Neither being legally married, or pregnant on their own are reasons for approval. Demonstrating that the relationship between you and your spouse is "bona fide" not a "sham for immigration purposes" is the reason for approval.

The good news about registering your account with USCIS is that you get to see the messages USCIS is sending you a few days before the mail arrives. The bad news is that they post an "estimate till case decision". I have found that that estimate is worthless. It changes daily, up and down, at the end of the day did not reflect reality, and while a case is in process drives the applicants crazy with it daily, inconsistent, noise. My recommendation is to igore that figure entirely and not give it any credence, as it deserves none.

My wife just passed her medical exam. And has her interview in the next few weeks for her visa. The issue is the visa might get issued after. Jan 20,2025.. because she still has to do a CFO in her country. If she has the visa before he takes office ,can he restrict her from coming here

The CFO class is required by the Philippines Government and has nothing to do with US immigration, it is about Philippines allowing her to leave, so is unlikely to be affected by anything USA immigration does. The answer to "what can POSSIBLY happen ?" is virtually anything. What probably, may happen is descibed in the video. And what will happen, probably won't happen immediately, assuming the new administration has other higher priority items on their agenda, they want to address on the very first days of office, perhaps China?, Russia?

Fiancé visas are wierd how can you guarantee that the person won’t make a run for it once they are here. Or the abandon the marriage…. I have known cases like that … yet I am married and my spouse visa has taken longer … like we are actually married and ppl with. Fiancés visa only met the people months and sometimes they are a different race.

People fall in love all the time, some quickly, some take more time. People of all races, cultures, etc find each other, and sometimes they share the same genetics, sometimes not. Being married vs engaged is not a guarantee of a successful relationship. Afterall the divorce rate is probably over 50% world wide. What you do is enter into a serious relationship by getting to know the other person and doing your due diligence. Once you "know" that that person is the "right one" both fiance and spouse visa routes are both perfectly acceptable and should be chosen based on a couples agenda, and individual preferences.

It's not USCIS's responsibility to make sure the woman you love loves you back. Although they will vet her and try to see if the marriage will be success is up to you to know whether the woman truly loves you. It's also up to you on how you treat her to have her continuingly wanting to love you

If she gets a spouse visa, can she still stay in Philippines but visit me several months out of the year? We are in a situation where we both had elderly widow mothers. She also has all her siblings and daught, church etc. So I plan to move there when I retire. I tried a tourist visa but she was denied because she has no traveling experience.

A spouse visa is for those who wish to take up permanent residence in the USA, not for short visits. If your spouse can spend over half the time in USA, ie: 7 months of each 12 month period, then a spouse visa that provides permanent residence is attainable. If she does not want to remain in USA so long, then the visitor visa is the option that matchs her plans.

"Could she get a tourist visa?" Well, she can apply any time. But as she has been denied the chances of changing the minds of the decision makers who grant the visitor visa is unlikely. So as per the other question you asked, if your spouse wants to live in the USA at least 7 months of each 12 month period, the spouse visa is an option you can apply for. If that won't work, then she will not be arriving to USA.

Once your case has left NVC and sent to Accra, you contact Montreal and request that they take over the case. Once they agree, they will contact Accra and Accra will forward the case to Montreal.

Sorry to hear you are in that position. I council my clients to only book the medical, after the consulate appointment has been set, roughly two weeks prior to the interview. If you have registered with the booking website and paid your fees, and the calendar does not show openings, then you return to the website a few times a day, until you find an opending, and snap it up. They release openings randomly, so this is the only way.

An appeal is always optional. The question is is it a waste of time and money or not. That is what you would ask the attorney. In my experience the cost of an appeal is so high, and the chances of success so low, that in most cases it is more economical and effective to simply correct the issues that caused denial, and reapply with a new more solid application, that includes high quality evidence of a bona fide relationship, as well as directly addressing and solving the denial issues.
