As South Africans we need to approach the constitutional court to challenge the xenophobic claims made against the citizens of this country.

The ConCourt will only deal with constitutional matters. The High Court cam entertain a claim for damages if there is a person, or groups who can collectively sue the wrong doer. However, litigation is also expensive.

If the matter isn't resolved by the SAHRC or other courts, then yes, one could escalate it to the Constitutional Court. This usually means starting with a legal case in a lower court, like the Equality Court or High Court, depending on the specifics of the xenophobic statements. If the outcome there isn't satisfactory, you can appeal all the way up to the Constitutional Court. But let's be real here. It seems there's a tendency, particularly among certain far-right white liberals, to throw the term 'xenophobia' around as if it were some trendy, attention-grabbing buzzword. If you dig through the literature as far back as 2003, you'll find that headlines from white-owned media were the ones plastering 'xenophobia' across their pages, possibly to perpetuate the very stereotypes they now claim to fight against. here is some example for you: "Aliens Invading Our Streets" - Sunday Times (2003) "Illegal Immigrants Overrun SA's Cities" - The Star (2003) "Foreigners Blamed for Crime Surge" - Sowetan (2003) And now, suddenly, it’s all flipped-the same people who once pushed this narrative are labeling South Africans as xenophobic whenever we speak out about real issues like crime and drug trafficking. Even former President Mbeki questioned the use of 'xenophobia' to describe South Africans, who have lived side by side with people from across the continent for years. In many of our villages, Sotho nationals have found homes, married, and become part of our communities. So, please, let’s not pretend that we, as South Africans, can't bring cases to court just like AfroForum does. If they can rally as a minority group and raise funds to bring their issues to court, are you seriously suggesting we can’t do the same? Get real.

There is not xenophobia here, her parents are criminals and she was informed as she grewup. She had only a Nigerian and Mozambique flags. She is definitely not innocent and for her to go to home affairs is that she thought our systems were of sub standards. She is definitely not a citizen

100% agreed Based on Home Affairs findings, it appears that Chidimma was a beneficiary of a crime. It is unlikely that she didn't know that the name on her birth certificate is not that if her real mother. The proceeds of crime must be rectified and resolved. It's like being sold stolen goods, you don't get to keep it.

BTW, they sell IDs & Passports in Marabastad. If the Minister of Home Affairs really wants to work then he should go there and clean up that place. Get a Somali, Pakistani or Chinese family (because I heard this operation is run by 1 group from those 3) to go in there seeking help with IDs & Passports. Let's see what information we can gather from this process & if arrests can be made.

There are repercussions to any criminal activities. For example, if you use someone's medical aid to remove a tooth then yrs later the owner wants to remove the same tooth. This must teach all of us that crime does not pay

Using someone else’s medical aid fraudulently not only hurts that person but can also lead to legal troubles and a loss of trust. It's a clear reminder that honesty and integrity are always the best policies. Crime does not pay in the long run.

Another lawyer dishing incompetent advice Citizenship by descent Any person who is adopted in terms of the provisions of the Children’s Act by a South African citizen and whose birth is registered in accordance with theprovisions of the Births and Deaths Registration Act, 1992 (Act 51 of 1992), shall be a South African citizen by descent. By birth it's anyone born to at least one SA parent....(or born of a permanent residence holder but citizenship will be granted at 18 if they stayed in SA till then)
