл бұрын
Never was any comment made about intelligence. What was stated is that proving ones "bone fides" is not a simplistic, "engineering" excercise. It requires "art" and "nuance". You tried it your way, twice, and failed both times. Perhaps you should open your mind to alternative ways to achieve success. Anyway good luck with any future attempts you make.

@@Visacoach My odds of success were toss of a coin (50%), succeeded, failed, succeeded, failed. What I'm trying to tell you is that 90% of "No proof of relationship" denials have nothing to do with proof of relationship, which is merely falsified on the papers to force visa denials for other non-legal reasons which they can't write in the papers. Please read the DOS Advisory Cable from 2004 and ask yourself why the word "factual" appears 6 times in a single cable !!!

@@Visacoach Law of Entropy - unmanaged affairs only sink into chaos. When judges dismiss cases over the doctrine of consular non-reviewability, prosecutors play defense lawyers and the DOS treats its employees like it's children, this is exactly what would happen. You are legally required to meet in person only once.
@Visacoach4 жыл бұрын
To be eligible to apply for a fiance visa you need to have met at least once, and within 2 years of applying. However being eligible TO APPLY, and being likely to succeed and getting approved are not the same. The theme of my video, and my service in general is that couples who wish to overcome the skepticism that consular officers have regarding "romance" type visas, need to meet a higher standard of what they do, what they document and what they present in order to be successful.

When I work with a couple I provide detailed checklist of useful evidence to use. Then once the client provides me with a package of evidence I go through each bit carefully, weighing it's value, and including what best helps the case. There is a fine line between providing providing reasonable financial support and the appearance of "buying" a relationship. I make sure not to cross that line. Choosing the best and proper evidence to "win" a case is more Art than Science. Here at VisaCoach we excel at keeping our clients on track to win their cases.

Would an application for the cr1 visa be approved if you visit your spouse once a year for 3 years? One to two weeks at a time?
@Visacoach5 жыл бұрын
Sorry, that is too simplistic. What is required to be approved is to act like a bona fide couple, document your bona fide actions, and present them. Just traveling on a repeat basis is just the start.

So filing the petition immediately after an in person visit is optimal. What if this is your first time meeting your fiancé in person and you proposed during that trip? Would this be too fast to file immediately afterwards?
@Visacoach5 жыл бұрын
Given the choice to file soon after a trip, or long after a trip, sooner is better. Given the choice of filing before you have sufficient proofs of Bona Fides, or after, AFTER you have enough proofs is better. And HAVING enough proofs is more important, then the arbitrary timing of your trip.
@hav1byte11 ай бұрын
good information but what is enough proofs? texts, emails, photos, what does enough mean...good to know the timeline to takes trips, costly but in the best interest of the outcome...@@Visacoach

as far as the 90 days on a k-1 could the couple go to city hall and apply for a marriage licence and fulfill the requirement ? then down the line if they decide to have a wedding do it then
@Visacoach5 жыл бұрын
The rule is simple, the wedding must be CONDUCTED within 90 days, not just planned, not just discussed. If no wedding has taken place the foreigner must exit USA by day 90.

Is that enough for us to get approve to our I- 130 petition?

When I work with a couple, I get to know them really well. Then I suggest a rainbow selection of evidences that they can give me, that I in turn would make as part of the front loaded application I am crafting for them. It is only AFTER they give me their shoebox of evidences that I can review exactly what they have. I can see the quantity and quality of their evidences, that they actually have. Only after this detailed and intensive review can I give them a reading whether they have "enough to get approved". Sorry while you might have enough, I wouldn't know for sure, and could not guess, without your evidences and full story on my desk.

@Visacoach6 жыл бұрын
Sure, a K1 visa application can be prepared and submitted during your visit. You do not need to leave the USA first. This would serve to minimize the time you spend apart before your visa is approved and you can return. To get started ask your fiance to reach out to me at info@visacoach.com or www.visacoach.com/talk.html

I have travelled to my fiancee once a year for 2 years because of money and time constraints coz i have moved to another job. Will that affect the application? my next trip is May 2019 and planning to hire you. Should I hire you before my trip or after?Thanks
@Visacoach6 жыл бұрын
You do the best you can. Best practice is to hire me two or three months before your next trip, so that we can get your application 95% complete on my desk by the time you depart, and during your trip you have my checklists of what to do and bring back, so that we can complete and submit your application IMMEDIATELY upon your return.

Hi, I have a tourist visa and my fiancé and I have been alternating visits to see each other (i come to him, he comes to me) for the last 2 years. Once he submits the application in the US can I still fly to spend time with my fiancé while we have k1 visa processing? My vacation time from my work is more generous and lenient than his.
@Visacoach5 жыл бұрын
Each entry to USA is at the discretion of the inspecting officer. If you keep to your earlier routine of short and infrequent visits you probably will be able to visit without getting on immigration's radar. Once on the radar, you might have to hold off till the Fiance Visa is issued before returning.
